AN ORDINANCEgranting a major modification to a Planned
Development Zone applicable to property at
South. AGth Avenue and Nob Hill Boulevard.
WHEREAS pursuant to due and legal notice, the City Council
of the City of Yakima held its hearings on April 2 and April 9,
1985 on the recommendation of the Planning CoMmission that a
major modification be granted to the existing Planned Development
Zone applicable to property at the intersection of South 40th
Avenue and Nob Hill Boulevard in the City of Yakima, Washington,
and
WHEREAS, as a result of its hearings, the City Council
,
hereby makes its following findings and conclusions:
FINDINGS:
1. Inline Construction, Inc. has submitted a request
. for a major modification to an existing planned development
located between South. 38th and South 40th Avenues north of
West Nob Hill Boulevard.. The purpose of the request is for
(1) a realignment of proposed buildings, (2) placement of
additional . buildings, and (3) redesign of the parking facilities.
2. The proposal is in substantial conformance with the
adopted Urban Area Plan, Also, it is consistent with previous
actions taken by the Planning Commission and City Council (e.g.
no access from South 38th Avenue).
3. The City Planning Commission recommended approval of
the major modification, subject to the conditions set out below.
CONCLUSIONS:
1. The recommendation of the Planning Commission to grant
the major modification should be affirmed, and the major modifi-
cation request should be granted, subject to the conditions set
110 out below, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of
the City of Yakima that the major modification to the Planned
Development Zone applicable to the following described property
at the intersection of South 4Qth Avenue and Nob Hill Boulevard,
Yakima, Washington, to wit:
PARCEL A: The southwest quarter of the southwest
quarter of the southwest quarter of the northeast
quarter of Section 27, Township 13 North., Range 18, •
EWM, EXCEPT the south 166 feet of the west 153 feet;
and EXCEPT the west 40 feet thereof; and EXCEPT the
south 36 feet thereof.
PARCEL B: The northwest quarter of the southwest
quarter of the southwest quarter of the northeast
quarter of Section 27, Township 13 North, Range 18,
EWM, EXCEPT the south 170.00 feet thereof; and
EXCEPT the west 40.00 feet thereof for street.
PARCEL C: The south. 170 feet of the northwest quarter
of the southwest quarter of the southwest quarter of
the northeast quarter of Section 27, Township 13 North,
Range 18, EWM, EXCEPT the west 40 feet for street.
PARCEL D: The northeast quarter of the southwest
quarter of the southwest quarter of the northeast
quarter of Section 27, Township 13 North, Range 18,
EWM, EXCEPT the east 25 feet conveyed to Yakima
County for road; and EXCEPT the east 134 feet of the
south 110 feet of said subdivision; and EXCEPT the
south 6 feet of said subdivision.
PARCEL E: The south 166 feet of the west 153 feet
of the southwest quarter of the southwest quarter of
the southwest quarter of the northeast quarter of
Section 27, Township 13 North, Range 18, EWM, EXCEPT
the west 40 feet thereof; and EXCEPT the south 36
feet thereof for street.
be, and the same is hereby, approved and the property is hereby
rezoned as Planned Development Zone to include the major modifi-
cation proposed by the development plan and program approved by
the Yakima Planning Commission, a copy of which is attached
hereto and by reference made a part hereof; provided, the major
modification is granted subject to the following conditions:
1. That the disclaimer be removed from the elevation shown
on the plan, so that the building appearance shall not be sub-
stantially changed from that as shown.
2. That a dust abatement procedure shall be written and
submitted to the Chief Building Offical of the City, and be
subject to his approval, prior to issuance of a building permit.
3. That an on -site drainage plan be written and submitted
to the City Engineer, and be subject to his approval, prior to
issuance of a building permit.
4. That a ground sign plan be submitted to the Office of
Environmental Planning, and be subject to approval by that office,
prior to the issuance of a building permit.

5. That an indication of the phaseS of development be filed
with the Office of Environmental Planning prior to the issuance
of a building permit.
III Section 2. 'The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared
by and for the City.
Section 3. The. City Clerk is hereby authorized and directed •
to file with the Yakima County Auditor a certified copy of this
ordinance. •
Section 4. This ordinance shall be in full force and effect
thirty days after its passage,- approval and publication as provided
by law and by the City Charter.
