AN ORDINANCE providi. g for the ,improvement of certain property by
constructing a pipe sewer with the necessary wye branches
and manholes; establishing a Local Improvement District,
providing for the method of payment thereof, and creating
` 8 special fund.

S � 1. The following d� ibed i t in Yakima
Section . scr property situate e n ma
County, liVashimgton shall be improved by constructing a pipe sewer with
the necessary wye branches and manholes:
All of Blocks 1, 2, 4, 5, 6 7, Vie*wnont Park Addition
and that Portion of Vacated Riohf-of-Way accrued thereto,
except Lot 6, Block 7 and /mended Plat Lot 6, Block 2 and
Block 4, Vicwmnnnt Park, that part lying south of a line
beginning 58.58 feet North 9 32' from Southwest Corner of
Lot, thence Vest to West Line (Ptn. of Lot 6, block 2,
Viemmmnt Park Addition), recorded in Volume R, Page 4 and
Volume R, Page 10 and Volume S, Page 46, Records of
Yakima County, Washington,
And, Lots 7, 8, 9, and 10 Block 3, Vie*wnont Park Addi-

tion and that portion Of vacated right-of-way accrued
thereto, recorded in Volume R, Page 4, Records of Yakima
County, Washington.
And, Lots 9 through 16, Block 8, V/e^mont Park Addition,
recorded in Volume R, Page 5, Records of Yakima County,
Washington.
Section 2. There is hereby created a Local Improvement District,
to be called "Local Improvement District No. I045 ",.which said dis-
trict shall include all of the above described property.
Section 3. The assessments shall be made according to special
benefits* derived frmn the inprovenents without regard to the zone and
termini method.
Section 4. All costs and expenses in connection with the con-
struction of said improvements, including the engineering, inspection,
advertising, publication of notices, and all other expenses incident
thereto, shall be levied and assessed against all of the property legal-
ly and properly assessable therefor as provided by law and as above
described.

Section S. All of the aforesaid construction work shall be in
accordance with the plans and specifications, profiles, maps and detail-
ed drawings which have been prepared by the City Engineer, filed with
the City Clerk, and which are hereby approved and adURted,

Section 6. The work necessary to be done in connection with the
making of said improvements shall be done by contract upon con ive
bids according to specifications and plans as prepared by the Engineer-
ing Division of the Department of Engineering and Utilities, and the
City sha|| have the power to reject any and all bids.

��r Section 7. There is hereby created a special fund, to be known as
"Local |nprnvernent Fund, District No. 1045 ", into which sha|| be
placed all suns paid on account of the aforesaid special assessments,
including a|| interest and penalties thereon, and in the event of the
sale of local improvement bonds by the City, all premium .and interest on
said bonds issued for said improvement.
Section 8. Bonds shall be issued in payment of the costs and
expense of said improvements Mich bonds shal l be redeemed by the
col lection of special ossessrrents to be levied and assessed upon the
property within said district, which assessments, with interest, shall
be payable annual |y under the mode of payment "payment by bonds" as
defined by the statutes of the State of Washington and the ordinances of
the City of Yakima; provided, this inprovenrent may be financed by the
issuance of promissory notes, under the authority of R.C.W. 35.45'150
and Section 8'12,100 of the City of Yakima Ivunicipa| Code. The term and
interest rate of bonds and special assessments contemplated by this
section shall conform to provisions, terms and conditions to be spec-
ified by a subsequent ordinance of the City of Yakima.
Section 9. This ordinance is one relating to local improvements or
assessments therefor, and sha|| become effective immediately upon its
passage, approval and publication as provided by law and by the City
Charter.
