AN ORDINANCE accepting the recommendation of the Planning
Commission and rezoning property at 1507 West
Yakima Avenue from R-3, Multiple-Family Zone
to Planned Development Zone. .
-410 WHEREAS, pursuant to due and legal notice, the City
Council of the City of Yakima held a hearing on the 12th day
of March, 1985, on the recommendation of the Planning Commission
that real property situate at 1507 West Yakima Avenue in the
City of Yakima, Washington, the_legal description Of which is
set out hereinbelow, be rezoned from R-3, Multiple-Family Zone
to Planned Development Zone, and
WHEREAS, as a result of its hearing, the City Council
hereby makes its following findings and conclusions:
4111 FINDINGS:
1. Ms. Bonnie Armstrong has submitted a request for
a rezone from Multiple-Family Zone to Planned Development
Zone. This request is to allow the use of an existing residential
structure as a "gallery/studio" located at 1507 West Yakima
Avenue
2. The site is zoned R-3, Multiple-Family Zone. A two-
story residential structure occupies the site. The area is
transitional in nature with a mixture of B-1, Modified Business
Zone, R-3, Multiple-Family Zone and R-1, One-Family Zone uses
in the immediate area. Adjoining zoning and land uses are as
follows;

West B-1, Modified Medical Office
Business
3. The Optimal Land Use Plan indicates that art gallery
may be compatible with adjoining residential uses with appro-
. priate site considerations and would be compatible with adjoining
professional business uses.
4. The site is served by ,Yakima Avenue and a pavea:falley.
Yakima Avenue is classified as a minor arterial.
5. An environmental checklist was submitted and a determina- „ •
tion'of'non-significance issued pursuant to the State Act.

6. The City Planning Commission recommended approval of the
rezone request.
CONCLUSIONS:
1. The request is in conformance with the Yakima Urban Area
Comprehensive Plan.

2. The recommendation of the Planning Commission to grant
the rezone should be affirmed, and the rezone should be granted,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that the following described real property
situate at 1507 West Yakima Avenue in the City of Yakima, Washing-
ton, and more particularly described as follows, to wit:
The east 10 feet of Lot 11 and all of Lot 12 of Ray's
Nob Hill Addition as recorded in Volume "B" of Plats,
Page 49, records of Yakima County, Washington.
be rezoned from R-3, Multiple-Family Zone to Planned Development
Zone be, and the same is hereby, approved and said real property
is hereby rezoned to a Planned Development Zone all in accordance .
with, and to conform to, the final development plan and program
approved by the Yakima Planning Commission, a copy of which is
attached hereto and by reference made a part hereof.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The City Clerk is hereby authorized and directed
to file with the Yakima County Auditor a certified copy of this
ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.

SUMMARY EXPLANATION:
Background
Ms. Bonnie. Armstrong has submitted a request for a rezone from R -3 (Residential
Multiple - Family) to P.D. (Planned Development). This request is to allow the use
of an existing residential structure as a "gallery /studio" located at 1507 W.
Yakima Avenue.
Zoning and Land Use
The site is zoned R -3 (Residential, Multiple - Family). A two -story residential
structure occupies the site. The area is transitional in nature with a mixture
of Modified Business (B--1), Multiple - Family and Single - Family uses in the
immediate area. Adjoining zoning and land use are as follows:

Urban Area Plan
The Optimal Land Use Plan indicates that an art gallery may be compatible with
adjoining residential uses with appropriate site considerations and would be
compatible with adjoining professional business uses.

An environmental checklist was submitted and a determination of non - significance
issued pursuant to the State Act.
Findings
1. On January 3, 1985, the Planning Commission reviewed the Preliminary Plan
and Program. Concerns raised at that time included:
a. Traffic pattern conflict
b. Sight screening
c. Compliance with City Building Codes.
2. The applicant has submitted a revised site plan. The Final Plan appears to
satisfactorily respond to the Planning Commission's and stiff's concerns.

PROPOSED DEVELOPMENT PROGRAM FOR 1507 WEST YAKIMA AVENUE
LEGAL DESCRIPTION: The east 10 feet of Lot 11 and all of Lot 12 of Ray's Nob
Hill Addition as recorded in Volume "B ", Page 49, records of Yakima County,
Washington.
The development program for 1507 West Yakima Avenue proposes to create a gallery
/studio in the existing two -story building which is now used as a residence.
The gallery /studio would be operated by its owner.
A three -phase program is proposed in order to accomplish this goal. Phase I
targets rezoning of said property from its current multi - family residential
[R -3] status to Planned Development [PD] by March 1, 1985. Phase II calls for
the demolition of the existing garage and the creation of nine [9] additional
on -site parking spaces on a paved parking lot to be created on the rear of the
property by July 15, 1985. Phase III projects an opening date of August 1, 1985,
for the gallery /studio.
The site has City of Yakima water, sewer, and garbage service. It also has
access to public transportation in,the form of Yakima City Transit, Route #8
Lincoln, which makes hourly stops on South 16th Avenue, less than a block from
the site.
The only lighting to be added to the site would be two ground level spotlights
used to illuminate a sign to be erected in front of the gallery /studio. The
sign would measure five [5] feet by five [5] feet. This sign would be the major
element in a small rock garden which would be part of the landscaping for the
front yard.
Entrance to the parking lot would be limited to Yakima Avenue. Exit from the
parking lot would be limited to the rear alley.
Site screening for the property would be achieved by planting arbor vitae along
the full extent of its east and north boundaries and along a portion of its
west boundary, The arbor vitae would stand six [6] feet high except along the
front 20 feet of the east boundary where they would measure a maximum of
three [3] feet, six [6] inches.
A foot path would lead gallery visitors from the rear parking lot to the
front entrance.
A drywell, calculated to meet city standards, would be incorporated as part
of the design for the parking lot.This dry well would be capable of containing
the run -off from an inch of rainfall in a 24 -hour period. T Z• �

Don Skone presented the staff report and findings, recommending
that the Final Plan and Program requested by Bonnie Armstrong for a
rezone from R -3 to Planned Development at 1507 West Yakima Avenue
be approved subject to the conditions stated in the staff report.
Citizen Comments (For)
Pat Brown, 116 South 8th Street, representing Bonnie Armstrong,
stated that she had no objections to the conditions stated in the
staff report.
Citizen Comments (Against)
Dr. Harold Hofer, 1515 West Yakima Avenue, made the following
statements: he opposed the proposed project as he felt the cus-
tomers at the art gallery would use his parking lot; he opposed a
spot zoning for this project and would like to see the entire block
rezoned; if the parking lot is in the rear of the proposed project
customers would walk on his property to get to the front door;
trees on the property need to be trimmed, and he has had no cooper-
ation from the current owners to trim the trees from the power
lines; the present garage on the proposed project is 3" on his
proerty; if proper parking was provided and the trees trimmed, he
would not be opposed to the project.
Larry Wright explained to the Commission that Dr. Hofer's letter
had been received by the Planning Office and fir. Hofer had indi-
cated all of the above mentioned in the letter. Mr. Wright read a
letter from Dr. Michael Korach, 1514 West Yakima Avenue, which

indicated that Dr. Korach was opposed to the project as the parking
for the proposed project would not be adequate and that Dr. Hofer
and Dr. Korach's parking lots would be used by the gallery patrons.
Commission Comments
Discussion followed regarding the parking lot as designed and Ms.
Brown was asked by the Commission if the applicant would check on
the concern of Dr. Hofer regarding the trees on the property. It
was MOVED by Hughes, seconded by Nubling to approve the request of
Bonnie Armstrong for a rezone from R -3 to Planned Development at
1507 West Yakima Avenue subject to the conditions stated in the
staff report. Motion carried, all members present voting aye by
voice vote.

Pat Brown, 116 South 8th Street, representing Bonnie Armstrong,
explained to the Commission that the proposed project would be used
for a studio /gallery with minimal retail trade. MS. Brown stated
that the residential character of the house would be mined to
compliment the surrounding neighborhood; parking lot will be in the
rear and accessible from the alley; proponent is willing to
redesign the parking lot as proposed by staff.
Citizen Comments (Against)
No one present wished to speak against this proposal.
Commission Comments
This being the Preliminary Hearing, the Commission offered the
following suggestions to the applicant: work with staff to retain
the project as a neighborhood residence; redesign parking lot as
requested by staff; project looks favorable subject to staff
recommendations.

The documents submitted to the City Council in this packet con-
sist of the same documents submitted by the staff to the Planning
Commission in preparation for the hearing. At the Planning
Commission hearing, exhibits were introduced by various parties.
Those exhibits are not included in this packet. Those exhibits
are on file in the office of the Department of Community and
Economic Development, and are available for inspection prior to
the hearing. Those exhibits will be available in the Council
meeting room at the time of the hearing for introduction as ex-
hibits in the City Council hearing if any party desires to intro-
duce such exhibits.
Attached is a list of those exhibits.
NOTE TO COUNCIL MEMBERS:
In the event a Councilmember inspects any exhibit(s) prior to
the Council hearing, the Councilmember should not discuss the
exhibit(s) with any City staff member, except as may be necessary
