ORDINANCE NO. ~= �~ ~~ �=
AN ORDINANCE relating to building regulations; adopting by reference the
Uniform Building Code, 1988 Edition, copyright 1988 by the
International Conference of Building Officials, regulating
the erection, construction, enlargement, alteration, repair,
moving, renxova | ' conversion, denxo| i t )on occupancy, equi-
prent, use, height, area and maintenance of buildings or
structures in the City of Yakima; and amending Sections
11.04.010, 11.04.015, 11.04.020, 11.04.025 11,04,027,
11.04.028 11.04.055 and 11.04,070, all of the City of
Yakima Municipal Code.
WHEREAS, R.C.W. 35.31 .180 authorizes cities and towns within the State
of Washington to pass ordinances adopting by reference comi |at ions and
codes relating to the construction of buildings, and
WHEREAS the City {ounc i | of the City of Yakima has heretofore exam-
i ncd and understands the scope and purpose of the regulations of the Uni-
form Building Code, 1988 Edition, copyright 1988 by the International
Conference of Building Officials, and deems it in the best interests of the
City that such Uniform Building Code and Regulations for Barrier -Free Fac-
ilities be adopted as the law of the City of Yakima, and
WHEREAS, one or more copies of such Uniform Building Code have here-
tofore been filed and are now on file in the office of the Code Adminis-
tration Manager of the City of Yakima for use and examination by the pub-
| ic, as required by law, now, therefore,
BE IT ORDAINED BY THE CITY OF YAK|MA:
Section 1. Section 11.04.010 of the City of Yak/ma Municipal Code is
hereby amended to read as follows:
o1 l .04.010 Adoption of Uniform Building Code. The L|ni fonn
8ui|ding Code, 1988 Edition, copyright 1988 by the International
Conference of Building Officials, consisting of the Uniform Building
Code, all appendices thereto except Appendices Chapters - One ' 7\we|ve
Fifty-three, Seventy, and a separate supp|cnent volume thereto en-
titled Uniform Building Code Standards, of which no less than one or
more copies each have been filed and now are on file in the office of
the Code Administration Manager of the City of Yakima, is hereby
adopted and incorporated as fu | |y as set out i n f u l l herein, as the
building code of the City of Yakima; except as hereinafter amended
and the provisions and regulations of the City of Yakima and the sev-
eral sections or numbers therein shall constitute, and may be referred
��� to as, the nmnbers of this chapter."
Section 2. Sec. 11.04,015 is hereby amended to read as follows:

Building Code, as applied to the City of Yakima, is hereby amended to
read as follows:

'Sec. 102. Purpose. The purpose of this code is to provide
ndnimun standards to safeguard life or limb, health, property and
public Ine|fare by regulating and controlling the design, construction,
qua|ity of materials, use and occupancy, location and of
all buildings and structures within this jurisdiction and certain
equipment specifica||y regulated herein.
Adoption or enforcement of this code shall not be construed for
the particular benefit of any individual person or group of persons,
other than the general public. In the event of a conflict between the
intent of this section and any: other section herein, this section
shall govern insofar as app|icab|a,
Section 3. Section 11.04.030 of the City of Yakima Municipal Code is
hereby amended to read as follows:
«11.04,020 Amendment to Section 201. Section 201 Of the Unifonm
Building Code, as applied to the City of Yakima, is hereby amended tO
read as follows:
'SECTION 201. There is hereby established in the City of Yakima
the OivisiVn of Code Administration in the Department of Community and
Economic Development which shall be under the jurisdiction of the Code
AcministrationManaSar designated by the appointing authority. Where-
ever the term Building Official is used in this code it shall be '
construed to mean the Code Administration Manager.'"
Section 4. Section 11.04.025 is hereby enacted as a new section of
the City of Yakima Municipal Code to read as follows:
«11,04.025 Amendment to Section 420. Section 420 of the Uniform
Building Code, as applied to the City of Yakima is hereby ana to
read as follows:
'SECTION 420. SENSITIZER is a chemical that causes a substantial
proportion of exposed people or animals to develop an allergic re-
action in normal tissue after repated exposure to the chemical.
SERVICE CORRIDOR is a fully onc|nsed passage used for trans-
purting HRN and for purposes other than required exiting.
SHAFT is a vertical opening through a building for elevators,
dunbv»aiters mechanical equipment or similar purposes.
SHALL
(a) With respect to the functions and powers of the Director of
Community and Economic Development, the Code Administration Manager, .
any agents and employees of the City of Yakima and any board auth-
orized hereunder, a direction aod authorizafioo to act in the exercise
of sound discretion and in good faith;

(b) With respect to the obligations upon owners and occupants of
promises and their agents, a mandatory requirement to actin cO | i-
ance with this code at the risk of civil and criminal liability won
failure so to act.'"
SMOKE DETECTOR is an approved detector which senses visible or �~
invisible particles of combustion. The detector sha| |� bear a label or
other identification issued an approved testing � agency having a
service for inspection of materials and workmanship at the factory
during fabrication and assembly.

STORY is that portion of a building included between the upper
surface of any floor and the upper surface of the floor next above,
except that the topmost story shall be that portion of a building
included between the upper surface of the topmost floor and the ceil-
ing or roof above. If the finished f|bur level directly above a
basement or unused under-floor space is more than 6 feet above grade
as defined herein for more than 50 percent of the total perimeter or

���y is more than 12 feet above grade as defined herein at any point, such
��' basement or unused under-floor space sha|| be considered as a story.
STORY, FIRST, is the lowest story in a building which qualifies
as a story, as defined herein, except that a floor level in a building
having only one floor |e/m| shall be classified as a first story,
provided such floor level is not more than 4 feet below grade, as
defined herein, for more than 50 percent of the total perimeter, or
more than 8 feet below grade, as defined herein, at any point.

STREET is any thoroughfare or public space not less than 16 feet
in width which has been dedicated or deeded to the public for public
use.

STRUCTURE is that which is built or constructed, an edifice or
building of any kind, or any piece of work artifically built up or
composed of parts joined together in some definite manner.'"
Section S. Section 11.04,027 is hereby enacted as a new section of
the City of Yakima Municipal Code to read as follows:
//11.04.027 Amendment to Section 307. Section 307 of the Uniform
Building Code, as applied to the City of Yakima is hereby amended to
read as follows:
'Sec. 307. Certificate of Occupancy
(a) Use or Occupancy. No building or structure shall be used or
occupied occupied, and no change in the existing occupancy class-
ification of a building or structure or portion thereof shall be made
until the building official has issued a Certificate of Occupancy
therefor as provided herein.
EXCEPTION: Group R, Division 3, and M Occupancies.
Issuance of a Cmrtificato of Occupancy shall not be construed as
an approval of a violation of the provisions of this code or of other
ordinances of the jurisdiction. Certifcates presuming to give auth-
ority to violate or cancel the provisions of this code or of other
ordinances of the jurisdiction shall not be valid.

(b) Change in Use. Changes in the character or use of a build-
ing shall not be made except as specified in Section 502 of this code.
(c) Certificate Issued. After the building official inspects
the building or structure and finds no violations of the provisions of
this code or other laws which are enforced by the code enforcement
agency, the building official shall issue a Certificate of 0ccupany
which shall contain the following:
1. The building permit number,
2. The address of the building.
3. The name and address of the owner.
4. A description of that portion of the building for which the
certificate is issued.

5. A statennent, that the described portion of the building
complies with the requirements of this code for the group
and division of occupancy and the use for which the proposed
occupancy is classified.

(d) Temporary Certificate. If the building official findS that

portion thereof before the same is completed, he may issue a temporary
Certificate • of • Occupancy fur, the use of a portion/or portions of a
building or structure prior to the completion of the entire building
or structure.'
(e) Posting. The Certificate of Occupancy shall be posted in a
conspicuous place on the premises, and shall not be removed bv
the building official.

(f) Revocation. The building official nay in writing, suspend.
or revoke a certificate of occupancy issued under the provisions of
this code, whenever the certificate is issued in error, or on the
basis of incorrect information supplied, or when it is determined that
the building or structure or portion 1hereof is in violation nf any
ordinance or regulation or any of the provisions of this Code.
(g) Public Nuisance. It is a public nuisance to use or occupy a i
building or structure, or any part thereof, of the groups enumerated
in subsection (a) herein without there having been issued a valid `
Certificate of Occupancy for such building, structure or part thereof.
Such public nuisance shall be subject to prevention or abatement bv
injunction or other appropriate |ega| remedy ,in the superior court of -
Washington in Yakima County.'"
Section h. Section 11.04.028 of the City of Yakima Municipal Code is
hereby enacted as a new section to read as follows:
"11.04.028 Amendment to Table Nuthar ]_A, Table number 3-A of
the Uniform Building Code, as applied to the City of Yakirra is mnonded

Section 7. Section 11,04.055 of the City of Yakima Municipal Code is
hereby amended to read as follows:
^11.04.056 Amendment to Subsection 3802(a). Subsection 3802(a)
of the Uniform Building Code, as applied to the City of Yakima is
amended to read as follows:
'Sec. 3802 (a) Mere Required. An autmnatic fire-extinguishing
system shall be installed in the occupancies and locations as set
forth in this section.
• For special provisions and hazardous chemicals and magnesium, and
calcium carbide, see the Fire Code. �II

EXCEPTION: ..Automatic sprinkler systems shall not be required for
controlled atmosphere storage rooms in which refrigeration apparatus
is installed to control the temperature in the storage roams and
gas-tight sea|s`'are incorporated in the construction of the rooms so
as to facilitate the maintenance of an atmosphere within the storage
rooms that is lower in oxygen content and higher in nitrogen and
carbon dioxide content than nnnna| atmosphere.'" :

Section 8. Section 11.04.070 of the City of Yakima Municipal Code is
hereby amended to read as follows:

-w The Washington State' Regulations - tor Barrier-Free Facilities, dated
July 1987, as promulgated by the Washington State Building Code
Council, of which regulations not less than one copy of each have been
and now are on file in the office of the Code Administration Manager,
are adopted and incorporated as fully as if set out in full herein, as
supplements and amendments to the Unifonn Building Code adopted by
this chapter."
Section 9. This ordinance shall be in full force and effect thirty
days after its passage, approval and publication as provided by law and by
the City Charter.
