BE I BY THE CITY OF YAKIMA: Section 1. The following described property situate in Yakima • County, Washington, shall be improved by constructing a pipe sewer with the necessary wye branches and manholes: Parcels 2, 3 and 4, Book Q-0022; Parcel 1, Book'81-0170; SPG33 Th Pt of Lot 4 and East 32 ft. of Lot 3 lying south of following described line. Beginning at the southeast corner of the SW4 SR Nun, thence north 1330" E 330.05 ft., thence N 89 W 200 ft. and end of line; SPG.33 Th pt. of Lot 4 and east 32 ft. of Lot 3 lying north of following described line. Beginning at the south- east corner of the SW* SE) 144, thence N 13'30" east 330.05 ft., thence N 89°48'40" west 200 ft. and end of line. Yakima County Parcel numbers: 181314-24444, 181314-24445, 181314-24461, 181314- • 24464, 181314-24465 and 181314-24457. Section 2. There is hereby created a Local Improvement District, to be called "Local Improvement District No. 1044", which said district shall include all of the above described property. Section 3. The assessments shall be made according to special benefits derived from the improvements without regard to the zone and . termini method. Section 4. All costs and expenses in connection with the con- struction of said improvements, including the engineering, inspection, advertising, publication of notices, and all other expenses incident, thereto; shall be levied and assessed against all of the property legal- ly and properly assessable therefor as provided by law and as above described. Section 5. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detail- ed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 6. The work necessary to be done in connection with the making of said improvements shall be done by contract upon competitive bids according to specifications and plans as prepared by the Engineer- ing Division of the Department of Engineering and Utilities, and the • City shall have the power to reject any and all bids. Section 7. There is hereby created a special fund, to be known as "Local Improvement Fund, District No. 1044", into Which shall be placed ORDRES EE3 all sums paid on account of the aforesaid special assessnents, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. 4111 Section 8. Bonds shall be issued in payment of the costs and expense of said improvements, which bonds shall be redeemed by the • collection of special assessments to be levied and assessed upon the property within said district, which assessments, with interest, shall be payable annually under the mode of payment "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima; provided, this improvement may be financed by the issuance of promissory notes, under the authority of R.C.W. 35.45.150 and Section 8.12.100 of the City of Yakima Municipal Code. The term and interest rate of bonds and special assessments contemplated by this 0 section shall conform to provisions, terms and conditions to be spec- ified by a subsequent ordinance of the City of Yakima. Section 9. This ordinance is one relating to local improvements or assessments therefor, and shall became effective immediately upon its passage, approval and publication as provided by law and by the City Charter.
