ORDINANCE NO. B-2151
AN ORDINANCE amending Section 2401 of Ordinance No. B-2095 entitled
"AN ORDINANCE establishing zones in the City of Yakima;
regulating and limiting the use of buildings and land;
establishing use, height, area, and off-street parking re-
gulations; providing for yards, courts and other open
spaces; providing for the adoption of maps shaving the
boundaries of said zones; providing for a Board of Adjust-
Ment; providing for the administration and enforcement of
this Ordinance, and fixing penalties for the violation
of its provisions; repealing Ordinances numbered B-22,
B-35, B-43, B-51, B-71, B-126, B-147, B-172 and B-293,
and all amendments thereto, and all other Ordinances
and parts of Urdinances in conflict herewith; and de-
claring and emergency", and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That Section 2401 of Ordinance No. B-2095
be and the same is hereby amended to read as follows:
Section 2401. 9UILDING INSPECTOR SHALL ISSUE PERMIT.
Written application for a Certificate of Occupancy Permit for a new
building or for a use requiring the addition to, or the alteration of an
existing building shall be made at the same time as the application for a
Building Permit. Where a change in occupancy in a building or structure
that does not require additions or alterations occurs, or a change in
occupancy upon land, written application shall be made at least seven (7)
days prior to the time that any use is established upon said land or
within said building. Upon written notification by the owner that said
building or land is ready for occupancy, the Buidling Inspector, within
five (5) days after receipt of said notification, shall, after final in-
spection, issue a Certificate of occupancy Permit if said use is found
to be in conformance with the provisions of this Ordinance. A Certifi-
cate of Occupancy Permit for a legal non-conforming use shall indicate
that such use is suoject to the restrictions of non-conforming uses as
specifiec in this Ordinance."
Section 2. This ordinance is one to provide for the
immediate preservation of the public peace, property, health and safety
and an emergency is declared to exist, and this ardinance shall be in
full force and effect immediately upon its passage, approval and publi-
cation, as provided by law and the City Charter.
