AN ORDINANCE establishing the rates to be charged by the City's Engineering
Division to review the design documents for, and inspect the
construction of, public works improvements in conjunction with
subdivision, development and redevelopment of real property by
private parties; and adding section 12.20 to the City of Yakima
Municipal Code.
WHEREAS, the City of Yakima (City) is authorized by Title 35 RCW to establish design
and construction standards for public works improvements within the City limits; and
WHEREAS, it is the City Engineer's responsibility to ensure that these standards are
used for public work improvements performed by private parties; and
WHEREAS, it is prudent that the City Engineer be compensated by the
Owners /Developers for whom the review and inspections are performed; and
WHEREAS, Section 12.01.050 of the Yakima Municipal Code states that a schedule of
fees for such review and inspection should be developed and adopted; and
WHEREAS, the City Council determines that the review and inspection fees contained in
this Ordinance are fair, just and reasonable, Now, Therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA
Section 1. Section 12.20 is added to Title 12 of the City of Yakima Municipal Code
(YMC), to read as follows:
12.20.010 Review and Inspection Fee for Public Work Improvements
The review and inspection fee shall be based on the construction cost estimate obtained from
the Public Works Improvement Bid Item Prices sheet provided in YMC 12.20.030. For items
that are not included in YMC 12.20.030, the Consulting Engineer shall provide the per unit cost
to be reviewed and approved by the City Engineer. The review and inspection fees shall be
calculated as follows:
♦ 7% of the calculated construction cost up to $25,000, plus 6% of the calculated
construction cost between $25,000 and $50,000, plus 5% of the calculated construction
cost, for costs in excess of $50,000.
12.20.020 Payment
Payment of the review and inspection fees shall be as follows:
♦ $250.00 or 10% of the calculated review and inspection fee, whichever is greater, shall
be paid at the time of plans are submitted to the City Engineer and shall be a non-
refundable charge.
♦ Remainder of fee balance shall be paid following review and prior to approved plans
released to the Consulting Engineer /Owner /Developer.

Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval
and publication as provided by law and by the City Charter.

ITEM TITLE: Request for Council to A) adopt, by resolution, the proposed update to the
Procedures Manual for Construction of Public Improvement Projects
Under Private Contracts, and to B) enact, by ordinance, the rates to be
charged by the Engineering Division to review and inspect public
improvement projects.

SUMMARY EXPLANATION:
In response to City Council's 2011 Major Policy Issue titled, "Engineering Review and Inspection
Fee Increase ", the Engineering Division proposes the following:
1. Charge Owners /Developers a portion of the engineering review and inspection fee at the
time of plans submittal.
2. Update the unit bid price worksheet from which the engineering review and inspection fee
is calculated.
Currently a fee is not paid until a developer picks up the approved plans. There are times that
plans are reviewed and approved by the City, but not picked up by the developer. In these
instances, the City is not compensated for any review expenses. It is proposed that the

STAFF RECOMMENDATION: Staff respectfully requests Council to:
A) Adopt, by resolution, the Procedures Manual for Construction of Public Improvement
Projects Under Private Contracts; and,
B) Enact, by ordinance (YMC 12.20), the timing of collection and rates to be charged by the
Engineering Division for review and inspection fees for public improvement projects
performed by private parties.
BOARD /COMMITTEE /COMMISSION RECOMMENDATION: The Community and Economic
Development Committee on March 2, 2011 requested that this information be presented to the
CWHBA, and then be brought to full Council for approval.

Owner /Developer pay a fee of $250 or 10% of the calculated fee, whichever is greater, to partially
reimburse review costs. The remainder of the fee would be paid when the approved plans are
picked up. Of the 26 project submitted in 2010, fees were never received for 10 of them.
Using this new, proposed method of payment would have resulted in the City receiving an
additional $3,627.13 _in revenue.
It is also proposed that Engineering's Public Works Improvement Bid Item Prices Worksheet be
updated to reflect recent bidding trends. Since private parties are not required to pay prevailing
wage rates, the bid item prices were set at 80% of the cost for recent publicly- funded projects.
The proposed cost adjustments increase some of the bid item prices, while decreasing others.
When compared with two large projects for which a review and inspection fee was collected in
2010, the proposed bid item price changes resulted in a 1% increase in fee on one project
( +$48.59), and a 6% decrease (- $790.01) on the other.
At the same time, staff proposes to update the Procedures Manual for Public Improvements
Constructed by Private Parties. YMC Chapter 12.01.050 states, "the City Engineer shall establish
and maintain a manual describing procedures for the City Engineer's review, permitting and
inspection of public improvements constructed by private parties. This manual shall include a
schedule of fees for such review, permitting and inspection approved by the City Council." The
proposed update would clarify certain elements of the Procedures Manual, and provide Council
with an opportunity to adopt it.
Staff feels that it is important, at this time, to. upgrade the Procedures Manual, along with the
engineering review and inspection fee. Updating the Public Works Improvement 'Bid Item Prices
Worksheet will ensure a more accurate engineering review and inspection fee, to better reflect the
current bidding environment. Collection of a small fee up front will ensure that the City's General
Fund is compensated for a portion of the review.
The proposed updates were presented to the Community and Economic Development Council
Subcommittee on March 2, 2011. They supported our proposals, but requested that the proposed
updates be presented to the Central Washington Home Builder's Association. The information
was presented to the Central Washington Home Builder's Association on March 24th. No
comments or concerns have been received regarding the proposed changes.
