HomeMy WebLinkAboutR-2001-046 4th Amendment to the Four Party AgreementRESOLUTION No. R-2001- 46 A RESOLUTION directing the Mayor, City Attorney and the City Clerk to execute the attached Fourth Amendment for Wastewater Treatment and Disposal Service to the Four Party Agreement. WHEREAS, the City of Yakima is responding to the needs for adjustment of sewer service areas for Yakima County, City of Union Gap, Terrace Heights and the City of Yakima; and WHEREAS, the City has joined in boundary changes to previous agreements; and, WHEREAS, the City believes that it is in the best interest of the public to incorporate these changes to the Urban Boundary; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The Mayor of the City of Yakima is hereby authorized to execute the attached "Fourth Amendment for Wastewater Treatment and Disposal Service to the Four Party Agreement" with Yakima County, City of Union Gap and Terrace Heights Sewer District. THIS AGREEMENT is entered into by and between Yakima County, a municipal corporation, the City of Yakima, a municipal corporation, the City of Union Gap, a municipal corporation, and the Terrace Heights Sewer District, a municipal corporation, for the purpose of amending the "Urban Boundary" as set forth in EXHIBIT A of the AGREEMENT FOR WASTEWATER TREATMENT AND DISPOSAL SERVICE. WITNESSETH: WHEREAS, on February 23, 1976, the parties entered into an AGREEMENT FOR WASTEWATER TREATMENT AND DISPOSAL SERVICE; and WHEREAS, said Agreement contains "EXHIBIT A" which depicts in map form the "Urban Boundary" of the Yakima Urban Area; and WHEREAS, the Urban Boundary has been enlarged from time to time to include additional lands to which sewer service can be provided; and WHEREAS, Yakima County and the City of Yakima now desire to amend the Urban Boundary in order to provide sewer service to the Apple Tree development; and WHEREAS, the City of Yakima further desires to provide sewer service to additional properties west of 96th Avenue between Summitview Avenue and Tieton Drive; and WHEREAS, the City of Union Gap and the Terrace Heights Sewer District desire to amend the Urban Boundary to make their sewer service boundaries coterminous with applicable portions of the Yakima -Union Gap Urban Growth Boundary established pursuant to the Washington State Growth Management Act; and WHEREAS, the parties believe that enlarging the Urban Boundary to incorporate these changes is necessary and in the public interest; NOW, THEREFORE, the parties do hereby mutually consent and agree to the following: 1. The "Urban Boundary" is hereby expanded to include the area shown in revised EXHIBIT A, dated March 6, 2001; which exhibit is attached hereto and incorporated by reference into this amendment. SUMMARY EXPLANATION: The attached resolution directs the Mayor, City Attorney and the City Clerk to execute the attached Fourth Amendment for Wastewater Treatment and Disposal Service to the Four Party Agreement. The amendment to the Four Party Agreement amending the four party sewer service area is proposed and supported by Yakima County, City of Union Gap, Terrace Heights Sewer District and the City of Yakima. This amendment incorporates several minor changes to the existing Urban Boundary service area as shown on the attached map. Also attached for informational purposes is the legal description of the revisions to the Boundary description of the City of Yakima Urban Area. The map includes an area larger than we discussed on February 27 for the "Pottenger area" at 96`f' Avenue and Tieton Drive. Discussions between the City of Yakima and Yakima County this morning disclosed that several parcels west of 96th Avenue and north of the "Pottenger area" are already being served with sewer. We agreed to include the area north of Pottenger and south of Summitview Avenue in the revised boundary. Contact me ASAP if you note any mistakes on the map, so we could make any corrections before adoption by the Board of Yakima County Commissioners Tuesday morning, March 6, 2001.
