The motion carried by unanimous vote. Executive Session was held and adjourned at 5:30 p.m. 1. Roll Call 3. Council: Mayor Patricia Byers, presiding, Assistant Mayor Holly Cousens, Councilmembers Kay Funk, Brad Hill, Soneya Lund and Eliana Macias and Jason White (all but White attending via speakerphone) Staff: Interim City Manager Alex Meyerhoff, City Attorney Jeff Cutter and City Clerk Sonya Claar Tee Interpreter Services None. Open Discussion for the Good of the Order A. Coronavirus (COVID-19) update Interim City Manager Meyerhoff provided an update on COVID-19's effect on City services and finances. B. Proclamations Do Something Good For Your Neighbor Day Mayor Byers proclaimed May 16 as Do Something Good For Your Neighbor Day. 4. Council Reports Page 1 of 4 A. 175 Resolution approving extension of Mayoral Proclamation declaring emergency and order, if the Mayor issues a Proclamation extending the civil emergency proclamation and order due to COVID-19 and draft letter to Governor Inslee Mayor Byers proclaimed an extension of the City of Yakima's Civil Emergency and Order through June 4, 2020. The City Clerk read the resolution by title only. MOTION: Cousens moved and Funk seconded to adopt the resolution. After discussion, MOTION: Hill moved and Cousens seconded to call for the question, which carried by unanimous vote. The motion carried by a 5-2 vote with Lund and White voting no. RESOLUTION NO. R-2020-050, A RESOLUTION extending the Mayor's Proclamation of Civil Emergency and Order regarding a state of emergency in the City of Yakima due to the coronavirus disease 2019 ("COVID-19"). Mayor Byers reviewed a draft letter she and County Commissioner Baker would like to send to Governor Inslee regarding a comprehensive plan submitted by local industry to expedite a safe return to business. After discussion, MOTION: Hill moved and Cousens seconded to approve the letter. The motion carried by a 6-1 vote, White voting no. B. Draft support letter for Yakima Neighborhood Health Services MOTION: Funk moved and Cousens seconded to send this letter. After Council discussion, the motion carried by 6-1 vote, White voting no. Senior City Attorney Watkins clarified the funding is through 2163 filing fees, which is distributed by Yakima County. 5. Consent Agenda Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes.The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Cousens moved and Macias seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the April 21, 2020 City Council regular meeting B. 2020 1st Quarter Accounts Receivable Status Report C. Project Completion and Contract Acceptance for Michels Corporation - Project SW2496 Drainage Improvement District (DID) CIPP Rehabilitation Set date of June 16, 2020 to consider Planning Commission's recommendation regarding the preliminary plat of Rainier Court Phases 2, 3, and 4, located in the vicinity of N 92nd Ave and Summitview Ave E. Resolution authorizing a recurring annual agreement with Yakima Valley Umpires Association to obtain officiating services for the City's organized softball program RESOLUTION NO. R-2020-051, A RESOLUTION authorizing an agreement with the Yakima Valley Umpires Association for officiating services for the City of Yakima's organized Page 2 of 4 176 softball program. F. Resolution authorizing acceptance of a grant from the Federal Aviation Administration (FAA) under the Coronavirus Aid, Relief, and Economic Security Act to provide economic assistance in response to COVID-19 operational impacts RESOLUTION NO. R-2020-052, A RESOLUTION authorizing acceptance of a grant from the Federal Aviation Administration (FAA) under the Coronavirus Aid, Relief, and Economic Security Act to provide economic assistance in response to COVID-19 operational impacts. G. Ordinance authorizing the execution of a financing contract with the Office of the State Treasurer and other Street Lighting Energy Project related documentation ORDINANCE NO. 2020-010, AN ORDINANCE authorizing the acquisition of personal property and execution of a financing contract and related documentation relating to the acquisition of said personal property DEPARTMENT ITEMS Ordinance adding Chapter 1.79 to the Yakima Municipal Code regarding the sale, disposition, or lease of surplus real property for affordable housing Senior Assistant City Attorney Sara Watkins briefed Council on the ordinance. The City Clerk read the ordinance by title only. MOTION: Funk moved and Cousens seconded to pass the ordinance. The motion carried by unanimous vote. ORDINANCE NO. 2020-011, AN ORDINANCE adding Yakima Municipal Code Chapter 1.79: Sale, Disposition or Lease of Surplus Real Property for Affordable Housing. Other Business MOTION: Lund moved and Macias seconded to direct staff to explore the ways and guidelines by which the City of Yakima can offer grants or loans to small business owners operating within city limits. After Council discussion, the motion carried by unanimous vote. MOTION: White moved and Hill seconded to direct staff to bring to the June 2 business meeting a liberal proposal on in home business uses and possible expansion. After Council discussion, the motion carried by unanimous vote. Senior Attorney City Attorney Watkins informed Council that any Title 15 amendments would need to go to the Planning Commission. Community Development Director Joan Davenport requested that if Council has specific businesses in mind, to provide additional details to the City Manager. MOTION: White moved and Macias seconded to add the parking enforcement issue to the next business meeting. After Council discussion, the motion carried by unanimous vote. MOTON: Hill moved and White seconded to direct staff to compile the performance standards for the previous City Manager and forward to Council, and after evaluating, meet and discuss performance standards at our next meeting. After Council discussion, the motion carried by unanimous vote. MOTION: Funk moved and Byers seconded that staff schedule a 2 hour Study Session for an appropriate outside expert to educate us on best process for Council Page 3of4 evaluation of any future City Manager, so that our process will be defensible, as well as compliant with Open Public Meetings Act and Open Public Records Act. After Council discussion, the motion failed by a 4-3 vote, Hill, Lund, White and Cousens voting no. MOTION: Macias moved and Funk seconded to request City staff to draft a plan for utility bill relief in COVID-19 emergency, funded by Enterprise Fund Operating Reserves. First draft is due at next business meeting, but plan completion may take longer. After Council discussion, the motion carried by unanimous vote. Public Works Director Scott Schafer cautioned against using reserve funds that will be needed for extra tonnage and tipping fees in Refuse as well as utility capital projects. Finance and Budget Director Steve Groom stated Council should review future capital projects. 8. Adjournment MOTION: Cousens moved and White seconded to adjourn to the next City Council regular meeting on May 19, 2020, 5:30 p.m. at City Hall. The motion carried by unanimous vote.
