BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described property situate in Yakima 111 County, Washington, shall be improved by constructing a pipe sewer with the necessary wye branches and manholes: Lot 2, Exc. E 80 Ft.; Lots 3 through 8, All Lots Within Erich's Hill Sites, As Recorded in Vol. V, Page 40, Records of Yakima County, Washington; And Lot 9, Erich's Hill Sites, As Recorded in Vol. V, Page 40, Records of Yakima Clunty, Washington And Th Ptn SEk NWT Desc. As F01: Beg At Sw Cor Lot 9, Eridh's Hill Sites, Th N 0° 35' W 179.86 Ft. to NW Cor Sd Lot 9, Th W' LY Parallel With N Ln Subd. 141.21 Ft., Th S° 35' E To Ln Bearing S 89° 25' W of POB, Th N 89° 25' To POB; Lots 10 through 13, Erich's Hill Sites, As Recorded in Vol. V, Page 40, Records of Yakima County, Washington; and Lots 14 through 16, Erich 's Hill Sites, As Recorded in vol. V, . page 40, Records of Yakima County, Washington. Yakima County Parcel Numbers: 181320-13416 through 181320-13422 Incl. and 181320-13441, 181320-13424 through 181320-13427, 181320-13434 and 181320-13435. Section 2. There is hereby created a Local Improvement District, to be called "Local Improvement District No. 1037", Which said district shall include all of the above described property. Section 3. The assessments shall be made according to special nenefits derived from the improvements without regard to the zone and termini method. Section 4. All costs and expenses in connection with the con- struction of said improvements, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assess ed against all of the property legal- ly and properly assessable therefor as provided by law and as above described. Section 5. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detail- ed drawings which have been prepared by the City Engineer, filed with • the City Clerk, and which are hereby approved and adopted. Section 6. The work necessary to be done in connection with the making of said improvements shall' be done by contract upon competitive bids according to specifications and plans as prepared by the Engineer- ing Division of the Department of Community Development, and the City shall have the power to reject any and all bids. ORDRES EE5 . Section 7. There is hereby created a special fund, to be known as "Local Improvement Fund, District No. 1037 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Section 8. Bonds shall be issued in payment of the costs and 410 expense of said improvements, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, which assessments, with interest, shall be payable annually under the mode of payment "payment by bonds" as defined by the statutes of the State of Washington and the ordinances of the City of Yakima; provided, this improvement may be financed by the issuance of promissory notes, under the authority of R.C.W. 35.45.150 and Section 8.12.100 of the City of Yakima Municipal Code. The term and interest rate of bonds and special assessments contemplated by this section shall conform to provisions, terms and conditions to be spec- ified by a subsequent ordinance of the City of Yakima. Section 9. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by law and by the City Charter. Zais, Jr. City Manager • City of Yakima 129 No. 2nd Street Yakima, WA 98901 Dear Mr. Zais: I hereby submit the following report in regard to the Erich's Hill Sites Sewer Local Improvement District according to Resolution No. D-5046 adopted by City Council on Novanber 20, 1984. The total cost and expense of this improvement is estimated at $45,000 of which $41,247.01 is to be borne by assessment against properties within the district. Total evaluation of land only $229,800 Twenty-five percent evaluation of improvements only $ 57,450 $287,250 There are no outstanding assessments for local impraVement districts against properties within the proposed district.
