HomeMy WebLinkAbout1985-2876 VACATING PORTION OF THE 900 BLOCK OF SOUTH NACHES AVENUE ALLEY ORDINANCE 'NO. 2 8 7 6 AN ORDINANCE vacating a portion of an alley in the 900 block of South Naches Avenue. WHEREAS, a petition to vacate a portion of an alley in the 900 block of South Naches Avenue, more specifically described below, was filed with the City by Pacific Realty Associates, L.P., and WHEREAS, hearings were held by both the City Planning Commission and the City Council on the matter of the vacation, and as a result of those hearings the City Council finds it to be in the best interests of the City that the petition to vacate the portion of the alley be granted, subject to the conditions provided below, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following portion of the alleyway in the 900 block of South Naches Avenue in the City of Yakima, Washington, to wit: The alley on the west side of Block D of South Park Addition to North Yakima, (now Yakima, Washington) as recorded in Volume "B" of Plats, Page 2, records of Yakima County, Washington, from a point lying 25 feet south of the north line of Lot 2 to a point lying 25 feet south of the north line of Lot 4 of said South Park Addition; together with the north 20 feet and the south 5 feet of the north 25 feet of the west 30 feet of Lot 2 of Block D of South Park Addition to North Yakima (now, Yakima, Washington) as recorded in Volume "B" of Plats, Page 2, records of Yakima County, Washington. is hereby vacated. Section 2. The City of Yakima hereby reserves all necessary easements, and the right to exercise and grant easements, over, along, and across, and above and below the surface of the north/south portion of the vacated alley, lying along the west side of Block D, as described above, for the installation, construction, repair and maintenance of City and other public • utilities which may now exist in said alley or which may hereafter be installed or constructed therein and no building or other structure shall be constructed on that portion of the vacated alley without prior approval of the City. Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter; provided, this ordinance 1111 shall not become effective until compensation in the amount of $1,748.35 has been paid to the City. 411 PASSED BY THE CITY COUNCIL, signed and approved this day of 11, , 1985.
