AN ORDINANCE providing for the vacation of that certain alley between
Lots 16 and 40, Shannon Home Plats, running from South
29th Avenue to South 29th Avenue, reserving unto the City an
easement to the City of Yakima for a sanitary sewer, and an
8 inch storm sewer now running along said alley, TOGETHER
WITH the right of ingress and egress for the repair and re-
placement of said sewers; SUBJECT TO a provision that no
buildings be erected over said sewer lines, said property -
II situated in Yakima, YakimaCounty, Washington.
WHEREAS, a petition has been filed with the City Commission
of the City of Yakima prociding for the vacation of the hereinafter des-
cribed property; and
WHEREAS, by resolution adopted by the City Commission, a
hearing on said petition was set for the 18th day of June, 1958, at the
hour of 10:00 o'clock a.m. in the office of the City Commission at the
City Hall, Yakima, Washington, and notices thereof were duly given in the
manner provided by statute and by the City L 'lerk of said City; and
WHEREAS, upon the hearing on said petition no objection was
made thereon or filed, and it being deemed for the best interests of the
City of Yakima that said petition be granted and portion of said street be
vacated;
NOW, THEREFORE, BE IT ORDAINED 3Y THE CITY OF YAKIMA:
Section 1. That the following described alley in the City
of Yakima, Washington, to-wit:
That certain alley between Lots 16 and 40, Shannon Home Plats,
running

reserving
unto the City an easement to the City of Yakima for a sanitary
TOGETHER WITH the right of ingress and egress for the repair
and replacement of said sewers; SUBJECT TO a provision that
no buildings be erected over said sewer lines, said property
being situated in Yakima, Yakima County, Washington,
be and the same is hereby vacated.
Section 2. The City of Yakima hereby reserves all necessary
easements and rights-of-way for the installation and maintenance of any
and all water mains, sewers or utilities of any and all kinds which may
now exist in said alley or which it may hereafter desire to construct
therein, without interference with any existing building thereon.
Section 3. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and the City Charter.
PASSED. BY THE CITY COMMISSION, signed and approved this 18
day of June, 1958.
