AN ORDINANCE providing for the acquisition by condemnation or purchase
of easements and rights of way over, across and through
certain real property more particularly described below
for use by the City of Yakima in the installation, opera-
tion and maintenance of an approach lighting system_at the
Yakima Municipal Airport; providing for the method of pay-
ment therefor; and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That it is necessary that the City of Yakima,
Washington, acquire easements and rights of way by condemnation pro-
ceedings or purchase over, across and through the following described
real property situate in Yakima County, Washington, to-wit:
PARCEL 1:
A Strip of land 200 feet in width, along the following described
centerline: Commencing at a point 580.84 feet north and 30 feet east
of the SW corner of Section 36, Township 13, Range 18 E.W.M.; thence
S. 70 03' E along the centerline of Runway 9 -27 extended, Yakima
Municipal A rport, a distance of 617.23 feet, all in Section 36,
Township 13, Range 18, E.W.M.
PARCEL 2:
A , strip of land 200 feet in width, along the following described
centerline: Commencing at a point 376.16 feet north and 610.06 feet
east of the SW corner of Section 36, Township 13, Range 18, E.W.M.;
thence S 70 03' E along the centerline of Runway 9 -27 extended,
Yakima Municipal Airport, a distance of 231.30 feet, all in Section
36, Township 13, Range 18, E.W.M.
Also a strip of land 70 feet in width, along the following described
centerline: Commencing at a point 299.46 feet north and 827.62 feet
east of said Section corner; thence S 70° 03 ' E along the centerline
of Runway 9 -27 extended, Yakima Municipal Airport, a distance 465.10
feet, all in Lot 1 and 2, Block 42 of said Section and containing
approximately 1.82 acres.
PARCEL 3:
A strip of land 70 feet in width, along the following described
centerline: Commencing at a point 145.05 feet North and 1265.08 feet
east of the SW corner of Section 36, Township 13, Range 18, E.W.M.,
thence S 70° 03' E along the centerline of Runway 9 -27, Yakima
Municipal Airport, a distance of 437.40 feet. All in Block 43 of
Secion 36, Township 13, Range 18, E.W.M., and containing approxi-
mately 0.70 acres.
PARCEL 4:
A strip of land 70 feet in width, along the following described
centerline: Commencing at a point 2564.38 feet East and 313.04 feet
South of the SW corner of`Section 36, Township 13, Range 18, E.W.M.;
thence S 70 03' E along the centerline of Runway 9 -27, Yakima
Municipal Airport, a distance of feet, all in Lot
4 of Section 1, Township 12, Range 18, E.W.M. and containing Approxi-
mately 0.20 acres.
That the acquisition of said easements and rights of way over, across
and through the above described property is for the purpose of con-
structing, operating, and maintaining an approach lighting system for
the Yakima Municipal Airport. It is hereby ordained that the ease-
ments and rights of way over, across, and throughthe above described
real property be acquired by purchase or dondemnation proceedings as
provided by law for the acquisition of property for such public use.

Section 2. That the City Commission speEifically finds that
the said easements and rights of way are necessary for the proper
development of the Yakima Municipal Airport, and that such improve-
ment and the acquisition of said easements and rights of way are here-
by declared to be a pgblic use.
Section 3. That the cost and expense of acquisition of said
easements and rights of way shall be determined in the manner pro-
vided by law, and all of such costs and payment of just compensation
for the easements and rights of way and severance dam:es, if any,
done to the adjoining property by the acquisition thereof as deter-
mined by and proceedings for such acquisition, shall be paid for from
the "Approach Lighting System" item within the "Capital Outlay"
Classification of the 1958 Budget of the Airport Improvement Fund.
Section 4. This ordinance is one to provide for the immediate
preservation of the public peace, property, health and safety and an
emergency is declared to exist, and this ordinance shall be in full
force and effect immediately upon its passage, approval and publica-
tion as provided by law and the City Charter
PASSED BY THE CITY COMMISSION, signed and approved this 23rd
day of April, 1958.

that the same has been published as required by law.
