HomeMy WebLinkAbout1997-015 Rezone R . , e l ORDINANCE NO. 97 - 15 AN ORDINANCE rezoning 0.77 acre in the vicinity of 3601 and 3515 Powerhouse Road in Yakima, Washington, from Single - Family Residential (R -1) to Light Industrial (M -1) and amending the zoning map of the Yakima Urban Area accordingly. WHEREAS, on November 14,1996, the Hearing Examiner conducted a duly convened public hearing on the application (UAZO RZ #6-96) submitted by Gary Germunson on behalf of property owners Gary and Rita Germunson and Philip Mills, requesting amendment of the Official Yakima Urban Area Zoning Map within the City of Yakima and rezone from Single- Family Residential (R -1) to Light Industrial (M -1) of 0.77 acre in the vicinity of 3601 and 3515 Powerhouse Road in Yakima, Washington (referred to below as "the Subject Property"), which is comprised of Yakima County Assessor's Parcels #181315 -42404 and #181315 - 42405; and WHEREAS, by Recommendation dated November 26,1996, the Hearing Examiner recommended that the requested rezone be granted; and WHEREAS, on January 7, 1997, the City Council duly conducted a public meeting to consider the proposed rezone and determined to adopt the Hearing Examiner's Recommendations; and _ WHEREAS, (1) the Subject Property is suitable for uses permitted in the Light Industrial (M -1) District and any problems with neighborhood compatibility can be resolved; (2) there exists a public need for the proposed rezone; (3) since the existing zoning was ® established circumstances have changed and now make the proposed rezone appro- priate; and (4) the proposed rezone is consistent with and complies with: (a) the require- ments and considerations set forth in Yakima Municipal Code Chapter 15.23; (b) the goals and policies of the Yakima Urban Area Comprehensive Plan; (c) the intent of the Yakima Urban Area Zoning Ordinance; and (d) other applicable land use controls; and WHEREAS, the proposed Rezone approval conforms with the requirements of City of Yakima Zoning Title, and other applicable land use controls; and WHEREAS, the best interests of the City of Yakima would be advanced by the • proposed rezone and by granting the requested Rezone approval; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The City Council finds formally that: (1) the Subject Property is suitable for uses permitted in the Light Industrial (M -1) District and any problems with neighborhood compatibility can be resolved; (2) there exists a public need for the proposed rezone; (3) since the existing zoning was established circumstances have changed and now make the proposed rezone appropriate; and (4) the proposed rezone is consistent with and complies with: (a) the requirements and considerations set forth in Yakima Municipal Code .Chapter 15.23; (b) the goals and policies of the Yakima Urban Area Comprehensive Plan; (c) the intent of the Yakima Urban Area Zoning Ordinance; and (d) other applicable land use controls. The Official Yakima Urban Area Zoning Map within the City of Yakima is amended to rezone from Single - Family Residential (R -1) to Light Industrial (M -1) 0.77 acre in the vicinity of 3601 and 3515 Powerhouse Road in Yakima, Washington (referred to below as "the Subject Property"), and legally described as follows: PARCEL No. 18131542404 The S 60 feet of the following described tract: Lot 12 Van's Half Acre Tracts, according to the official plat thereof recorded in Volume "D" of Plats, page 8, records of Yakima County, Washington, EXCEPT the N 140 feet of the E 54 feet thereof. PARCEL No. 18131542405 Lot 12 Van's Half Acre Tracts, as recorded in Volume "D" of Plats, page 8, records of Yakima County, WA, EXCEPT the N 140 feet of the E 54 feet thereof, and EXCEPT the S 60 feet. Section 3. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. Subject to the foregoing provisions and conditions, this ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and . by the City Charter, and this action shall be final and conclusive unless within 30 days from the date of final action by the City Council an aggrieved party obtains an appropriate writ of judicial review from the Yakima County Superior Court for the purpose of review of the action taken.
