ORDINANCE NO. B-2146

AN ORDINANCE adding paragraph 14 of Section 800 and Paragraph 40 of Sec-
tion 1000, and amending Sections 400, 704, 800, 903, and
1000 of Ordinance No. B-2095 entitled "An Ordinance estab-
lishing zones in the City of Yakima; regulating and limit-
ing the use of buildings and land; establishing use, height,
area, and off-street parking regulations; providing for
yards, courts and other open spaces; providing for the
adoption of maps showing the boundaries of said zones;
providing for a Board of Adjustment; providing for the
administration and enforcement of this Ordinance, and fix
ing penalties for the violation of its provisions; repeal-
ing Ordinances numbered B-22, B-35, 3-43, 3-51, B-71, B-126,
B-147, 9-172 and 9-293, and all amendments thereto, and all
other Ordinances and parts of Ordinances in conflict here-
with; and declaring an emergency."
BE IT ORDATNED BY THE CITY OF YAKIMA:
Section 1. That Section 400, paragraph 4 of Otdinance No.
3-2095 be and the same is hereby a-nended to read as follows:
"4. Private stables, provided:
" a. The number of horses, not counting sucklings, in
a private stable shall not exceed two (2) for :every
acre in the area of the lot on which such building is
located."
Section 2. That Section 704 of Ordinance No. B-2095 be
and the same is hereby arnended to read as follows:
"Section 704. SIDE YARDS. Every lot and parcel of land
in a B-1 zone, when devoted to a use permitted initially
in a B-1 Zone, but not permitted in an R-3 zone, need pro-
vide no side yards except as may be required by a Special
Use Permit, unless when bordering one of the "R" zones, all
the boundaries abutting residential zones shall have side
yards as r4quired for the residential zone they abut and
shall be landscaped."
Section 3. That Section 800, paragraph 10 of Ordinance
No. B-2095 be and the same is hereby amended to reas as
follows:
"10. Dry Cleaning pickup agencies and dry cleaning plants
provided the cleaning solvents used are nonflammable, non-
odorus, nontoxic and nonexplosive and further provided
that the venting of the plant meets the provisions of the
Building Code."
Section 4. That there is hereby added to Section 800 of
Ordinance No. 3-2095 paragraph 14 which shall read as follows:
"14. Commercial Parking Lots."
Section 5. That Section 801, paragraph 1, of Ordinance No.
B-2095 be and the same is hereby amended to read as follows:
"1. All uses shall be conducted wholly within a building
except for providing service to automobiles or customers
in automobiles."
Section 6. That Section 804 of Ordinance No. 9-2095 be
and the same is hereby amended to read as follows:
"Section 804. SIDE YARDS: Lots and parcels of land in a
B-2 zone need provide no side yardS except as may be re-
quired by a Special Use Permit, unless when bordering one

of the "R" Zones, all the boundaries abutting residential
zones shall have side yards as required for the residen-
tial zone they abut and shall be landscaped."
Section 7. That Section 903 of Ordinance No. B-2095 be
and the same is hereby amended to read as follows:
"Section 903. SIDE YARDS: Lots and parcels of land in a
B-3 Zone need provide no side yards except as may be re-
quired by a Special Use Permit, unless when bordering one
of the "R" Zones, all the boundaries abutting residential
zones shall have side yards as required for the resident-
!' ial zone they abut and shall be landscaped."
Section 8. THat there is hereby added to Section 1000 of
Ordinance No. B-2095, paragraph 40 which shall read as follows:
"40. Accessory usses, normally a part of the Principal
Use."
Section 9. That Section 1000, paragraph 2, of Ordinance
No. B-2095 be and the same is hereby amended to read as
follows:
"2. Auto salvage and auto wrecking operations, provided
that the property shall be enclosed by a tight board or
masonry fence or similar, permanent, sight obscuring
structure not less than eitht (8) feet in height, Said
fence shall be uniform in color and shall not be used for
outdoor advertising display purposes."
Section 10. That Section 1000, paragraph 16, of Ordinance
No. B-2095 be and the same is hereby amended to read as follows:
"16. Junk handling, provided that the property shall be
enclosed by a tight board or masonry fence or similar,
permanent, sight obscuring structure not less than eight
(8) feet in height. Said fence shall be uniform in color
and shall not be used for outdoor advertising display pur-
poses."
Section 11. That Section 1000, paragraph 29, of Ordinance
No. B-2095 be and the same is hereby amended to read as follows:
"29. Storage in bulk of the following, which does not in-
clude salbaged or waste materials or junk storage or oper-
ations, provided the property is enclosed by a wall or
fence of sturdy construction and uniform color or an ever-
green hedge not less than six (6) feet in height."
Section 12. This ordinance shall be in full force and
effect 30 days after its passage, approval and publication as provided
by law and the City Charter.

day of March, 1958.

tion and enforcement of this Ordinance and fixing penalties for the viola-
tion of its provisions; repealing Ordinances numbered B-22,B-35,B-43,B-51,
B-71,B-126,B-147,B-172 and B-293, and all amendments thereto, and all
other Ordinances and parts of Ordinances in conflict herewith; and declar-
ing an emergency."as passed on the 13th day of March, 1958, and that the
same has been published as required by law.
