AN ORDINANCE accepting the recommendation of the Planning
Commission and rezoning property at 1008 South
40th Avenue from R -3, Multiple- Family Zone to
B -1, Modified Business Zone.
WHEREAS, pursuant to due and legal notice, the City Council
of the City of Yakima held a hearing on the llth day of June,
1985, on the recommendation of the Planning Commission that real
property situate at 1008 South 40th Avenue in the City of
Yakima, Washington, the legal description of which is set out
hereinbelow, be rezoned from R-3, Multiple- Family Zone to B-1,
Modified Business Zone, and
WHEREAS, as a result of its hearing, the City Council
hereby makes its following findings and conclusions:
FINDINGS:
1. Applicant requested that property located at 1008 South
40th Avenue in the City of Yakima, Washington, be rezoned from
R -3, Multiple- Family Zone to B -1, Modified Business Zone, for
the stated purpose of allowing an existing single family
residential structure to be used as a physical therapy center.
2. The Optimal Land Use element of the Urban Area Plan
indicates that professional office development of this type is
compatible with high density residential development of the type
in the immediate neighborhood.
3. The proposed rezone site is an isolated single family
residence bordered by property on the south zoned B -1, Modified
Business Zone and property on the north developed for multiple
family occupancy.
4. The proposed rezone site is adequately served by an
arterial street, South 40th Avenue.
5. The proposed rezone is compatible with adjoining land
uses.
6. The City Planning Commission recommended approval of
the rezone.
CONCLUSIONS:
1. The recommendation of the Planning Commission to grant
the rezone should be affirmed, and the rezone should be granted,
now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:

Section 1. The recommendation of the Planning Commission
of the City of Yakima that the following described real property
situate at 1008 South 40th Avenue in the City of Yakima, Wash-
ington, and more particularly described as follows, to wit:
A parcel of land lying within the southeast quarter of
the northwest quarter of Section 27, Township 13 North,
Range 18, E.W.M., Yakima County, Washington, described
as follows: beginning at the southwest corner of Lot
54, Mt. Vista Addition recorded in Volume "R" of Plats,
Page 1, records of Yakima County, Washington; thence
north 89 19' east along the south line of said lot
• 166.4'; thence south 70'; thence 89° ; thence 9' west
176.25'; thence north 8 00' 70.81' to the point of
beginning.
be rezoned from R-3, Multiple-Family Zone to 8-1, Modified
Business Zone be, and the same is hereby, approved and said real
property is hereby rezoned to B-1, Modified Business Zone.
Section 2. The above change in zoning shall be included
and depicted on the next regularly amended Use District Map
prepared by and for the City.
Section 3. The City Clerk is hereby authorized and
directed to file with the Yakima County Auditor a certified copy
of this ordinance.
Section 4. This ordinance shall be in full force and
effect thirty days after its passage, approval and publication
as provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this
day of 1985.
