ITEM TITLE: Resolution declaring a 2.77 acre parcel of property abandoned to
the uses and needs of the City of Yakima

SUMMARY EXPLANATION:
In May of 1956, the City acquired 2.77 acres from the Squire-Ingham Company to install a
Ranney Collector(Well)to augment the City drinking water supply. The Statutory Warranty Deed
the City received from Squire-Ingham Co. with the 2.77 acre Ranney Well parcel states
"...subject to the right of the Grantors to repurchase said property from the City for a sum of
$1.00 if and in the event at any future time the City abandons said well site".
The Ranney Collector has failed to produce enough water and had been abandoned and
physically removed from the site. The Ranney water rights were transferred to Gardner Well and
Kissel Well.
To comply with the deed requirements, the property must be declared surplus to the City needs
and must be sold back to the Grantor, Squire-Ingham Co. for$1.00.

RESOLUTION NO. R-2020-
A RESOLUTION declaring a 2.77 acre parcel of property abandoned to the uses and needs of
the City of Yakima, in anticipation of Squire Ingham Co.'s repurchase of the
property for$1.00 in accordance with the terms of the City's Deed conditions,
and authorizing the City Manager to execute documents to accomplish this
transaction.
WHEREAS, the City of Yakima owns 2.77 acres of real property known as the Ranney
Well parcel, located near the mouth of Cowiche Creek, situated north of Highway 12 next to the
Naches River; and
WHEREAS, the City acquired the parcel from Squire-Ingham Co. in May of 1956 for the
purpose of establishing a Ranney Well Collector to provide for City drinking water supply; and
WHEREAS, the Ranney Well Collector water supply has failed and is no longer a viable
drinking water supply source; and
WHEREAS, the Ranney Well water rights have now been transferred to the Gardner and
Kissel wells that continue to provide a City water supply; and
WHEREAS, the Statutory Warranty Deed the City received from Squire-Ingham Co. with
the 2.77 acre Ranney Well parcel states "...subject to the right of the Grantors to repurchase said
property from the City for a sum of$1.00 if and in the event at any future time the City abandons
said well site"; and
WHEREAS, the Ranney Well has been abandoned by the City and has been physically
removed from the site; and
WHEARAS, the Grantor, Squire-Ingham Co. has indicated it will exercise its right to
repurchase pursuant to the terms of the deed; and
WHEREAS, Squire-Ingham Co. has agreed, and the City has accepted this time frame,
to exercise its rights and make the required payment to the City within six (6) months of the date
of this Resolution, after which the City shall execute the necessary deed to return the property to
Squire-Ingham Co.; and
WHEREAS, the City Council finds and determines that the 2.77 acre Ranney Well parcel
is abandoned to the uses and needs of the city, and that declaring the parcel abandon to the uses
and needs of the City is in the best interests of the City of Yakima and will promote the general
health, safety and welfare; and
WHEREAS, in accordance with the terms and conditions of the City's Deed for the
property, and Squire-Ingham's exercising of its legal rights, the 2.77 acre parcel must now be sold
back to the Grantor, Squire-Ingham Co. for $1.00; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
1. The 2.77 acre parcel identified in Exhibit "A", attached hereto and incorporated herein
by this reference, Yakima County Assessor's Parcel No. 181310-32003, is hereby

declared abandoned to the uses and needs of the City of Yakima, and in accordance
with the terms of the Deed by which the parcel was acquired, attached hereto and
incorporated herein by this reference as Exhibit "B", the parcel shall now be
repurchased by Squire-Ingham Co. for the sum of$1.00.
2. The Interim City Manager is authorized and directed to execute all necessary
documents to complete the sale of the property as described herein.
