HomeMy WebLinkAbout1985-2897 MODIFICATION TO PROPERTY AT 208 NORTH 16TH AVENUE ORDINANCE NO.28 9 7 AN ORDINANCE granting a major modification to a Planned Develop- ment Zone applicable to property at 208 North 16th Avenue. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on August 27, 1985, on the recommendation of the Planning Commission that a major modifica- tion be granted to the existing Planned Development Zone appli- cable to property on the northwest corner of the intersection of 16th and Summitview Avenues in the City of Yakima, Washington, and WHEREAS, as a result of its hearing, the City Council hereby makes its following findings and conclusions: FINDINGS: 1. The property on the northwest corner of the inter- section of 16th and Summitview Avenues in the City of Yakima is presently zoned as Planned Development Zone. Property at 208 North 16th Avenue is included within that Planned Development; and originally the existing building was to be converted to a bookstore. The proposed major modification consists of removing that existing building and constructing a new 1,680 square foot building for occupancy by the Pied Piper Childrens Bookstore. The modification includes grading of the site to the existing grade of the Fiddlesticks parking lot and development of a driveway access along the north boundary of the site. While access and parking would continue to be shared indefinitely with the Fiddlesticks development, it is the applicant's intent to insure suitable access and parking in the event that the book- store site is sold separately from the remainder of the Fiddle- sticks development at some future date. In order to accommodate the new building and driveway, five (5) feet of property will be 410 acquired from the adjacent Fiddlesticks site and merged with this property. 2. Existing land use and zoning on adjacent properties is as follows: Zoning Land Use North R-1 Single Family Residential South PD Fiddlesticks East B-2, R-3 Commercial, Multi-Family Res. West R-1 Single Family Residential 3. The proposed development is consistent with the Plan description of Auto Oriented Commercial. The Optimal Land Use Element of the Plan indicates that Auto Oriented Commercial Residential development is conditionally compatible with the Moderate Density Residential development to the north and west and directly compatible with the commercial uses in the area. 4. North 16th Avenue is classified as a Major Arterial Street. 5. An existing six (6) foot high site screening fence located between the site and the Fiddlesticks Store will be moved to the north boundary of the site and provide needed site screening between the development and adjacent residential uses. Use of a six (6) foot high site screening fence between commer- cial and residential uses is consistent with the provisions of the proposed Yakima Urban Area Zoning Ordinance. 6. Nine (9) off-street parking spaces, av on the premises, will adequately serve the proposed ifacility; and access to the off-street parking from North 16th Avenue and the Fiddlesticks parking lot is adequate and will pOse no foresee- able problems. 7. Vacation of the existing irrigation easement and re- location of the irrigation line along the south boundary of the site will be required, with the applicant to be responsible for the costs of engineering and construction. 8. The engineering detail of the proposed i drywell storm drainage system should be subject to review and approval by the City Engineer. 410 9. The Yakima City Planning Commissioil recommended approval of the major modification subject to the conditions set out hereinbelow. -2- CONCLUSIONS: 1. The proposed modification is consistent with the previous planned development 'approval for a bookstore on the site and is consistent with the policies of the Yakima Urban Area Plan, 411 2. The recommendation of the Planning Commission to grant the major modification should be affirmed, and the major modifi- cation request should be granted, subject to the conditions set out hereinbelow, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the major modification to the Planned Development Zone applicable to the following described property at the intersection of 16th and Summitview Avenues in. the City of Yakima, Washington, and more particularly described as follows, to wit: North 49 feet of the south 189 feet of Tract 40, Summitview Acre Tracts, as recorded in Volume "A" of Plats, Page 30, records of Yakima County, Washington. be, and the same is hereby, approved and the property is hereby rezoned as Planned Development Zone to include the major modifi- cation proposed by the development plan and program approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof; provided, the major modification is granted subject to the following conditions: 1. The irrigation easement along the south boundary of the property shall be vacated and the irrigation line relocated in accordance with specifications and subject to the approval of the City Engineer. 2. The proposed storm drainage system engineering design shall be submitted to and subject to the approval of the City Engineer. • 3. A four (4) foot strip of the property shall be dedi- cated as additional right-of-way for 16th Avenue prior to the issuance of a building permit. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4.
