HomeMy WebLinkAbout1987-3017 REZONE PROPERTY IN VICINITY OF WIDE HOLLOW CREEK AT 1802-1804 SOUTH 24TH AVENUE ORDINANCE NO. 3017 AN ORDINANCE affirming the Hearing Examiner's recommendation granting a master application and rezone of prop- erty in the vicinity of Wide Hollow Creek at 1802 4111 through 1804 South 24th Avenue, and amending the zoning map of the City of Yakima. 111 WHEREAS, on April 7, 1987, the Hearing Examiner held a hearing on a master application and rezone request initiated ., by Irwin Research & Development, Inc., for the rezone of prop- erty in the vicinity of Wide Hollow Creek at 1802-1804 South 24th Avenue, Yakima, Washington, the legal description of which is set out hereinbelow, from B-1, Professional Business District to M-1, Light Industrial District and for an adjust- ment of site screening, and 4111 WHEREAS, as a result of that hearing, the Hearing Exami- ner recommended to the City Council that the rezone and re- mainder of the master application be granted with conditions, and WHEREAS, at its public meeting on April 28, 1987, the City Council determined that the decision of the Hearing Exam- iner should be affirmed, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The decision of the Hearing Examiner, recom- mending the rezone of property in the vicinity of Wide Hollow Creek at 1802-1804 South 24th Avenue in the City of Yakima, 4110 Washington, the legal description of which is as follows: The east half of the following described property: Parcel "A" The Southeast quarter of the Southeast quarter of the Northwest quarter; EXCEPT the South 596 feet thereof; AND That 'PaiAt'ifie'Northeast quarter of the Southeast quarter of the Northwest quarter lying South of the centerline of Wide Hollow Creek, ALL in Section 35, 111 Township 13 North, Range 18, E.W.M., EXCEPTING from said parcels the following portions conveyed to the City of Yakima by deed 'recorded in Volume 707 of Deeds, under Auditor's File Number 2166723;** 1. The East 30 feet thereof; 2. All that part thereof lying Southwesterly of a 1111 line drawn parallel with and 30 feet Northeasterly when measured at right angles from the centerline of Washington Avenue, hereinafter referred to as line "L" said line "L" being described as follows: Prasch.Ord/B11 Beginning at a point 482.20 feet East of the South- west corner of the Northeast quarter of said Section 35; thence Northwesterly along the arc of a curve to • the right having a radius of 955 feet and the long chord of which bears North 67 °25'00" West 752.78 feet; thence North 44 ° 50' West 380.97 feet; thence Northwesterly along the arc of a curve to the left having a radius of 955 feet and the long chord of which bears North 61 °34'14" West 557.90 feet. Parcel "B" • The North 62.5 feet of the South 596 feet of the Southeast quarter of the Southeast quarter of the Northwest quarter of Section 35, Township 13 North, Range 18, E.W.M., lying East of the Northeasterly right -of -way line of Washington Avenue; EXCEPT the East 30 feet for road. from B -1, Professional Business District to M -1, Light Indus- trial District, is hereby affirmed; and that property is hereby rezoned to M -1, Light Industrial District. Section 2. The City of Yakima zoning map is hereby 1111 amended to correspond to the rezone ordained by Section 1 of this ordinance. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. The decision of the Hearing Examiner ap- proving said master application and rezone, a copy of which is on file in the City Clerk's office, is hereby adopted and affirmed together with its conditions. Section 5. This ordinance shall be in full force and effect thirty days after its passage, approval and publication • as provided by law and by the City Charter.
