HomeMy WebLinkAbout1985-2854 PARTIAL VACATION OF A PORTION OF SOUTH 29TH AVENUE • ORDINANCE 118 28 5 4 AN ORDINANCE providing for the partial vacation of a portion of South 29th Avenue in the City of Yakima, Washington. • WHEREAS, in connection with the rezoning to a Planned Development Zone of the Yakima Valley Memorial Hospital facility, a request was made for the partial vacation of a portion of South 29th. Avenue, the legal description of which is set out hereinbelow, and WHEREAS, hearings were held by both the City Planning Commission and City Council on the matter of the vacation, and as a result of those hearings the City Council findS-Itto be in the best interests of the City that a portion of South Avenue be partially vacated as more specifically provided herein- below, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following portion of South 29th Avenue between Chestnut Street and Walnut Street in the City of Yakima, Washington, to 'wit: All of that portion of South 29th Avenue lying north. of the south lines extended of Lots 10 and 11 of Nob Hill Orchard Heights adjoining North YakiMa (now Yakima) as recorded in Volume "E" of Plats, Page 25, records of Yakima County, Washington, andlying south of a circle having a radius of 40, feet; the center of said circle being a point on the centerline of South 29th Avenue • lying 34.64 feet south of the north lines extended of Lots 9 and 12 of said Nob Hill Orchard Heights. is hereby vadated. Section 2. The City of Yakima hereby reserves all necessary easements, and the right to exercise and grant easements, over, along, and across, and above and below the surface of the vacated street, for the installation, construction, repair and mainte- 410 nance of City and other public utilities which may now exist in said street or which may hereafter be installed or constructed therein and no building or other structure shall be constructed on any portion of the vacated street without the prior approval of the City. Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter; provided, this ordinance shall not become effective until compensation in the amount of $1,723.75 has 400 been paid to the City.
