R-2000- 85 A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute Contract Amendment No. 10, amending Supplemental Agreement to the Local Agency Agreement 94-57 with Huibregtse, Louman Associates, Inc., Consulting Engineers for Professional Engineering services on the I-82/Yakima Ave. project in the City of Yakima, City Project 1847. WHEREAS, the City of Yakima desires to proceed to the completion of the I-82/Yakima Avenue Project, and WHEREAS, the Yakima City Council deems it to be in the best interest of the City that the attached document, Contract Amendment No. 10, be executed by the City of Yakima, accordingly, now therefore. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: • The City Manager and City Clerk of the City of Yakima are hereby authorized and directed to execute Contract Amendment No. 10 to the Local Agency Agreement 94- 57 with Huibregtse, Louman Associates, Inc., Consulting Engineers in Yakima for Professional Engineering Services for the purpose mentioned above, a copy of which Contract Amendment is attached hereto and by reference made a part hereof. PE This letter and attached information is a summary of the status of our understanding of the wetlands mitigation issue for the above referenced project. History Two wetland areas were discovered to be impacted by the proposed construction of the TAR Ramp (the southbound off -ramp to the Gateway Center by Trailwagons). The two wetlands totaled approximately 18,245 square feet in area. A replacement wetland area was identified immediately adjacent to the impacted wetlands and the TAR Ramp and,a wetlands mitigation plan was developed by CH2M HILL for the 1.46 acre replacement site (an approximate 3.5 to 1 ratio). Chronology June 1995 - The Final Wetlands Mitigation Plan for the replacement site is submitted to WDOE. July 1995 The Mitigation Plan is approved by WDOE. However, due to extensive solid waste and debris discovered at the intended location of the replacement site, the mitigation plan was not implemented. 0 January to May 1996 - YK10-82 CH2M HILL developed an alternative wetland mitigation approach' to compensate for the impacts of the TAR Ramp construction. The site selected is approximately 1 mile north of the TAR Ramp, east of 1-82 and west of the Yakima Greenway. It was determined that this altemative site was just large enough to provide 1.46 acres of replacement wetlands at a suitable elevation. April 1996 to April 1999 The altemative wetlands mitigation approach was discussed informally with Cathy Reed (formerly Cathy Rajala) of WDOE; however, there was no formal submittal nor approval of the alternative mitigation site or plan. No action is taken on the wetlands mitigation issue. Sept. 1998 Huibregtse, Louman Associates, Inc. (HLA) is retained by the City of Yakima to complete certain items of the Yakima Avenue/I-82 Gateway Project including determining the status of the wetlands issue and completing the mitigation work required. Feb. 1999 CH2M HILL is retained as a subconsultant to HLA to compare actual wetland impacts from the TAR Ramp construction to the impacts estimated prior to construction and to determine whether the alternative wetland mitigation approach prepared in 1996 is still viable. April 1999 CH2M HILL visits the TAR Ramp and the proposed wetlands mitigation site. During the visit, a large amount of newly -placed fill material and large culvert with a flap gate is observed in the mitigation area. Subsequent communication revealed that this fill is part of a project to raise the flood control levee to the 100 -year flood elevation. May 1999 Telephone conference call between the City of Yakima, WDOE, CH2M HILL and HLA identified the following: May 1999 YK1 0-82 The reduced size of the proposed alternative site was discussed. Cathy Reed, WDOE, indicated that the reduced mitigation ratio of 3.1 to 1 is acceptable. The North Yakima Conservation District, with the help of local students, planted riparian vegetation on the construction access road and turnaround in the portion of the mitigation site south of the newly constructed levee (approximately 0.50 acre). Implementation of the previously proposed wetlands mitigation plan would require that these plantings be removed. The City of Yakima entered into a Memorandum of Understanding with Yakima County for construction of the flood control levee. It is assumed that another Memorandum of Understanding will be required with the City, County, and the Yakima Greenway for construction of the mitigation wetlands in this area. Cathy Reed, WDOE, spoke with Mr. R.E. Cornelius of the North Yakima Conservation District regarding the riparian plantings south of the flood control levee. Mr. Cornelius was opposed to the idea of removing the new plantings in order to construct mitigation wetlands. Approximately 50 students from local schools assisted the Conservation District with the plantings. The Conservation District has established Tong -term plans to include the students in maintenance and monitoring of the plantings. June 1999 Summary HLA, CH2M HILL, WDOE, and the North Yakima Conservation District meet at the proposed mitigation site. After review of the riparian plantings by the students and the North Yakima Conservation District, WDOE is willing to consider amending the proposed wetlands mitigation plan to include this area as part of the mitigation, provided that these plantings survive the first year. (Please refer to attached WDOE letter). There was some discussion as to how these plantings could be maintained (basically watered) until Spring of 2000. The portion of the proposed site north of the new flood control levee must be developed into a wetlands mitigation area according to the 1996 plan developed by CH2M HILL. CH2M HILL has estimated approximately $120,000 for construction of the portion of the mitigation site north of the flood control levee into wetlands replacement suitable to the WDOE. They believe that to develop the portion south ofthe flood control levee into wetlands replacement would double the cost. This means that the City could save approximately $120,000 by watering the referenced riparian plantings. As I mentioned to you a couple of weeks ago, it would be in the best interests of the City to find a way to water these riparian plantings. Some of the issues we briefly discussed were: 1. Watering by the City Parks Department. 2. Watering by separate contract to a private landscape firm 3. Watering by water truck and hoses. 4. Watering by portable pump and irrigation pipelines. (Using the small stream from Boise Cascade that flows through the site may have water rights issues. A pump and pipelines left in place may be subject to vandalism.) We are now entering the hottest time of the year. We believe it is important to begin a plan to maintain these plantings as soon as possible. I would be glad to meet with you at the site to that you can see the area to be watered. Perhaps a representative of the Parks Department could also attend. Completion of the Wetlands Mitigation From the action plan of the June 25, 1999, WDOE letter, there are various scenarios regarding the final wetland mitigation plan depending upon the success of the riparian plantings south of the dike. It appears that the WDOE's preference is to wait on any design and construction until next Spring to see if the south half must be replanted with riparian plantings or developed as wetlands area. This will delay completion of this project for another year. Another option is to design and construct the wetland improvements to the area north of the dike this year, assuming that the riparian plantings south of the dike will survive (with proper maintenance). From the WDOE letter, it is also important to note that the City will be responsible for the long-term maintenance of the entire mitigation area, whether half wetland and half riparian area or all wetland area in accordance with the original approved Shoreline Permit. The schedule will be updated periodically to reflect the current status of the project. This work clement will also prepare the monthly progress reports and monthly invoices. Progress reports will discuss the work in the previous month, the status of individual work elements, meetings attended, and outstanding information. This work element provides for the preparation. attendance, follow-up, and documentation of meetings over the course of the project. These meetings will be the forum for thc agencies to provide input and guidance for the direction of the project. They will also be used to discuss project issues. approve submittals, and develop potential solutions. Periodic monitoring of the consultants design budget will occur over thc course of the project. Current status as well as projections to complete will be developed. This work element is intended to help monitor costs and budgets and to propose corrective actions. 'these actions could include formal requests for budget increases or scope modifications or reductions. Drawings and documents received and generated over the course of the project require management. This information will be filed to facilitate ready and selective retrieval. A status of requested information will also be maintained. The CONSULTANT shall develop a workplan that defines thc proposed project expenditures on a month by month basis. This will be summarized on a work element by work clement basis, as well as an overall total, This work element also provides for the itnplementation of quality control program. The CONSULTANT shall also prepare a - vicinity snap showing the PROJECT limits in accordance with the PPM. 2.2 General Notes and Survey Control The CONSULTANT shall prcparc a sheet which includes general notes and abbreviations for the project, as well as survey control of sufficient accuracy to locate property corners and construction alignments. 2.3 Site Preparation and Grading Plans The CONSULTANT shall prepare the site preparation plans in accordance with the PPM. The plans will be used to show finished site grading and will depict removal and demolition and other such related items that can not he clearly addressed on other required plan sheets. The CONSULTANT shall prepare quantity takeoffs, tabulations, and backup calculations in accordance with the PPM. and currcnt WSDOT bid item listing. This task will include the preparation of survey requests and the incorporation of new field information into the base mapping and project design surface. This task will also include design for dc -watering during construction_ Dc -watering may be needed in localized areas for the excavation of material and placement of topsoil. This task will include one (1) field visit and coordination meeting with HLA and other project stakeholders such as the City of Yakima (CITY), DOE, and the South Yakima Conservation District. 2.4 Temporary Water Pollution Control Plans The CONSUL'TAN'T shall prepare the temporary water pollution control plans. The temporary water pollution control plans will show items necessary to restrict construction runoff from entering drainage facilities. creeks or rivers without first being treated in a manner that is acceptable to the WSDOT and approving agency. The CONSULTANT shall prepare quantity takeoffs, tabulations, and associated backup calculations in accordance with the PPM and current WSDOT bid item listing. 2.5 Planting Plan The CONSULTANT shall prepare the planting plan and details that depict the type and location of all planting material. The contract provisions shall be prepared in accordance with the PPM. The. CONSULTANT shall submit a set of contract provisions with the 90 percent review submittal. Review comments will he incorporated in the Final Submittal. 2.8 Engineer's Estimate The CONSULTANT shall prepare an engineers estimate for the PROJECT. The estimate shall be prepared using the Summary of Quantity sheets with unit costs. lump sunt prices and hack up. The CITY will provide unit cost data for standard hit] iten►s. The CONSULTANT shall submit documentation of unit prices for non-standard items of work. The estimate shall be prepared in accordance with the PPM Section 3-5.13.1. The CONSULTANT shall submit the estimate with the 90 percent submittal. Review comments will be incorporated in the Final Submittal. In providing opinions of cost. financial analyses. economic feasibility projections. and schedules for this project, the CONSULTANT has no control over cost.or price of labor and materials: unknown or latent conditions of existing equipment or structures that may affect operation or maintenance costs; competitive bidding procedures and market conditions: time or quality of performance by third parties' quality, type, management. or direction of operating personnel: and other economic and operational factors that may materially affect the ultimate project cost or schedule. Therefore. the CONSUTA ANT makes no warranty that the actual project costs. financial aspects, economic feasibility, or schedules will not vary from the CONSULTANT's opinions, analyses, projections, or estimates. If LILA or OWNER wishes greater assurance as to any element of Project cost, feasibility or schedule, NLA or OWNER will employ an independent cost estimator. contractor. or appropriate advisor.. Work Element 3 PLAN ASSEMBLY AND DOCUMENTATION 3.1 Reviews and Submittals Draft submittals of half -sized plans will he made at 60 and 90 percent levels of design development. One cotnplete set of the PS&E and applicable backup data shall he submitted to HLA for reproduction and distribution for the 90 percent review, The CONSULTANT shall submit 1 original set of 22"x34" statnped final plans as outlined in the PPM at the ad copy submittal. Computer technology shall be used by the CONSULTANT at its discretion as may be appropriate to help expedite the design and plan preparation process. Computer generated drawings that arc included in the final plans shall he done in accordance with the PPM for CADD plan preparation. 3.2 Services During Bidding Once the PS&E for the construction contract is finalized, the CONSULTANT shall remain "on-call" until the contract has been awarded to the successful bidder. This normally occurs within three months of the advertisement of the contract. This will include 1"=20' topographic base mapping and digital terrain model (DTM). • The CONSULTANT will determine horizontal and vertical control for the design using thc Washington State Department of Transportation (WSDOT) coordinate system for horizontal control and NGVD '29 to establish the vertical datum. • The CONSULTANT assumes that ('ITY or HLA shall prepare all other documents other than special provisions, drawings, and bid schedule (with cost estimate) necessary for a complete contracting package suitable for bidding. These additional sections might include but not he restricted to Introduction. Table of Contents, Invitation for Bids, Bid Proposal package, Sample and Actual Contracts, Contract Bonds and General Requirements (Division 1) except those directly affecting survey control and other aspects specific to construction activities. • One (1) field visit and coordination meeting is assumed for the project with no overnight stay anticipated. If additional meetings or overnight stay are desired by the City, these services will be provided by a supplemental agreement. • The CONSULTANT shall provide services during bidding and post PS&E assistance on an "on -calf" basis. The hours shown in the attached fee estimate are based on an assumed level of effort. If thc level of support desired by the City exceeds this amount, these services will he provided by a supplemental agreement. Geulechnical • No geotechnical report will he rcquircd. • The geotechnical work for this site is complete and no additional field explorations or laboratory testing are needed for this project. WDOE permit No. 1995 -CS -10003 This letter serves to document our site visit of February 18. 2000. to review the status of the riparian area that was planted by the City last summer. The site visit is a follow-up of mitigation conditions set forth in a previous letter (June 22, 1999) about the site. We determined that more than 50% of the holes in the planting matrix contained living plants. (If one plant within a hole had survived. then that hole in the planting matrix was counted as a success. More than one plant had been planted in some of the holes.) Therefore, additional wetland mitigation south of the dike will NOT be required, and the planted area referenced above can be managed by the City as a riparian area. (See terms of the June 22, 1999 letter). It is recommended that the City continue to water the plants this summer, as they are still quite young, with roots systems that could use assistance in getting firmly established. It is also recommended that the City take advantage of inexpensive plant materials that the Conservation District has available this time of year and do some additionai plantings to replace those that have died or expand into the triangular area between the planting matrix and the slough. Second Street Yakima, WA 98901 Dear Mr. Maine: Re: City of Yakima Gateway Project revised wetland mitigation plan; City shoreline permit reference #94-3, WDOE permit #1995 -CS -10003 This letter is in reference to the last site visit (June 2, 1999) that I made with consultants Chris Brueske, Tim White, Dennis Whitcher, and with R. E Cornelius of the South Yakima Conservation District. The purpose of that site meeting was to reconcile the existence of a dike and a riparian enhancement project in a portion of an area which had also been chosen by the City as a wetland mitigation site for the above referenced shoreline project. The following general action plan was discussed on site, which will resolve the over -lap in projects and which should eventually satisfy Ecology requirements with respect to wetland mitigation for the Yakima Gateway Project: Action plan: The area to the north of the dike will certainly be used for wetland mitigation. The area to the south of the dike will remain as it is currently is (with riparian plantings of shrubs and trees as placed by the Conservation District) until the success of the plantings can be evaluated next spring/early summer. If the riparian plants south of the dike show good survival (greater than 50% during Spring 2000), then the area south of the dike will be managed and maintained by the City as a riparian mitigation area, rather than a wetland mitigation area. City consultants will then go ahead with development of a wetland mitigation site to the north of the dike. If the riparian plants south of the dike do not show a 50% survival rate during Spring 2000, then the area to the south of the dike will be excavated and used as a wetland mitigation area. City consultants will develop a wetland to the north and the south of the dike. The north and south areas will then be managed and maintained by the City as a wetland mitigation area. • * Jim Maine Page 2 June 23, 1999 Sometime after Spring 2000, it is expected that a decision will be made on how much area will be excavated for wetlands and at that time a final wetland mitigation plan will be submitted to Ecology for approval. In the event that the riparian area south of the dike meets the vegetation criteria in Spring 2000, but falls below that criteria after construction of the northern mitigation wetland area has occurred, then construction of a mitigation wetland south of the dike will not be required. Instead the City will be responsible for replanting the riparian vegetation in the south area of the dike. This provision is added in order to keep the City from having to mobilize twice to do excavation in the area. At this time, it is Ecology's expectation that the City will be responsible for the long-term success of the mitigation area, whether the mitigation is half wetland and half riparian area or all wetland area. This means that maintenance and monitoring of the riparian vegetation will be required as partial fulfillment of the wetland mitigation plan (as required by the original Shoreline permit). Condition #2, which was placed by Ecology on the City of Yakima Shoreline permit, stated that mitigation monitoring reports would be submitted to Ecology on the 3`d and 5th year after initial construction. I appreciate the extra effort that the City and consultants have made to incorporate the riparian revegetation efforts of the Conservation District into the existing mitigation plan. Hopefully, both the riparian restoration and wetland mitigation efforts will be a success over the long term. Please call me if you have any questions on the above information. The Department of Ecology issued a letter (March 3, 2000, copy attached) which indicates that the City of Yakima is required to design and develop a wetlands mitigation area north of the flood control levee which was constructed by the City in 1999. Task 1 b of our agreement with the City, referred to earlier, is the design and preparation of plans and specifications for the wetlands mitigation area. At the time the agreement with the City was executed, the extent of the design effort was not known: In fact, the status of the wetlands issue had to be determined and was a separate task of the. agreement (Task 1 a). Now that the status of the wetlands has been determined, a more accurate cost for the design and preparation of plans and specifications can be made. The original agreement with the City estimated a cost of $23,1.07.25 for the wetlands design and preparation of plans and specifications. No subconsultant fees were .included.
