HomeMy WebLinkAbout1985-2864 MODIFICATION TO 4708 TIETON DRIVE z ORDINANCE NO. 2 - 4 AN ORDINANCE granting a major modification to a Planned Development Zone applicable to property at 4708 Tieton Drive, 411 WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on April 2, 1985, on the recommendation of the Planning Commission that a major modifi- cation be granted to the existing Planned Development Zone applicable to property at 4708 Tieton Drive, Yakima, Washington, and WHEREAS, as a result of its hearing, the City Council hereby makes: its following and conclusions: FINDINGS: 1. Time Oil Company has submitted a final plan and program fora major modification to an existing Planned Development located on the southeast corner of South 48th Avenue and Tieton Drive where. an automobile service station now exists. The purpose, of this request is to allow the construction of a convenience store at this location. The existing building would be demolished and replaced with a new convenience store. One set of gasoline pumps would remain at its present location while the second set of pumps would be relocated. 2. The subject property is currently occupied by a service station, is zoned Planned Development, and is approximately one-half acre in size. Zoning Land Use North. R-1, Single Family Single Family Residential South. Planned Development Professional Office East Planned Development Professional Office West Planned Development Bank 3. The Optimal Land Use section of the Urban Area Plan indicates that this proposal is generally compatible with the surrounding uses with the exception of the properties to the north, 4. The City Planning Commission recommended approval of the major modification, subject to the conditions set out below. CONCLUSIONS: 1. Although the Urban Area Plan indicates that this proposal may not be compatible with the properties to the north, the proposal would not substantially'increase the impacts currently existing on the site. if, as proposed, the hours of operation are not extended beyond 12: midnight. 2. The recommendation of the Planning Commission to grant the major modification should be affirmed, and the major modifi- cation request should begranted, subject to the conditions set out below, now, therefore, BE. IT ORDAINED BY THE CITY OF YAKIMA: Section I. The recommendation of the Planning Commission of the. City of that the major modification to the ,Planned Development Zone applicable to the following described property at 47U8 Tieton Drive, Yakima, Washington, to wit: The north 175 feet of the west 170 feet of the northwest quarter of the northwest half of Section 27, Township 13 North, Range 18 E.W.M Yakima County, Washington: EXCEPT 30 feet of right-of-way for Tieton Drive and 20 feet of right-of-Way for 48th Avenue. be, and the same is hereby, approved and the property is hereby rezoned as Planned Development Zone to include the major modifi- cationjoroposed by the development plan and program approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, the major modification is granted subject to the following conditions: 1. The sign is to be relocated on the premises in accordance with the Unifo/m Sign Code and Chapter 11.08 of the City of Yakima Municipal Code., 2. Any extension of hours of operation past midnight will be deemed a major modification of this Planned Development, and .authorization of the City Council must first be obtained before hours of operation are extended. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. -2- Section 3. The. City. Clerk is hereby authorized and directed to file with the. Yakima County Auditor a certified copy of this ordinance.. Section 4. This ordinance shall be in full force and effect thirty days after its'passage:, approval and publication as provided by law and by the City Charter. The purpose of this request is to allow the construction of a convenience store at this location. The existing building would be demolished and replaced with a new convenience store. One set of gasoline pumps would remain at its present loeatlon while t h e second set of p u m p s would be relocated. A previous application sdbmitted by Time Oil was unable to satisfy City concerts regarding the locations of curb --outs and pump islands, however, this proposal has been redesigned in an effort to satisfy these concerns. Zoning and Land Use The subject property is currently occupied by a service station, is zoned PD (Planned Develop ent ) , and is approximately ore -half acre in size. We propose to construct a 60 x 40 convenience store using standard wood construction. 2. Replace existing 28' long concrete pump island with new 10' long island as shown on Drawing 1915. 3. Replace two (2) existing driveways along both Tieton Drive and South 48th Avenue with one (1) 35' drive on each street. 4. Approximately 1,500 sq. ft. of landscaping will be provided (including 5 -foot wide strip along street). 5. We propose to install a 96 sq.ft. single pole exterior lit sign at the Northwest corner of site. (22 ft. to top of sign.) 6. We plan to have business hours of 6:00 a.m. to 12:00 p.m. with one (1) employee per shift. TIME OIL COMPANY Judd Black presented the staff report and findings recommending that the request of Time Oil Company for a major modification to an existing Planned Development at 4708 Tieton Drive be approved subject to the conditions listed in the staff report. Citizen Comments (For) John Jost, Time Oil Company, Seattle, stated that his company did not object to the staff recommendations of the sign requirement. Citizen Comments (Against) No one present wished to speak against this proposal. Caamission Comments After discussion, it was MOVED by Nubling, seconded by Snodgrass to approve the Final Plan and Program requested by Time Oil Company for a major modification to an existing Planned Development at 4708 Tieton Drive subject to the staff recommendations and to include that any future change in the hours of operation as stated in the Final Program must be considered as a major modification. TIME OIL COMPANY Judd Black presented the staff report and findings, recommending that the request of Time Oil Company for a major modification to an existing Planned Development at 4708 Tieton Drive be approved subject to the conditions listed in the staff report. Mr. Black also advised the Commission that the applicant has indicated that the hours of operation at the proposed project will be 6:00 A.M. to 12:00 Midnight. Citizen Comments (For) John Jost, Time Oil Company, Seattle, stated that the deed for the right -of -way is in the process of being prepared; pump island could be moved approximately 5 -6' westerly as requested by staff, but any further would interfere with gasoline delivery; siding on the pro- posed building will be of cedar material with a dark color; does not object with the sign requirements requested by staff. Citizen Comments (Against) Yvonne Craig, 4703 Tieton Drive, stated that the same problems with the traffic at the corner of 48th Avenue and Tieton Drive exist as stated at the previous hearings and she has trouble getting into and out of her driveway. Mrs. Craig said the hours of operation proposed are much more agreeable than a 24 hour operation presented at earlier hearings. Elfrieda Melzer, 4705 Tieton Drive, stated that problems continue to exist with traffic turning into the present station at the corner of 48th and Tieton Drive. MIND E R15 Commission Comments This being the Preliminary Hearing, the following comments were presented by the Commission to the applicant: the hours of opera- tion be included in Final Plan and Program. Discussion followed regarding traffic and the right -of -way at the intersection and Denny Covell stated that it was possible that a traffic study would be conducted at the corner after the new signalization is in- stalled. fir. Covell said that if there is a problem with traffic turning left on Tieton Drive into the Time Oil Company driveway, installation of a Type C barrier would be considered. • MINONE RI6
