AN ORDINANCE relating to the regulation of Truck Routes; amending Sections 8.40.010 and
8.40.080 of the Yakima Municipal Code regarding the established weight of
qualifying trucks and the associated violation penalty.
WHEREAS, the City Council has previously adopted ordinances establishing criteria of
rated capacity of trucks required to utilize truck routes within the City of Yakima and the
associated violation -penalty for noncompliance; and
WHEREAS, the City Council finds and determines that such Sections 8.40.010 and
8.40.080 YMC should be amended to better define the rated capacity for trucks required to
travel exclusively on established truck routes and the imposing violation -penalty for not adhering
to such truck routes; and
WHEREAS, the City Council finds and determines that such amendment is in the best
interest of the residents of the City of Yakima and will help to preserve the integrity of arterial
roads not built to withstand the excessive weight of such trucks; now, therefore
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. YMC 8.40.010 Definitions, is hereby amended to read as follows:
8.40.010 Definitions.
For the purposes of this chapter, the following terms, phrases, words, and their derivations shall
have the meaning given in this section. When not inconsistent with the context, words used in
the present tense include the future, words in the plural number include the singular number,
and words in the singular number include the plural number. "Shall" is always mandatory and
not merely directory:
A. "City" is the city of Yakima.
B. "Deviating truck" is a truck which leaves and departs from a truck route while traveling
inside the city.
C. "Person" is any person, firm, partnership, association, corporation, company, or
organization of any kind.
D. "Truck" is any vehicle designed or operated for the transportation of property, and whose
body weight or whose combined body and load weight or whose rated capacity exceeds twenty-
six thousand (26,000) pounds.
E. "Truck route" is a way over certain streets, as designated in this chapter, over and along
which trucks coming into and going out of the city must operate. (Ord. 2018-024 § 1 (Exh. A),
2018).
Section 2. YMC 8.40.080 Violation -Penalty, is hereby amended to read as follows:
8.40.080 Violation - Penalty,
Violation of or failure to comply with any of the provisions of this chapter shall be a traffic
infraction punishable by a fine not to exceed $250.00. (Ord. 2018-024 § 1 (Exh. A), 2018).
Section 3. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

Ordinance amending the City of Yakima Municipal Code Sections
8.40.010 and 8.40.080 regarding Truck Routes

SUMMARY EXPLANATION:
The Street & Traffic Division requests that Yakima Municipal Code (YMC) Chapter 8.40 relating
to Truck Routes be amended to allow for the increase in the weight of trucks designated for
"Truck Routes" and to amend the violation -penalty.
The proposed amendment to YMC Section 8.40.010 would increase the rated capacity from
fifteen thousand (15,000) to twenty-six thousand (26,000) pounds for trucks allowed only on
designated truck routes. The current rate capacity of 15,000 pounds affects most of the delivery -
type trucks that are vital to the businesses in the downtown area. Increasing the capacity rated
weight to 26,000 pounds would apply only to the tractor -trailer trucks in which the ordinance was
originally intended; limiting their travel routes to the designated truck routes that were designed
and built to accommodate the additional weight.
The proposed amendment to YMC Section 8.40.080 would eliminate the tracking of progressing
violations and associated penalties; simplifying the process to a traffic infraction not to exceed
$250.00 for each violation. Attached for City Council review is both a redlined and a clean version
of the ordinance.
