R-2000-131 A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute Modification No. 1 to the "2000-2001 Agreement between the City of Yakima and Yakima National Little League Association" regarding the use, operation and maintenance of Elks Park. WHEREAS, on February 24, 2000, the City of. Yakima. and Yakima National Little League Association entered into an agreement regarding the use, management and operation of Elks Park; and WHEREAS, as part of the agreement, the Association agreed to provide $17,500 to the City to assist with the development and improvement of an irrigation system at Elks Park; and WHEREAS, the cost of said irrigation project is substantially higher than anticipated by the City or the Association and additional funding is necessary to complete the irrigation project; and WHEREAS, the Association is willing to provide an additional $25,000 for completion of the irrigation project in consideration for the agreement being extended through December 31, 2005 as reflected in the attached modification to the agreement; and WHEREAS, the City Council has determined that it is in the best interest of the City to authorize the City Manager to execute Modification No. 1 to the "2000-2001 Agreement between the City of Yakima and Yakima National Little League Association," now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized and directed to execute the attached and incorporated Modification No. 1 the "2000-2001 Agreement between the City of Yakima and Yakima National Little League Association" regarding the use, operation and maintenance of Elks Park. ADOPTED BY THE CITY COUNCIL this 17t dayof Oc ATTEST: City Clerk (1k)res/parks hula league mod oct oo-pm 2000. ary Place, Mayor MODIFICATION NO. 1 TO AGREEMENT BETWEEN CITY OF YAKIMA AND YAKIMA NATIONAL LI11'LE LEAGUE ASSOCIATION THIS MODIFICATION (hereinafter "Modification No. 1") to the existing "2000- 2001 Agreement between the City of Yakima and Yakima National Little League Association" (hereinafter "Agreement") is entered into by and between the City of Yakima, Washington, a municipal corporation, (hereinafter the "City"), and the Yakima National Little League Association (hereinafter the "Association"). WHEREAS, on February 24, 2000, the City and Association entered into an Agreement regarding the use, management and operation of Elks Park; and WHEREAS, as part of the Agreement, the Association agreed to provide $17,500 to the City to assist with the development and improvement of an irrigation system at Elks Park; and WHEREAS, the cost of said irrigation project is substantially higher than anticipated by the City or the Association and additional funding is necessary to complete the irrigation project; and WHEREAS, the Association is willing to provide an additional $25,000 for completion of the irrigation project in consideration for the Agreement being extended through December 31, 2005. NOW, THEREFORE, the City and Association agree to the following modifications (language additions are underscored, and language deletions are stricken through) to Section 2 and Section 4 of the Agreement: 2. Consideration. Except as otherwise provided herein, the Association shall pay the City the amount of Forty Two Thousand Five Hundred Dollars and Zero Cents ($42,500.00) Seventeen Thousand Five- in ivcin consideration for the use of the Elks Park baseball fields, the services provided by the City as set forth in Section 1(a), and the exclusive concession granted in Section 3. The Association shall pay the City said sum at the time of execution of this Agreement and Modification No. 1. The City shall use said sum as a match for a Seventeen Thousand Fivc Hundred Dollars and Zcro Ccnts ($17,500.00) grant from Interagency Committee for Outdoor Recreation for development and improvement of an irrigation system at the Elks Park. The consideration specified in the preceding paragraph shall not include situations where the Association requests additional mowing and other special maintenance services beyond the normal maintenance schedule. In those situations, the Association shall compensate the City on a per hour basis in accordance with the current fee schedule for the Yakima Parks and Recreation Division as adopted by the Yakima City Council and as may be amended during the term of this Agreement. A copy of said fee schedule is attached hereto as Exhibit "A." The Association shall pay the City said compensation within thirty (30) calendar days of receiving an invoice from the City. 4. Term. The term of this Agreement shall commence and be retroactive to January 1, 2000 and shall terminate at midnight, December 31, 2001 2005, unless sooner terminated by either party in accordance with Section 18 of this Agreement. Except to the extent expressly modified herein, all of the other terms and conditions contained in the Agreement shall remain in full force and effect. The Little League Association, as part of their agreement with the City, provided the sum of $17,500 to assist with the development and improvement of an irrigation system at Elks Park. The cost of the irrigation project was substantially higher than anticipated and additional funding was necessary to complete the irrigation project. The Little League Association agreed to provide the additional dollars necessary to complete the project. For their consideration, the Agreement is being extended an additional four years of which the City has agreed to waive all "use of facility" fees.
