ORDINANCE NO B -2306
AN ORDINANCE relating to, regulating and licensing the business of mer-
chant patrolmen, defining such business, providing penalties
and repealing Ordinance No. B -1190, as amended by Ordinance
No. B -163.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. For the purposes of this ordinance, the term
"merchant patrolman" is defined to mean any person or corporation who, for
hire or reggrd, as a business, and as an independent contractor;; guards
or protects persons or persons' property, or patrols streets, districts
or territories for such pruposes, and includes any person who is employed
as a guard or patrolman for any such person or corporation.
Section 2. It shall be unlawful for any person, firm or
corporation to be or to become a merchant patrolman or solicit business as
a merchant patrolman without being the holder of a valid and subsisting
license issued underthe provisions of this ordinance, such license to be
designated as "Merchant Patrolman's License." The fee for such license
shall be 025.00 per year, or in case of a temporary employee as such,
shall be $5.00 per month. All annual licenses shall expire on the 31st
day of October of. each year, and no reduction in fee for such licenses
shall be made for any•parti.al year.
Section 3. Applications for "Merchant Patrolman's License"
shall be eiccompanied by a receipt showing the payment of the required fee
to the City Treasurer and shall be made to the City Clerk on forms to be
furnished by him; shall be signed and verified by the applicant (or in
case of a corporation shall be signed by a duly authorized officer of the
corporation and shall give the local address and place of business of the
corporation); and shall state the applicant's full name, age and residence
present and prekious occupations, and if an employee, the address of the
place of business and the name of his employer. The City Clerk, before
acting upon the application, shall requirst the Chief of Police to in-
vestigate the truth of the statements contained therein and any other
matters which might lead in determining whether the application shall be
granted. The Chief of Police shall within a reasonable time after the
date of such request, furnish a report to the City Clerk containing the
results of his investigation, and if the City Clerk be satisfied that the
statements contained in such application are true, that the applicant is
of good moral character, a citizen of the United States, and that his
finger prints are on record with the Police Department of the City of
Yakima, and is qu to receive the license applied for, he shall
issue the license applied for in accordance with the provisions of this
ordinance; otherwise said application shall be denied.
Section 4. Before receiving the license, the applicant shall
be required to file with the City Coerk a bond, conditioned for the faith-
ful performance of his duties, executed in behalf of the applicant in the
sum of $1,000.00 and anming the City of Yakima as obligee. Anyone who
would have any right upon or concerning said bond, had he been named as
obligee therein, shall have the same right as if so named, Anyone having
any interest in said bond may sue thereon separately or jointly, with any-
one else also interested. It shall not be necessary to sue in the name of,
or to join the City of Yakima in any suit upon such bond.
Section 5. The license herein required may at any time be
revoked by the City Commission upon the conviction of the holder thereof
of a crime involving moral turpitude or on conduct of the holder detri-
mental to the preservation of peace and order in the City of Yakima. The
holder of such license shall be given ten days' notice in writing by the
City Commission of any such forfeiture, and upon the determination by said
City Commission that the holder of such license is no longer a fit and
proper person to conduct such business as defined in this section, such
license shall thereupon be revoked.
Section 6. Anyone violating this ordinance shall be guilty
of a misdemeanor and fined not to exceed Three Hundred Dollars (p300.00)
or imprisoned in the City jail for a time not to exceed ninety (90) days,
or both.
Section 7. Ordinances Rol B -1190 and No. B -1633 are hereby
repealed.

Section 8. That this Ordinance shall be in full force and
effect 30 days after its final passage, approval and publication as pro- Wg.w
vided by law and the City Charter.
