AN ORDINANCE relating to building regulations; adopting by reference, and
anending certain sections of, the,Un)forn Sign Code, 1988
41 ' 'Edition' copyright 1998 •bv the International Conference of
- Building Officials; amending Sec1ionS 11.08.010, 11.08.020,
' 11.08.025 11.08.027 and 11.08.029 all of the City of
Yakima Municipal Code. •

WHEREAS, the City Council of the City of Yakima has heretofore exanh

form Sign Code, 1988 Edition, copyright 1988 by the International Con-
. ference of Building Officials, and deems it in the best interest of the

WHEREAS, one or more copies of such Uniform Sign Code have heretofore
been filed /n the office of the Code Administration Manager. of the City of
Yakima for use and examination by the public, as required by Haw, now,

RE IT ORDAINED FY THE CITY OF YAKIMA:
Section 1. Section 11.08.010 of the City of Yakima Municipal Code is
hereby amended to read as follows:

o11.08.010 Adoption of Uniform Sign Code. The Unifnnn Sign
Code, 1988 [ditioh, of the International Conference of Building •
Officials, of which not less than one or nnre copies have been and now
are on file in the office of the Code Administration Manager of the
City ak/ma, is hereby adopted and incorporated as fully as if set
out in full herein, as the Sign [}ode of the City of Yakima, except as
hereinafter amended, and the prov/sions and regulations of the City of
Yakima; and the several sections or nwnbers therein shall constitute,
and may be referred to as, the numbers of this chapter."
Section 2. Section 11.08.020 of the City of Yakima.Munic/pa| Code is
hereby wended to read as follows:
"11.08.020 ' /rendnent to Section 103. Section 103 of the Unifonn

'Sec. 103. Enforcement.
(a) Authority. The Code Administration Manager or his repre-
sentative is hereby authorized and directed to enforce all the provi-
sions of this code.
(b) Right of Entry. Whenever necessary to make an inspection to
enforce any of the provisions of this code, or whenever the building ���
official or his authorized representative has reasonable cause to ���y
believe that there exists in any building or upon any premises any
condition or code violation which makes such building or premises
unsafe, dangerous or hazardous, the building official or his author-
ized representative may enter such building or premises at all rea-
sonable times to inspect the same or to perform any duty inpmsed upon
the building official by this code, provided that if such building or
premises be occupied, he shall first present proper credentials and
request entry; and if such building or premises be umnccupied, he
shall first make a reasonable effort to locate the owner or other
persons having charge or control of the building or premises and
request entry. If such entry is refused, the building official or his
authorized representative shall have recourse to every remedy provided
by law to secure antry.
When the building official or his authorized representative shall
have first obtained a proper inspection warrant or other remedy pro-
vided by law to secure entry, no owner or occupant or any other per-
sons having charge, care or contro| of any building or premises shall
fail or neglect, after proper request is made as herein provided, to
promptly permit entry therein by the building official or his authnr-
iced representative for the purpose of inspection and examination
pursuant to this code.
(c) Board of Appeals. In order to provide for reasonable inter-
pretation of the provisions of this code there is hereby established a
Board of Appeals as provided in the Building Code.
(d) Violations. It shall be unlawful for any person, firn or
corporation to erect, construct, enlarge, alter, repair, move, im-
prove, remove, convert or demolish, equip, use or maintain any sign or
sign structure in this jurisdiction, or cause or permit the same to be
done, contrary to or in violation of any of the provisions of this
code. Any condition resulting from such unlawful conduct shall be a
public nuisance subject to abatement by the City of Yakima through
civil action.'"
Section 3. Section 11.08.025 of the City of Yakima Municipal Code is
amended to read as follows:
«11.08.025 Amendment to Section 203. Section 203 of the Unifonn
Sign Code, adopted by this chapter, is hereby amended to read as
:follows:
• 'Sec. 203. BUILDING CODE is the Uniform Building Code promul-
gated by the International Conforence of Building Officials, as
enacted by the City of Yakima.
BUILDING OFFICIAL is the Code Administration Manager or his
representative.'"
Section 4. Section 11.08.027 of the City of Yakima Municipal Code is
amended to read as follows:
x11.08.027 Amendment to Section 214. Section 214 of the Uniform
Sign Code, adopted by this chapter, is hereby amended to read as
follows:

'Sec. 214 , SIGN i s any medium, including its structure and
component parts, which is used or intended to be used to attract
attention to the subject matter for advertising purposes other than
paint on the surface of a building.
SIGN STRUCTURE is any structure which supports or is capable of
supporting any sign as defined in this code. A sign structure may be
��N�^ a single pole and may or may not be an integral part of the building.

SHALL is defined to have the following meaning:
(a) With respect to the functions and powers of the Director of
Cannunity and Economic Development, Code Administration Manager, any
-agents and employees of the City of Yakima and any board authorized
hereunder, a direction and authorization to act in the exercise of
sound discretion and in good faith;
(b) With respect to the obligations upon owners and occupants of
premises and their agents, a mandatory requirement to act in compli-
ance with this code at the risk of civil and criminal liability upon
failure so to act.
STRUCTURE is that which is built or constructed, an edifice or
building of any kind, or any piece of work artifically built up or
composed of parts joined together in some definite manner.///
Section G. Section 11.08.029 of the City of Yakima Municipal Code is
arrended to read as follows:

Sign Code, adopted by this chapter, is hereby amended to read as
follows:
'Sec. 301. Ranni ts Required. A sign shal | not hereafter be
erected, re-erected, constructed, altered or maintained, except as
provided by this code and after a penni t for the saoe has been issued
by the building nffici a| . A separate permit shall be required for a
sign or signs for each business entity,' and a separate permit shall be
required for each group of signs on a single supporting structure. In
addition, electrical permits shall be obtained for electric signs.
Any permit granted hereunder may be suspended or revoked by the Code
Administration Manager if he finds that said permit was issued in
error ,or in violation of this coda or any other ordinance of the City
of Yakima.'"
Section 6. This ordinance shall be in full force and effect thirty
days after its passage, approval and publication as provided by law and by
the City Charter.
