HomeMy WebLinkAbout1988-3085 ANNEXING PROPERTY 3085 ORDINANCE NO. AN ORDINANCE annexing property to the City of Yakima. WHEREAS, proceedings have been held in accordance with all applicable laws for the annexation to the City of Yakima of Chesterley Park, owned by the City of Yakima, and hereinafter described, and WHEREAS,a hearing by the Yakima County Boundary Review Board on such annexation was held as required by law and the annexation was approved, and WHEREAS, Chesterley Park has been formerly zoned R-2, Two- Family Residential District, pursuant to the official zoning map for the Yakima Urban Area and it is the intent of the City Council to retain such zoning, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described property, owned by the City of Yakima and used for a park situated in Yakima County, Washington, and non-contiguous to the City of Yakima, is hereby annexed to the City of Yakima, Washington, for park purposes: That portion of the southwest quarter of the northeast quarter of Section 15, Township 13 North, Range 18, E.W.M., lying northeasterly of North 40th Avenue. Except beginning at the intersection of the north line of said subdivision and the easterly right-of-way line of the Pacific Power and Light Company Canal; Thence east 104 feet; Thence south 195 feet, more or less, to the easterly right-of-way line of said canal; Thence northwesterly along the easterly right-of-way line of said canal to the point of beginning. Except that portion lying northwesterly of the following described line: 010 Beginning at a point on the west line of said subdivision situate 237.6 feet south of the northwest corner thereof; Thence south 70 40' west 49 feet, more or less, to a point on the easterly right-of-way line of Powerhouse Road, said point hereinafter referred to as point "A"; Thence north 70° 40' east to the westerly right-of-way line of said Pacific Power and Light Company Canal; ANNEX.ORD/G9 1 Thence southeasterly along said canal right-of-way line 239 feet to the true point of beginning of the line herein described;: Thence southwesterly 177 feet, more or less, to a point on the easterly right-of-way line of said Powerhouse Road, the terminus of the line herein described, situate 234 feet southeasterly measured along said road right- of-way line from the aforesaid point "A". And Except right-of-way for road on north. Section 2. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the County Auditor of Yakima County and with the Board of County Commissioners of Yakima County, Washington. Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter. &- PASSED BY THE CITY COUNCIL, signed and approved this 4400-; day of , 1988.
