• AN ORDINANCE accepting the recommendation of the Planning
Commission and rezoning property at 103 North
6th Street from R -1, One - Family Zone to Planned
Development Zone.
WHEREAS, pursuant.to due and legal notice, the City
Council of the City of Yakima held a hearing on the 12th day
:of March, 1985, on the recommendation of the Planning Commission
that real property situate at 103 North 6th Street in the City
of Yakima, Washington, the legal description of which is set
out hereinbelow, be rezoned from R -1, One- Family Zone to Planned
Development Zone, and
WHEREAS, as a result of its hearing, the. City. Council hereby
makes its following findings and conclusions:
• FINDINGS:'
1. Mr. Larry Becker has requested a Planned Development
zone for property located'at 103 North 6th. Street, The purpose
of his request is to allow the establishment of an accounting
office in the existing single - family residence. His intent is
to have the site remain substantially unchanged with the exception •
of the asphalt paving and parking facility.
2. The proposal is insubstantial conformance with the
Urban Area Plan that states "professional offices may be allowed
adjacent to low - moderate density residential development if it
can demonstrate compatibility ", and further "in areas where com- •
patibility conflicts with the citizens of the area can be resolved."
3. There were no objections voiced by the citizens living
in the immediate area.
4. The City Planning Commission recommended approval of --the
request. •
CONCLUSIONS: •
1. The recommendation of the Planning Commission to grant
the rezone should be affirmed, and the rezone should be granted,
now, - therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
• the City of Yakima that the following described real property
situate at 103 North 6th Street in the City of Yakima, Washington,
and more particularly described as follows to wit:
Lots 15 and 16 of Yakima and Huson's Additions to IIIL
North Yakima, now Yakima, as recorded in Volume "A"
of Plats, Page 11, records of Yakima County,
Washington.

be rezoned from R-1, One-Family Zone to Planned.Development Zone
be, and the same is hereby, approved and said real property is
hereby rezoned to a Planned Development Zone, all in accordance
with and to conform to the final development plan and program
approved by the Yakima Planning Commission, a copy of which is
attached hereto and by reference made a part hereOf.
Section 2.. The above change in zoning shall be included and
depitted on the next regularly amended Use District Map prepared
by and for the City.

Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 19th
day of March , 1985.

SUMMARY EXPLANATION:
Background
Mr. Larry Becker has requested a Planned Development zone for property located at
103 N. 6th Street. The pulvise of his request is to allow the establishment of
an accounting office in the existing single - family residence. He has stated his
intent is to have the site remain much as it is today with the exception of the
asphalt paving and parking facility.
Findings
The Planning Commission and staff finds Mr. Becker's proposal in substantial
conformance with the adopted Urban Area Plan that states "professional offices
may be allowed adjacent to low - moderate density residential development if it can
demonstrate compatibility", and further "in areas where compatibility conflicts
with the citizens of the area can be resolved."
This proposal assures that the residential character of the site will remain.
There were no objections voiced by the citizens living in the irnrdiate area.

1. Proposed purpose remains the same with the intention of operating
a Accounting Office from a former vacant residence located at 103
No. 6th. street. Business License will be maintened for the follow-
ing usages.

B. Pioneer Business Forms
1 employee Territorial salesman - Main Plant Rep.
from Tacoma Office. Desk space - only office.
C. Computer Forms and Supplies
NO eraplbyees. This is a complimentary company to
provide the supplies for accounts usage. Under
separate name only because of Duel Ownership.
2, Property usage snap drawn to scale of 1/8" G 1'. 12 copies provided.
3. Property located at corner of North 6th St. and East 'A' street.
Main entrance to office will. be from the read of the residence.
4 property is serviced by City Utilities and P.P.&L Elect.
5. Existing subdivision.
6. No structural changes to existing buildings anticipated.

7. Approximately 60% of the property is in lawn.
8. Mairi entry to the office will be from the rear of the residence.
Motor traffice will enter from.the alley running North and South
between 'A' and B. The Major portion of the consulting is done
outside of the office with only four or five clients per day corning
to the office. There will be no naticable effect on presant trafic.
9. Parking, 6 stright in General parking spaces in paved area. This area
is presantly fenced with rase bushes down the 6th st side which will
remain and a prun tree and a peach tree inside the area which will
remain. 2 customer parking spots on the paved area adjacent to the
entry drive around area, 3 covered employee parking spaces in the
presant garages. 1 alternate customer parking space in the front
drive way which will be discouraged as far as using at all. 12 TOTAL
Dry well drain will be provied in the parking area with 3" rains asph.
10. We hope to be fully moved by April 1st. 1985. The Parking lot can
not be compleatad untill mid summer by 8/k/85 because they allready
have their spring time paving jobs lined up.

that the Final Plan and Program retluested by Larry Becker for a
rezone from R -3 to Planned Development at t03 North 6th Street he
approved subject to tha conditions stated in the stall report.

Larry Becker, 103 North 6th Street, explained to the Commission
that the stai:f request for a 24' driveway entrance would not be
possible, and suggested that his proposal of the driveway entrance,
parking, and exit onto "[I Street would be more beneficial to the
project anu would also prevent a r_onttict with foot traffic from
the Convention. Center area.
Dick 1irilse_ , 1u3 c i 6th Street, stated that he and Mr. Becker
had studied the access/egress plans on this lot and felt that their
proposed driveway plan would be more practical than the staff
recommendition.

John Haddix presented the staff report and findings, recommending
that the request of Larry Becker for a rezone from R -3 to B-1 at
103 North 6th Street be denied based on the reasons staters in the
staff report.
Discussion followed regarding: the uses in a B-1 zone; buffer zone
north of "A" Street and east of Naches Avenue; possibility of B -1
zoning in the core area;' rezone to Planned Development as opposed
to a 13--1 rezone of this proposed project to maintain the
residential character.
Citizens Comments (For)
Larry Becker explained that he and Richard Halsey would use the
proposed project for an accounting office and business; portion of
the house would be unoccupied; intend to refurbish the interior and
exterior of the property to maintain the current historical
residential character; will not dhange the landscaping currently on
the property; has a definite plan for the use of the project.
Mary Hersey, owner of 113 North 8th Street, stated that the traffic
pattern in the area has created problems on No. 8th Street and
created an island of single family residences that are not able to
be sold. Mrs. Hersey said that she supports a rezone for the
proposed project to B -1 and wished to see the island from North 6th
Street to North 9th Street - Yakima Avenue to "B" Street rezoned
to B-1 or B -3.
Richard Halsey said he wished to assure the Commission that the
business to be established in the proposed property would be
business counseling and would not be a high density business; the
current aesthetic value of the property would remain.

Commission Comments
Discussion followed regarding the possiblity of the applicant
requesting a Planned Development rezone rather than a B-1 rezone,
and the timefrane needed for the applicant to get this heard by the
Commission and the City Council.
A recess was called at 8:50 p.m. and reconvened at 9:10 p.m.
John Haddix explained to the Commission that staff had met during
the r - ss to consider the options available to the applicant and
to the Commission regarding this matter. These options are if the
rezone is denied by the Commission, the applicant can appeal to the
City Council for approval; the Commission can deny without
prejudice and ask the applicant to apply for a Planned Development
rezone; consider this as a Planned Development preliminary hearing,
however, staff is net sure this would net the legal standards.
Mr. Becker was asked by the Commission Which direction he wished to
proceed and staff explained the requirements of a Planned
Development request. Mt. Becker stated that he wished to consider
this a Preliminary Planned Development hearing and will comply with
staff requirements for the Final Plan and Program for the next
meeting.
This being considered the Preliminary Hearing, the Commission
offered the following comments to the applicant: Tenney stated
that according to the ordinance, he did not agree with the Planning
Caronission decision that this should be considered a legitimate
Preliminary Hearing; Kurbitz stated that he would accept the
Planned Development, but would like to see this as a B -1 zone,
Hughes, Snodgrass, Nubling, Heinen and Patterson indicated that
this would save the applicant tire and to proceed with the Planned
Development.
It was MOVED by Hughes, seconded by Heinen to continue this meeting
until January 10, 1985 at 11 :30 A.M. in the Planning Conference
Room, City Hall, to consider the area from the alley between Naches
Avenue and North 6th Street to North 8th Street from "A" to "B"
