BE IT ORDAINED BY THE CITY OF YAKIt4A: Section 1. Section 11.58.160 of the City of Yakima Municipal Code is hereby amended to read as follows: '11.58.160 Floodways A. Located within areas of special flood hazard established in Section, 11.58.050 of this Chapter are areas designated as floodways. Since the floodway is an extremely hazardous area due to the velocity of flood waters which carry debris, potential projectiles, and erosions potential, the following provisions apply: (1) Encroachments, including fill, new construction, sub stantial improvements, and other developments are pro hibited unless certification by a registered professional engineer or architect demonstrates to the Code Admin- istration Manager that such encroachments shall not result in any increase in flood levels during the occur- rence of the base flood discharge. (2) If subsection 11.58.160A(1) is Satisfied, all new con- struction and substantial improvements shall comply with all applicable flood hazard reduction provisions of Sections 11.58.140, 11.58,150, and 11.58.160 of this Chapter. (3) Any manufactured home, except in an existing manufactured home park or existing manufactured home subdivision is prohibited in an area of special flood hazard. B. COnstruction or reconstruction of residential structures is prohibited within designated floodways, except for repairs, reconstruc- tion, or improvements to a structure Which do not increase the ground floor area; and repairs, reconstruction or improvements to a structure the cost of which does not exceed 50 percent of the market value of the structure either, before the repair, reconstruction, or repair is start- ed, or if the structure has been damaged, and is being restored, before the damage occurred. Work done on structures to comply with existing health, sanitary, or safety codes or to structures identified as his- toric places shall not be included in the fifty percent determination. Section 2. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
