B-2279 AN ORDINANCE adding Article 6.5; and Paragraphs 19, 20, 21, 22, 23, 24, 25, 26, 27, •and 28 of Section 800; paragraphs 17, 18, 19, 20, 21, and 22 of Section 900; and paragraphs 10 and 11 of Section 1300 of Ordinance No. B-2095 entitled "AN ORDINANCE establishing zones in the City of Yakima; regulating and limiting the use of buildings and land; establishing use, height, area, and off-street parking regulations; provid- ing for yards, courts and other open spaces; providing for the adoption of maps showing the bouddaries of said zones; providing for a Board of Adjustment; providing for the administration and enforcement of this Ordinance, and fix- ing penalties for the violation of its provisions; repeal- ing Ordinances numbered B-22, B-35, B-43, B-51, B-71, B-126, B-147, B-172 and B-293, and all amendments thereto, and all other Ordinances and parts of Ordinances in con- flict, herewith; and declaring an emergencyl" BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That there is hereby added a new Article 6.5 of Ordinance No. B-2095, which shall read as follows: Article 6.5. R-4 Suburban Residence Zone (R-4 Zone) Section 650: LAND USE. The R-4 zone is intended to pro- vide uniform provisions for suburban and rural and residential areas which may be annexed to the City from time to time. These standards are designed to protect the character of outlying sections of the com- munity, to provide measures for an orderly transition in such areas which are apt to change from rural to urban status with the continuing population expansion and to set reasonable safeguards on residential development. Section 651. PERMITTED USES: In a R-4 Zone no building shall be erected, reconstructed or structurally altered, nor shall any building or land be used for any purpose except as hereinafter speci- fically provided and allowed by this Article, subject to the provis- ions of Article 14 goinrning off-street parking requirements. In an R-4 Zone the following uses only are permitted: 1. One-family, two-family, and multiple family dwel- lings of a permanent character placed in a permanent location. 2. Farming, gardening, fruit raising, nurseries, in- cluding the sale of products raised on the premises provided, stands for the display of such products are not located less than twenty (20) feet from any public street or highway. 3. Home ccupations as specified in Article 2. 4. Public parks and playgrounds including usual park buildings. 5. Churches, provided they meet the requirements set forth in the R-1 Zone. 6. Schools, provided they meet the requirements set forth in the R-1 Zone. 7. Accessory usew appurtenant to any permitted use in- cluding barns, coops, and similar structures provided that no enclo- sures for animals or fowls shall be location less than forty (40) feet from any portion of any adjoining lot which may be occupied by a resi- dence. 8. Livestock (except swine), poultry, rabbits, and bees may be kept. All such animals or fowls shall be kept primarily fotl personal non-commercial use. Section 652; FRONT YARD: Every lot and every parcel in an R-4 Zone shall have a front yard of not less than thirty (30) feet. Section 653: SIDE YARDS: In an R-4 Zone every lot and parcel shall have side yards as follows: i 1. There shall' be a side yard on each side of a building of not less than ten (10) feet, except that on a lot of record at the time of the passage of ordinance of seventy-five (75) feet or less in width the side yard on each side of a building shall not be less than ten (10) per- cent of the width of the lot or parcel, provided that such side yard shall not be less than five (5) feet in width, and need not exceed eight (8) feet in width. 2. Reversed corner lots shall be subject to the requirements set forth in the R-1 Zone. Section 654: AREA. The minimum required area of a lot or parcel in the R-4 Zone shall be not less than one (1) acre. Section 655: LOT AREA PER DWELLING. The lot area per dwell- ing unit shall not be less than the minimum required lot or parcel area. Section 656: PERCENTAGE OF LOT OCCUPANCY In an R-4 Zone no building including its accessory buildings shall occuj5y, or coyer more than thirty-five (35) percent of the total lot area. Section 2. That there is hereby added to Section 800 of Ord- inance B-2095 Paragraphs 19, 20, 21, 22, 23, 24, 25, 26 and 27, which shall read as follows: 19. Tailor and dressmaking shops, including retail sales. 20. Barber and beauty salons. 21. Book or stationery stores and newstands. 22. Florist, gift and jewelry stores. 23. Bakery, retail. 24. Photographic studios and camera shop. 25. Interior decorator and art studios. 26. Music stores, including instrument service and sales. 27. Sports, furniture, hardware and paint, dry goods, drug, shoe, auto supply, department and floor covering and rug stores. 28. Laundro-mat. Section 3. That there is hereby added to Section 900 of Ordinance B-2095 Paragraphs 17, 18, 19, 20, 21 and 22, which shall read as follows: 17. Glass, sales and installation. 18. Frozen food retail lockers. 19. Pet shops. 20. Motorcycle sales and repait,.shops. 21. House trailer and boat sales establishments. 22. Employment offices. Section 4. That there is hereby added to Section 1300 of Ordinance B-2095 Paragraphs 10 and 11, which shall read as follows: 10. Drive-in theaters, provided that such uses shall be specifically excluded from the R-1, R-2, R-3 and B-1 anm 11. Animal hospitals and kennels, provided that such uses shall be specifically excluded from the R-1, R-2, and R-3 Zones. Section 5. This Ordinance shall be in full force and effect 30 days after its passage, approval and publication as provided by law and the City Carter.
