o AN ORDINANCE annexing property to the City of Yakima and zoning
said property.
I I I WHEREAS, proceedings have been held in accordance with all
applicable laws for the annexation to the City of Yakima of
the property hereinafter described, and
WHEREAS, a hearing was duly held on such annexation by the
Yakima County Boundary Review Board as required by law and as a
result of such hearing the Boundary Review Board has approved the
annexation provided for by this ordinance, and
WHEREAS, pursuant to due and legal notice, the City Council
• held a public hearing on said annexation on the 18th day of
October; and, as a result thereof, finds that such property should
be annexed to the City of Yakima and further finds that the
property should retain its current zoning pursuant to the Yakima
Urban Area Zoning Map and that such zoning and classification is
in accord with the Yakima Urban Area Comprehensive Plan, the
General Plan of the City of Yakima, that not less than seventy-
five percent of the property owners within the area described
below have petitioned the City Council for annexation, that the
needs of the City and community do require the hereinafter set
forth zoning classification, and that the highest and best use for
410/ said property is as hereinafter determined, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described property is hereby
annexed to the City of Yakima, Washington:
Beginning at a point situate 30 feet west and 335 feet
north of the Northwest corner of the Northwest Quarter
of the Northwest Quarter of the Southwest Quarter of
Section 13, Township 13 North, Range 18 E.W.M.: Thence
east parallel with the north line of said subdivision 60
feet to a point 30 feet east of the west line of said
III Section 13; thence north parallel with the west line of
said Section 13 to a point situate 30 feet east and 20
feet north of the Northeast corner of the Southeast
Quarter of the Northeast Quarter of Section 14, Township
13 North, Range 18 E.W.M.; thence west parallel with the
north line of said subdivision to the Southwest corner
of Lot 13 Fruitvale, according to the plat thereof
recorded in Volume "A" of Plats, Page 20, records of
• Yakima County Washington; thence north along the west

line of said Lot 13, to a point 35 feet north of the
• north line of said subdivisionv thence west parallel
with the aforesaid north line to a point 170 feet east
of the west line of Lot 14, said plat of Fruitvale;
thence south parallel with said west line 15 feet to the
south line of said Lot 14; thence west along said south
line to a point situate 30 feet east of the west line of
said Southeast Quarter of the Northeast Quarter of said
Section 14, being the east, line of North 20th Avenue;
thence south along the east line of North 20th Avenue to
a point situate 296.4 feet north of the centerline of 1111,
Fruitvale Boulevard, being the existing corporate limits
of the City of Yakima, Washington; thence following said
corporate limits North 89 52' East 320 feet; thence
South 0 12' West 296.4 feet to the original centerline
of Fruitvale Boulevard; thence east along said center-
line to a point 30 feet west of the Southwest corner of
the Northwest Quarter of the Northwest Quarter of the
Southwest Quarter of said Section 13, Township 13 North,
Range 18 E.W.M.; thence north to a point lying 30 feet
west and 335 feet north of the Northwest corner of said
subdivision, and the point of beginning.
Section 2. The owners of the hereinbefore described real
property annexed to the City of Yakima shall be required to assume
existing indebtednesses of the City of Yakima. ,
Section 3. The hereinbefore described real property annexed
to the City of Yakima is hereby zoned as it is currently zoned and
depicted on the official zoning map for the unicorporated portion
of the Yakima Urban Area which map is maintained in the Yakima
County Planning Department and which map is incorporated herein by
reference.

Section 4. The next regularly amended Zoning District Map
prepared by and for the City of Yakima shall show said property as
hereinbefore zoned and classified.
Section 5, The City Clerk is hereby authorized and directed
to file a certified copy of this ordinance with the County Auditor
of Yakima County and with the Board of County Commissioners of
Yakima County, Washington. •

Section 6. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as
provided by law and by the City Charter.

Comes now, the following named person(s), firm(s) or corporations)

and petition the City Council of the City of Yakima that the following
described property situate in Yakima County, Washington, to -wit:
See Attached.

be annexed to the City of Yakima, and in support of said Petition, the
above named person(s), firm(s) or corporation(s) allege and show that
they are the owners of not less than 75 percent in value according to
the assessed valuation of said property for which annexation is peti-
tioned; that said property is not now within the limits of any incor-
porated town; that said property is contiguous to the City of Yakima;
that a plat or drawing of the boundaries of said property which is
sought to be annexed is attached hereto; that the City Council of the
City of Yakima has determined that i t w i l l accept the proposed annexa-
tion and that i t w i l l require the assumption of existing City indebt-
edness by the area proposed by t h i s petition to be annexed, as reflect-
ed by the f o l l o w i n g quotation from the minutes of the June 21. 1988
meeting of the Yakima City Council:
"It was duly moved, seconded and passed that the
annexation proposed by Petition No. 1075 (Notice of
Intention to Commence Annexation Proceedings) be accept-
• ed by the City of Yakima and that the area sought to be
annexed be required to assume the City's existing in-
debtedness."
The petitioners agree to pay the expenses of publications and
posting of notices of this petition, and to assume and pay existing
City indebtedness.
WHEREFORE, petitioners pray that the City Council make and enter
an Order fixing the time and place of hearing this petition pursuant
to R.C.W. 35.13.140; that due notice be given of such hearing and that
upon a hearing the said property be annexed to the City of Yakima.
