ORDINANCE NO. 8-2144
AN ORDINANCE providing for the expenditure of funds in the City Hall
and Miscellaneous General Government not provided for in
the 1958 Budget, and declaring an emergency.
WHEREAS, it has become necessary to install a storm sewer
to provide adequate drainage for the drainage area in the vicinity of
29th Avenue and Lincoln Avenue within the City of Yakima, and
WHEREAS, at the time of the adoption of said 1958 Budget
it could not be reasonably forseen that such storm sewers would be re-
quired; and
WFIEREAS, an emergency exists requiring the expenditure of
funds for the aforementioned purpose, and
WHEREAS, the action contemplated herein is authorized by
R.C.W. 35.33.090, NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That an emergency exists requiring the expendi-
ture of an amount not to exceed $7,000.00 for the installation of a
storm sewer to provide adequate drainage for the drainage area in the
vicinity of 29th and Lincoln Avenues within the City of Yakima, and
that said emergency has arisen by reason of the failure of the existing
sub-drain to adequately carry off the storm drainage, thereby causing
flooding of properties in the area.
Section 2. That there is hereby appropriated the sum of
$7,000.00 for storm sewer construction, said item being within the '"Cap-
ital Outlay" classification of the City Hall and miscellaneous general
government budget.
Section 3. The City Clerk is hereby authorized, empowered,
and directed to issue emergency warrants upon the funds chargeable there-
for upon the presentation of proper claims for the installation of said
storm sewer in an aggregate amount not to exceed $7,000.00, and the City
Treasurer is directed to honor such emergency warrants.
Section 4. This ordinance is one to provide for the ex-
penditure of funds not budgeted and an emergency is declared to exist
and this ordinance shall be in full force and effect immediately upon
its passage, approval and publication as provided by law and the City
Charter.

published as required by law.
