ORDINANCE NO. B-2286 1731
AN ORDINANCE providing for the improvement of property in the City of
Yakima by the construction of necessary mains, fire hyd-
rants, valves qnd other appurtenances for the purpose of
supplying water for domestic use and fire protection, es-
tablishing a Local Improvement District, providing for the
method of payment theregor, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1; That the property in the City of Yakima, Wash-
ington, shqllbe improved by the construction of necessary
mains, fire hydrants, valves and other appurtenances for
the purpose of supplying water for domestic use and fire
protection; sqid improvement to serve the property the
boundaries of which are described as follows:
Lots 2 to 9 inclusive, except West 140 feet,
Block 2 Terminal Addition;
Lots 13 to 15 inclusive, Block 2 Terminal Addition;
Beginning 416.3 feet East of the NW Corner of NEk,SW, Sec-
tion 30, T. 13N., R.19; thence S. 45 55' E 136.2 feet,
thenc8 S. 17 E. 523 feet, thenceSouth 74 feet, thence
S. 48 30' E. 283 feet, thence S. 59 0 17' E. 93.5 feet to
0.W.R. and N. Co. right of way, thence northwesterly along
west line of said right of way to north line of NE4, SA,
thence West 130 feet to beginning, except North 50 feet to
City for right of way.
All of said improvement to be constructed in full accordance
with the plans and specifications to be prepared by the City Engineer.
Section 2. There is hereby created and established a Local
Improvement District, to be called "Local Improvement District No. 869",
which said district shall include all of the property described and set
forth in Section 1 hereof.
Section 3. A portion of the costs and expehses of said
improvement including engineering, inspection, advertising, publication
of notices, if any, and all other expenses incident thereto, shall be
levied and assessed against all of the property legally and property
assessable therefor, as provided by law and as above described, and the
balance of the said costs and expenses shall be borne by the City Water
Department in accordance with Resolution No. C-1051.
Section 4. All of the work necessary to be done in connec-
tion with the making of said improvement shall be done by the City of
Yakima.
Section 5. There is hereby created a special fund to be
called "Local Improvement Fund, District No. 869" into which shall be
paid all sums paid on account of the aforementioned specia. assessment,
including all interest and,penalties thereon; and in the event of the
sale of the local improvement bonds by this City, all premiums and in-
terest on said bonds issued for said improvement.
Section 6. Bonds bearing interest at the rate of 4% per
annum, payable on or before 12 years from date of issuance shall be
issued in payment of the costs and expenses of the said itprovement,
which bonds shall be redeemed by the collection of special assessments
to be levied and assessed upon the property with said district, payable
in ten annual installments, with interest at the rate of 4 % per annum,
interst payable annually under the mode of "payment by bonds"as defined
by the statutes of the State of Washington and the ordinances of the
City of Yakima.
Section 7. This ordinance is one relating to local improve-
ments or assessments therefor, and shall become effective immediately up-
