1985-2844 REZONE PROPERTY AT INTERSECTION OF 40TH & SUMMITVIEW AVENUES
ORDINANCE 2844 AN. ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at the intersection of 40th and Summitview Avenues from B-1, Modified Business Zone and R-2, Two-Family Zone to Planned Development Zone.. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 22nd day of January, 1985, on the recommendation of the Planning Commission that real property situate at the southeast corner of the intersection of 40th and Summitview Avenues in the City of Yakima, Uashington the legal description of which is set out below, be rezoned from B-1, Modified Business Zone and R-2, Two-Family Residential Zone to Planned Development Zone, and WHEREAS, as a result of its hearing, the City Council hereby makes its following findings and conclusions: FINDINGS: 1. The application is for a rezone from B-1, Modified Business Zone and R-2, Two-Family Zone to Planned Development Zone for property located on the southeast corner of North 40th and Summit- view Avenues for the purpose of constructing a structure for mixed retail use, using the north half of a parking lot belonging to an adjacent church as a shared parking space. 2. The northern portion of the subject property is currently vacant as a result Of recent demolition of an abandoned service station. and is zoned B-1, Modified Business Zone. The southern portion is zoned R-2, Two-Family Residential Zone and is being used for church parking. Surrounding land use and zoning is as follows: Zoning Land Use North Planned Development Bank/Financial (Vacant) South R-2 (Two-Family Res.) Church parking East B-1 (Modified Business) Church West B-1 (Local Business) Retail • 3. The Optimal Land Use section of the Urban Area Plan in- dicates that this proposal is generally compatible with the surrounding properties. 4. The City Planning Commission recommended approval of the rezone . subj to certain conditions specified below. • CONCLUSIONS: 1. The request is in conformance with the Yakima Urban Area Comprehensive Plan. 2. The recommendation of the Planning Commission to grant the rezone should be affirmed, and the rezone should be granted subject to the conditions set out below now,. therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situate at the southeast corner of North 40th and Summitview in the City of Yakima, Washington, and more particularly described as follows, to wit: Lots 29, 30 and 31 of the Plat of Weber Square as recorded in Volume "K", Page 1, records of Yakima County, Washington. be rezoned from B-1, Modified Business Zone and R-2, Two-Family Zone to Planned Development Zone be, and the same is hereby, approved and said real property is hereby rezoned to Planned Development Zone, all in accordance with, and to conform to, the final development plan and program therefore approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, the rezone granted by this ordinance is subject to the condition that a sign be posted at the parking lot exit onto 40th Avenue restricting movement to right turns only, with the sign and its placement to be subject to the approval of the City Traffic Engineer. Section 2. The above change in zoning shall be included and depicted on the next regularly amended use district map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect 111 thirty days.after its passage, approval and publication as provided -2- by law and by the City Charter.
