NO, 2 8 6 9 • AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning property at 708 North 2nd Street from R-3, Multiple-Family Zone to 111 Planned Development Zone. WHEREAS, pursuant to due and legal notice, the CitT of the City of Yakima held a hearing on the 16th day of April, 1985, on the recommendation of th.e Planning Commission that real property situate at 708 North 2nd Street in the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Multiple-Family Zone to Planned Development Zone, and WHEREAS, as a result of its hearing, the City Council hereby makes its following findings and conclusions: FINDINGS: 1. Thomas R. Edwards dba Four Seasons Square has submitted a Final Plan and Program for a rezone from R-3, Multiple-Family Zone, to Planned Development Zone for a vacant lot located at 708 North. 2nd Street. The proposed development is the installation of an 18 space off-street parking facility to serve a professional office building proposed for 711 North 1st Street. While the plan shows the proposed office structure, the office development is currently, zoned B-2 (Local Business) and is therefore not a part of the planned development request. The purpose of locating • parking on the Planned Development site is to maximize the use of 711 North 1st Street for office square footage. 2. Land use and zoning on adjacent properties is as follows: 'Zoning 'Land Use North R-3 Single-Family Residential South R-3 Single-Family Residential East R-3 Single-Family Residential West B-2 Professional Offices 3. The density of the adjacent residential neighborhood 111 is approximately 9 DU/NRA which places it in the Moderate Density Residential land use category. The Optimal Land Use Element of the Urban Area Plan indicates that the proposed development is compatible, with site considerations, with the adjacent Moderate D ensity residential neighborhood. 4. The City Planning Commission recommended approval of the request subject to certain conditions specified below. CONCLUSIONS: • 1. The request is in conformance with the Yakima Urban Area Comprehensive Plan. 2. Site screening and buffering will be provided to achieve compatibility with the adjacent residences and to satisfy the intent of the Urban Area Plan. 3. The. recommendation of the-Planning Commission to grant the rezone should :be, affiLmed, and the rezone should be granted, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property 4111 situate at 708 North 2nd Street in the City of Yakima, Washington, and more particularly described as follows, to wit: Lots 4 and 5, Block 23, Town of North. Yakima, now Yakima, recorded in Volume "A" of Plats, Page 10, re-recorded in Volume "3" of Plats, Page 1, records of Yakima County, Washington. be rezoned from R-3, Multiple-Family Zone to Planned Development Zone be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Development Zone, all in accordance with, and to conform to, the final development plan and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, the rezone granted by this ordinance is subject to the following conditions: 1. That the applicant and successors in interest agree to participate in a future Local Improvement District for paving of the alley. 2. That a chain or gate be provided for the 2nd Street entrance to the parking lot to close the lot during non-business hours. 3. That there not be a barrier between parking stalls numbered 1-3 so that traffic can flow between the alley and 2nd when stalls 1-3 are not in use, -2- Section 2. The above change in zoning shall be included • and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with. the Yakima County Auditor a certified copy of this ordinanCe. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as pro- vided by law and by the City Charter. The following comments were offered by utility canpanies, agencies, and City divisions participating in Design Review of the proposal: a) City Traffic Engineering Div. - Recanmends that the site be lighted with high pressure sodium lights; that landscaping at exit to lot not interfere with traffic vision; possible need for two - way left turn lane . on North 1st St.; question about need for sidewalk on west side of North 2nd Street. b) City Engineering and Utilities Dept. - Notes that an on -site drainage system will be required and that utilities are located in the alley right -of -way. c) City Water Div. - Notes that irrigation line is located in the alley and requests to be notified if the alley is to be paved. d) City Public Works Dept. - Recommends that alley be paved since it is part of parking design and suggests sidewalk on North 1st St. be repaired. e) City Fire Dept. - Requests more information about two story office building. f) City Streets and Refuse Divs. - No canment g) City Code Enforcement Division - No comment h) City Police Dept. - No cammment i) Washington State Dept. of Ecology - No comment j) North Yakima Conservation District - No canment k) Pacific Northwest Bell - No comment i) Cascade Natural Gas - Notes that shallow (3' to 15 ") service lines run from the alley to residences to be removed to accommodate the office construction. m) Pacific Power & Light - Requests that the applicant provide information as soon as possible on electrical load and voltage requirements. 2. Site screening and buffering will be provided to achieve compatibility with the adjacent residences and to satisfy the intent of the Urban Area Plan. 3. The Yakima City Planning Commission, in public hearing on March 5, 1985, recommended approval of the Planned Development request subject to the following conditions: a. That the applicant and successors in interest agree to participate in a future Local Improvement District (LID) for paving of the alley. b. That a chain or gate be provided at the 2nd Street entrance to the parking lot to close the lot during non - business hours. c. That there not be a barrier between parking stalls numbered 1 -3 so that traffic can flow between the alley and 2nd Street when stalls 1 -3 are not in use. STAFRP M2 PROGRAM FOR PLANNED DEVELOPMENT The enclosed information is respectfully submitted as a written program for development and sets out detailed information concern- ing the following subjects as they may be involved in or provided' . for by the planned development. They are: 1) Market Analysis: The apparent conclusion concerning the lot at 708 North Second Street is that as an R -3 lot there appears to be little community interest in investing in any R -3 development. Investment appears to be going to better R -3 areas of the city. Allowing planned development of this lot to a parking lot seems beneficial to the city and • all concerned. • 2) Proposed Ownership of 708 N. Second Street; T -Gem Trust 711 N, First St. Yakima, Wa 98901 3) Operation and Maintenance: • The lot would be maintained and operated by T -Gem Trust. 4) Waste disposal facilities: None appears to be needed. 5) Lighting: None is planned for, as this is generally going to be a day time parking lot. 6) Water supply: Irrigation is available for watering plants and foliage. 7) Public Transportation: None appears to be needed. 8) Community facilities: None appears to be needed. 9) General Timetable: Proposed Start: April 1985 Proposed Completion: September 1985 MINUTES CITY OF YAKIMA PLANNING CCMDI<SSION March 5, 1985 MEMBERS PRESENT STAFF PRESENT Deb Patterson Glenn K. FOUR SEASONS SQUARE Don Skone presented the staff report and findings, recommending that the request of Thomas Edwards, dba Four Seasons Square for a rezone fran R - 3 to Planned Development at 708 North 2nd Steet be approved subject to the conditions stated in the staff report. Citizen Comments (For) Thanas Edwards, 711 North 1st Street, stated that he was present to answer any questions of the Planning Commission. Citizen Comments (Against) Clifford Clayton, 712 North 2nd Street, stated that he had received a letter fran Wilmer L'Heureux, owner of 710 North 2nd Street, opposing the project. Don Skone said that staff had received a copy of this letter, but it was not entered into the record as 710 North 2nd Street had been withdrawn as part of the Planned Development. Mr. Clayton stated that Mr. L'Heureux had given him limited Power of Attorney to speak on his behalf and that he and Mr. L'Heureux request that the alley be paved for this project, low lighting in the parking lot be installed, and a five foot setback from Mr. L'Heureux's property be established. Commission Comments Discussion followed regarding: the parking lot is the only consideration of this Planned Development; the proposed structure will be sized to the amount of the parking; the possibility of forming an LID for the alley; lighting in the parking lot. Mr. MINUT E5 Edwards stated: he would prefer a Chain closing the parking lot at night as opposed to lighting of the lot; he would be in favor of forming an LID with the neighbors for paving the alley; size of proposed building will confirm to the number of parking spaces. After further discussion, it was MOVED by Hughes, seconded by Menke to approve the Final Plan and Program requested by Thomas Edwards, dba Four Seasons Square for a rezone from R -3 to Planned Development at 708 North 2nd Street subject to the staff recanmendations and include that Mr. Edwards proceed with an LID for the paving of the alley and chain the drive- through on the entrance on North 2nd Street. Motion carried, Hughes, 'tabling, Heinen, Kurbitz, Menke, Patterson voting aye; Snodgrass voting nay as she wished a curb be placed at the end of the driveway to discourage through traffic from the alley to North 2nd Street. Citizen Comments (For) Tom Edwards, 711 North 1st Street, stated: he does not object to lighting of the parking lot, but that the neighbors may object; a chain closing the lot at night would provide security; objected to paving the entire alley, but would support an LID; sidewalk on the north side of North 2nd Street would remain; no comment on instal- lation of ground lighting for pedestrian safety. Larry Wright read a letter received from Mr. Clifford Clayton, 712 North 2nd Street, stating that he had no objections to a parking lot at 708 North 2nd Street, and a letter from Jack Foster, Diver- sified Realty, 707 North 1st Street, which stated that he is in favor of the project. Citizen Comments (Against) Clifford Clayton, 712 North 2nd Street, made the following state- ments: he had sent the letter which was in favor of a parking lot at 708 North 2nd Street, but is opposed to a parking lot at 710 North 2nd Street which adjoins his property; according to the zoning ordinance a parking lot is considered a B -3 zone which is not compatible with an R -3 zone; he manages apartments for Mr. MINONE R13 Wilmer L'Heureux, owner of 710 North 2nd Street, which has site screening but does not keep lights from shining into the apart- ments. Mr. Clayton also stated that he felt it was unfair for the City to allow adjacent property to be zoned B -3, since he cannot use his property for B -1, and would like to see that the entire area is rezoned to B -1 so he can sell his residential property. Jeanine Benoit, 819 North 2nd Street, asked for clarification on the entrance of the driveways to the proposed project. It was explained that the driveways will be onto both North 1st and North 2nd Streets. Don Skone advised the Commission that he had received a phone call on this date from an adjoining property owner, Adrienne Otto, 24406 - 13th Street S.E., Monroe, Washington, in opposition to the proposed project because of additional traffic, and she wished to retain as a residential neighborhood. Commission Comments This being the Preliminary Hearing the following comments were submitted by the Commission to the applicant: site screening of the proposed project should be considered; applicant should con- sider refining the Preliminary Plan and Program before submitting for final; project would create an intrusion on the neighborhood; currently zoned R -3 and parking requirements of same. The Commis- sion also asked staff to clarify if the mailing list included all �. property owners within 300 feet had been contacted, and discussed possible long range plan of this area on North 2nd Street.
