ORDINANCE NO. B-2291
AN ORDINANCE directing the City Treasurer of the City of Yakima to transfer
all funds in the Cumulative Reserve Fund for Yakima City
Library Building Fund of the City of Yakima to the Yakima
County Treasurer and declaring an emergency.
WHEREAS, the City of Yakima has a fund known as the Cumula-
tive Reserve Fund for Yakima City Library Building Fund, and
WHEREAS, the City of Yakima entered into a contract with the
Rural County Library District of Yakima County which created the Yakima
Valley R Libfary, and
WHEREAS, in said contract, the County Treasurer of Yakima
County was named Treasurer of the Regional Library, and
WHEREAS, R.C.W. 27.12.080 provides in part that "the treas-
urer of one of the participating units shall have custody of the funds of
the Library. The tf,easurers of the other participating governmental units
shall transfer to the one who has been selected as treasurer for the libr-
ary, all moneys collected for public library purposes in their goVernmental
units.", and
WHEREAS, in an opinion dated June 28, 1957 the Attorney Gen-
eral of the State of Washington ruled that the meaning of the above-cited
portion of statute included all funds including the proceeds from the sale
of General Obligation bonds, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That the Chief City Accountant and the City
Treasurer of the City of Yakima are hereby authorized and directed to
transfer all money presently in the Cumulative Reserve Fund for Yakima
City Library Building Fund of the City of Yakima together with all bonds
or invested collateral within said fund to the Yakima County Treasurer for
the use of the Yakima Valley Regional Library.
Section 2. This Ordinance is one to provide for the immedi-
ate preservation of the public peace, property, health and safety, and an
emergency is hereby declared to exist and this ordinance shall be in full
force and effect immediately upon its passage, approval and publication as
provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 13th
day of May, 1959.

Yakima County Treasurer tnd declaring an emergency.", as passed on the
13th day of May, 1959, and that the same has been published as required
by law.
