B -2174 ANLORDINANCE providing for a licensefbr the delivery of gasoline and oil to the Yakima Municipal Airport, and fixing rental charges for the purpose of delivering oil and gasoline to the N Municipal Airport, defining offenses and providing penalties, repealing Ordinance Nos. B -804 and B -1365, and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That from and after the first day of July, 1958, it shall be unlawful for any oil company, association, corpora- l' tion, firm, person or concern to make delivery of gasoline or oil or any petroleum products to the Yakima Municipal Airport without first securing a lincense so to do hereby designated as "Airport Petroleum License." Such license shall be obtained from the City Clerk and shall expire on the 1st day of July of each year. The annual fee for such license is hereby fixed in the sum of 0.0.00. Section 2. That from and after the first day of July, 1958, all oil companies, persons, firms or corporations engaged in the business of selling or delivering gasoline or lubricating oil to aviators, aviation companies or commercial operators, located on the Yakima Municipal Airport shall pay a rental charge of .010 or each gallon of gasoline delivered to the Municipal Airport and none% on each gallon of oil delivered to the Municipal Airport. Section 3. That each of said oil companies or licensees so delivering gasoline or lubricating oil to the Municipal Airport shall on or before the 10th day of each month render to the Finance Commission- er of the City of •akima a statement showing the number of gallons of oil and gasoline delivered to the Municipal Airport the previous month, to whom delivered, and the amount due the City therefor pursuant to this ordinance, and accompany such statement with the remittance of the amount due. Section 4 . That ordinance ` o. B -804 passed and approved by the City Commission on the 2nd day of September, 1947, and Ordinance No. B -1365 passed and approved April 28, 1952, be and the same are hereby repealed. Section 5. Any person, firm, or corporation, or any officer or agent thereof, who shall fail to comply with any of the provi of this ordinance shall be deemed guilty of a misdemeanor and upon convic- tion thereof shall be punished by a fine in any sum not exceeding $300.00 or by imprisonment in the City Jail for a term not exceeding 90 days, or both such fine and imprisonment. Section 6. This ordinance is one to provide for the im- mediate preservation of the public peace, property, health and safety, and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and the City Charter.
