AN ORDINANCE providing for the appropriation of moneys in the Water-Sewer
Fund not provided.for in the 1959 Budget, and declaring an
emergency.
WHEREAS, JudgmentNo. 42086 was handed down January 30, 1959,
.in the Superior Court of the State of Washington, in and for Yakima County,
in the case of A.L. Goodman and J.D. Goodman, a co-partner-ship d.b.a
Goodman Construction Company plaintiff, vs. the City of Yakima, defendant,
and4.
WHEREAS, the Court directed the City of Yakima to pay said
Goodman. Construction Company $982.34, together with interest thereon at the
rate of 6 per cent per annum from August 10, 1956 until paid, and to pay
plaintiff's costs and disbursements in the amount of $36.0, and,
WHEREAS, at the time of the adoption of the 1959 Budget it was
not foreseen that the expenditure directed by the Court would be necessary
and an emergency of the type contemplated by R.C.W. 35.33.090 exists,
now therefore,
BE IT ORDAINEDBY THE CITY OF YAKIMA:
Section 1. That an emergency exists requiring expenditure of
$1,167.50 by the Water-Sewer Fund to satisfy said judgment, and that said
emergency could not be reasonably foreseen at the time of adoption of the
1959 Budget..
Section 2. That there is hereby appropriated the sum of
41,167.50 from unappropriated funds of the Water-Sewer Fund to be charged
to a South Interceptor Sewer account in the Capital or Betterment classi-
fication 6f the 1959 Budget.
SSection 3. The Chief City Accountant is hereby authorized,
empowered and directed to issue warrants to Goodman Construction Company
in the total amount of $1,167.50.
Section This Ordinance is one to provide for the expendi-
ture of funds not budgeted and,is one to provide for the immediate preser-
vation of the public peace, property, health and safety of the people of
the City of Yakima, and an emergency is hereby declared to exist and this
ordinance shall become effective .immediately upon its passage, approval
and publication as provided by law and the City Charter.
PASSED BY THE CITY COMMISSION, signed and approved this 25th
day of February, 1959.
