REPEALED By ORDINANCE No.
ORDINANCE NO. B-2241
AN ORDINANCE adding Section 282,408,508,606,800 and 1618, and amending Sec-
tion 900 and 1606 of Ordinance No. B-2209 "AN ORDINANCE amend-
ing Section 212, Paragraph 2 of Section 400, Paragraph 6 of
Section900, Paragraph 1 of Section 1300 and Paragraph 4 of Sec-
tion 1409; deleting Section 271 and adding Section 281, Para-
.. graph 15 of Section 400, Paragraphs 10 and ii of Section 700,
Paragraphs 15,16 and 17 of Section 800, and Section 1617 of
Ordinance No. B-2095, establishing zones in the City of Yakima;
regulating and limiting the-use of buildings and land; estab-
lishin g use, height, area and off-street park re ulationS•

providing for yards, courts and other open providing
for the adoption of maps showing the boundaries of said zones;

for the violation of its provisions; repealing Ordinances num-

bered B=22,B-35,B-43,B-51, B-71, B-126,B-147, B-172 and B-293,
and all amendmensts thereto, and all other ordinaries in con-
flict herewith; and declaring an emergency."
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That there is hereby added a new Section 282 of
Ordinance No. B-2209, which shall read as follows:
Section 282: YARD,REAR. A yard extending across the full
width of the lot, having at no point less than the minimum required hori-
zontal distance between the rear property line and the closest permissable
location of the main or accessory buildings. Said distance shall be meas-
ured by a line at right angles to the rer property line, or by the radial
line in the case of a curved rear lot line.
Section 2. That there is hereby added a new Section 408 of
Ordinance No. B-2209, which shall read as follows:
Section 408: REAR YEAR. Every parcel and lot in an R-1 Zone
shall have a rear yard Of not less than ten (10) feet. In no case shall a
dwelling or an accessory building be built over an easement for a City
owned or franchised utility.
1==.-Section 3. That there is hereby added a new Section 508 of
Ordinance No.13-2209, which shall read as follows:
Section 508-: REAR YARD. Every parcel and lot in an R-2 Zone
shall have a rear yard of not less than ten (10) feet. In no case shall a
dwelling' or an accessory building be built over an easement for a City
owned or franchised utility.
Section 4. That there is hereby ADDED a new Section 606 of
Ordinance No. B-2209, which shall read as follows:
Section 606: REAR YARD. Every parcel and lot in an R-3 Zone
shall have a rear yard of not less than ten (10) feet. In no case shall a
dwelling or an accessory building be built over an easement for a City owned
or franchised utility.
Section 5. That there is hereby added a new Section 800 of
Ordinance No. B-2209, which shall read as follows:
Section 800: LAND USE.
18. Undertaking establishthents and/or crematories
provided that the following requirements are met:
a. All funeral hOme sites shall have a minimum lot
area of twenty thousand (20,000) square feet.
b. Parking facilities for such use shall be so
arranged that a funeral procession of Twenty (?0) cars can
be accommodated in procession formation within the parking
area.
Section 6. That there is hereby added a new Section 1618 of
Ordinance No. B-2209, which uhall read as follows:

Section 161$: FENCE PROVISIONS. In a R -1, R -2 and R -3 Zone, 1°11
and as an accessory use to a dwelling in any zone, fences, walls and hedges
not more than six (6) feet in height may be permitted in any required yard,
provided, that any fence, wall or hedge over three and one -half (32). feet
in height located in any required front yard shall maintain the side yard
shall maintain the side yard requirements and be located in from thefront
property line a distance of five (5) feet.
Section 7. That Section 900 of Ordinance No. B -2209 be amended
to read as follows:
Section 900: LAND USE.
9. Undertaking establishments and /or crematories pro-
vided they meet the requirements as specified for the same use in a B -2
Zone.
Section $. That Section 1606 of Ordinance No. B -2209 be amend
ed to read as follows:
Section 1606: MODIFICATION OF SIDE REQUIREMENTS FOR ACCESSORY
BUILDINGS. Accessory buildings located within the rear hall
(1/2) of the lot may be built within five (5) feet of the aide property
lines, but must maintain the rear yard requirements.
Section 9. This Ordinance shall be and is, hereby declared to
he in full force and effect thirty (30) days from and after its final
passage, approval and publication, as provided by law and the City Charter.
PASSED BY THE CITY COMMISDION, signed and approved this 22nd

and off- street parking regulations; providing for the adoption of maps
showing the boundaries of said zones; providing 'for a Board of Adjust-
ment; providing for the administration and enforcement of this Ordinance
and fixing penalties for the violation of its provisions; repealing Ordin-
ances numbered B- 22, B- 35,B- 43,B- 51,B- 71,B- 126,B,147, B -172,B -293, and all
amendments thereto, and all other Ordinances and parts of Ordinances in
conflict herewith; and declaring an emergency. ", as passed on the 22nd
day of January, 1959, and that the same has been published as required
by law.
