AN ORDINANCE relating to parks and playgrounds; changing park
curfew time; and amending Section 73.20.030 of the City
of Yakima Municipal Code and declaring an emergency.
WHEREAS the City of Yakima owns and operates public parks and park

���� facilities for public use; and

WHEREAS there has been a significant increase in unlawful drug
activities, vandalism, and consumption of alcohol during night time hours
especially in the summer months within Yakima parks; and
WHEREAS such activity is detrimental to the public and the City Council
finds and declares an emergency to exist so as to justify the immediate effect
of this ordinance, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 13.20.030 of the City of Yakima Municipal Code is
hereby amended to read as follows:

A. It shall be unlawful for any person to enter upon or remain
in any public park owned by the City of Yakima between the hours of ten
p.m, and six a.m, of the following day, unless the presence of such person
in such park during prohibited hours is authorized by a park use permit
issued pursuant to Section 13.16.100 of the City of Yakima Municipal Code or
otherwise is incidental to an activity or function conducted by or under the
auspices of the department of parks and recreation of the city of Yakima.
B. No person shall be convicted for violating the curfew imposed
by this section unless such violation occurred in a park conspicuously posted
around its boundaries with signs warning against entry into or remaining in ,
the park during prohibited hours.
C. No person shall be convicted for violating the curfew imposed
by this section unless, prior to being arrested, such person was warned by|
a police officer of the curfew violation and was thereafter afforded a
reasonable opportunity to vacate the park premises."
Section 2. This ordinance is one to provide for the immediate preser-
vation of the public peace, property and health of the people of the City of i
Yakima. An emergency is hereby deemed to exist. This ordinance shall be
in full force and effect immediately after its passage, approval and
publication as provided by law and by the City Charter.
