B-2287 7z2 AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, and together with the necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and creating a speciql fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following streets shall be improved by grading, ballasting, surfacing with asphaltic concrete and constructing curbs and gutters, together with necessary dainage features: 1. Unnamed Street betweeh Mavis Avenue & Lincoln Avenue from 40th Avenue east 185 feet. 2. All of Kenny Drive 3. Chrisholm Trail from Chestnut to Walnut. Section 2. the following alley shall be improved by grading, ballasting, and surfacing with asphaltic concrete: Alley in Block 4 - Richland 2nd Addition. Section 3. That the following street shall be improved by grading, ballasting, and surfacing with asphaltic concrete: Blackburn Street, west of 8th Avenue South. All of said improvements shall be constructed in full accordance with the plans and specifications prepared by the City Engineer and filed with the City Clerk. Section 4. There is hereby created a Local Improvement District, to be called "Local Improvement District No. 870", which said district shall include all of the property adjacent to the abovementioned improvement-2 which are subject to assessments, said property being des- cribed above. Section 5. The assessments shall be made according to dpecial benefits derived from the improvements without regaIrd to the zone and termini method. Section 6. All costs and expenses in connection with the construction of said improvements, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property leg- ally and properly assessable therefor as provided by the laws and as above described. Sectiom 7. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and de- tailed drawings which have been prepared by the City Engineer, filed with the City Clerk, and which are hereby approved and adopted. Section 8. All of the work necessary to be done in connec- tion with the making of said improvement shall be done and made by con- tract upon competitive bids; and the City shall have the power to re- jeet any and all bids. Section 9. There is hereby created a special fund, to be called "Local Improvement Fund District No. 870", into which shall be 11 placed all sums paid on account of the aforesaid special assessments, including all interest, and penalties thereon; and in the event of the sale of local improvement bonds by the Cityl, all premium and interest on said bonds issued for said improvement': Section 10. Bonds bearing interest at the rate of 4% per annum, payable on or before 12 years from the date of issuance, shall be issued in payment of the costs and expense of said improvement, which arl bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property with said district, payable in ten equal aOnual installments with interest at the rate of 4% per annum, inter- est payable annually, under the mode of"payment by bonds", as defined by the statutes of the State of Washington and the ordinances of the City of Yakima Section 11, This Ordinance is one relating to local improve- ments or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by the City Charter.
