AN ORDINANCE relating to health and sanitation; adjusting fees for various services
for garbage storage, collection, and disposal; and amending City of
Yakima Municipal Code Section 4.16.140.
BE IT ORDAINED BY THE CITY OF YAKIMA:
1 Section 1. Section 4.16.140 of the City of Yakima Municipal Code is hereby
2 amended to read as follows:
3 "4.16.140 Classification of premises — Charges.
4 • A. For the purpose of regulating the collection of garbage and refuse
5 in the City of Yakima there are hereby established two classifications: One to be
6 known as the "residential classification," and the other as the "business
7 classification." The residential classification shall include all premises occupied
8 as a single- family housekeeping unit, either in dwelling houses, apartments, or
9 other multiple residences. "Residential unit" as used herein, is defined as a unit
0 0 1 in which all persons reside together as a single family, whether in single or
multiple dwellings. The business classification shall include all other premises.
12 Provided, property owned by the City may be served by City equipment
13 and crews independently of the classifications and rates established by this
14 chapter; provided further, the rules and regulations established by this chapter
15 pertaining to receptacles and to the preparation, storage, and collection of
16 garbage, refuse and debris shall be applicable to all property within the City,
17 including that owned by the City.
18 B. The collection of all refuse in the business classification shall be
19 made only by licensed collectors, hereinafter provided for, at rates to be agreed
20 upon between such collector and the business houses served by him.
21 C. The collection of all refuse in the residential classification shall be
22 conducted by the City of Yakima equipment and personnel and financed by
23 garbage and refuse collection fees hereinafter set forth. The City of Yakima shall
24 not collect refuse from apartments or multiple units in excess of four units except
25 .upon the request of the owner or operator thereof. The following collection fees
26 and practices shall apply for all garbage collection services conducted by the City
27 of Yakima..

30 single - family dwelling and for each residential unit in any multiple dwelling:
31 Basic charge for one -can
32 residential service at alley

43 "Call -back charge" as used herein means a charge to be imposed when any
44 customer fails to place the garbage can at the appropriate place for collection
45 during the regularly scheduled pickup, resulting in a customer request for
46 garbage collection service at a time other than the regularly scheduled time.

76 2. A surcharge, in addition to the charges imposed by subsection
77 (C)(1) of this section, is hereby imposed on each residential unit as a charge for
78 service performed by the City for collecting yard material during the nine -month
79 period of each year commencing March 1st and ending November 30th. The
80 surcharge, to be known as the "yard service charge," shall be the amount of eight
81 dollars and ninety-nine cents ($8.99) per month, and shall be billed to
82 each residential unit at the time and as a part of the billings rendered for other
83 City services applicable for that nine -month period.
84 Any person billed for such yard service charge who does not utilize any
85 such additional refuse collection service may request such surcharge to be
86 canceled from his billing by notifying the utility accounts office of the City of
87 Yakima; and upon such notification being made the request for such cancellation
88 shall be granted, subject to verification by the City that such additional service is
89 not utilized.
90 Where refuse collection service is performed for multiple dwellings
11 1 wherein all units are carried under a single account number and street address
2 for water department metered services, the multiple dwelling shall be deemed a
93 single residential unit for the purpose of computing the surcharge imposed by
94 this section.
95 3. All of the charges for garbage and refuse collection provided in
96 subsections (C)(1) and (C)(2) shall be billed for and paid at the same time and for
97 the same period as billings and payments are made for other City utility services;
98 or, in the event a customer is served by the municipal garbage division but is not
99 served with other City utility, garbage and refuse collection charges shall be
100 billed and paid for according to the schedule which would be applicable to such
101 customer were he so served with another City utility service. Accounts shall
102 become delinquent if not paid within the time specified by. Section 7.68.025 for
103 payment of water service charges.
104 4. Garbage and refuse collection charges will be suspended for any
105 customer upon advance notice to the office of the division of utility accounts that
106 . a particular premises served will be unoccupied and such charges will be
107 resumed on notice to such office to resume service. No such suspension of
108 ' charges for garbage and refuse collection service will be made for any premises
109 - served with any other City utility unless all City utility service to such premises
110 is likewise suspended.
11 Application for resumption of service to a new customer shall be made to •
12 • 'the office of the division of utility accounts on forms provided for that purpose
111111 13 which shall contain the name of the customer and the street address and number
114 • of units of the premises to be served.

115 5. Collection . service may be suspended for nonpayment of accounts,
116 but such suspension shall not relieve the person owing such account from the
117 duty of complying with the provisions of this chapter or other ordinances
118 pertaining to garbage, refuse, or sanitation. Such suspension of service shall
119 render the premises where such collection service is suspended subject to
120 condemnation for lack of sanitary requirements, and the owner or person in
121 charge or in possession of said premises shall be subject to prosecution for
122 maintaining a nuisance thereon. .
123 6. Upon failure to pay such charges and upon delinquency, the
124 amount thereof shall become a lien against the property from which the garbage
125 . collection service shall have been rendered. Such lien shall be made effective by
126 filing a notice thereof specifying the charges, the period covered by the charges
127 and giving a legal description of the premises at which the service was rendered.
128 Such lien shall be filed with the same official and within the time and shall be
129 foreclosed within the time and manner prescribed by law for filing and
130 foreclosing liens for labor and material, and shall be superior to encumbrances
131 filed subsequent to the filing of such line, but shall be subject to all general taxes
132 and local improvement assessments, whether levied prior or subsequent thereto.
133 D. The yard service collection, for which the yard service charge is
134 imposed by subsection (C)(2) of this section, shall include the collection of yard
135 material from automated /semiautomated plastic containers furnished, by the
136 City Department of Public Works or, as an alternative, yard material, not to
137 exceed the equivalent of - five containers, bags or boxes (each of which shall not
138 exceed thirty- two - gallon capacity) per week during the nine -month period for
139 which the yard service charge is billed to any particular premises. Except for tree
140 and shrub trimmings, the yard material shall be collected in nonporous,
141 disposable containers, bags or boxes to be collected and disposed of along with
142 the yard material contents, and collection crews shall not be required to return
143 containers used for disposing yard material. The yard material which will be so
144 collected shall not include trees or large limbs; and tree and shrub trimmings not
145 susceptible to being stored for collection in containers, bags or boxes shall be
146 securely tied in bundles not to exceed two feet in diameter or four feet in length.
147 Yard trimmings must not be placed against any building or fence so as to
148 constitute a fire hazard. City service does not include the collection of discarded
149 fruit from trees, nor rubbish or debris of any kind except in minor quantities
150 resulting from construction, alterations, demolition, remodeling or landscaping
151 of any property. Grass, rakings or rubbish must be in nonporous containers.
152 E. In addition to the regulations adopted and charges imposed by
153 subsections C and D of this section, further charges are imposed in the following
154 types of service: .
155 1. A charge of one dollar and eighty cents ($1.80), in
156 addition to the regular monthly charge, shall be made each time an extra can or
157 partial can of refuse or yard material is collected from any particular residential
158 premises;

2. A charge of one dollar and twenty eight thirty -four cents ($1.34), in
160 addition to the surcharge for collecting refuse and yard material, shall be made
161 " for each extra container, bag, box or bundle of tree or shrub trimmings, collected
162 from any particular residential premises.
163 3. For a special garbage pickup, actual cost shall be charged to the
164 customer. Actual cost shall include the City's actual cost for labor, equipment
165 rental, and landfill fees. The minimum charge for this service shall be twenty -
166 five dollars."
167 Section 2. This ordinance shall be in full force and effect 30 days after its passage,
168 approval, and publication as provided by . law and by the City Charter.

SUMMARY EXPLANATION:
The 1998 Refuse Division Budget includes a budgeted policy issue to increase refuse rates. At
the 1998 Budget Wrap -up held December 9,1997, City Council approved a 5% rate adjustment
on residential can service, yard service, bin service and charges for extra containers. The
increase in refuse rates is estimated to generate an additional $130,160 in revenue for 1998.
The attached Ordinance contains revisions to Subsections 4.16.140C and 4.16.140E of the
Municipal Code. Amended refuse rates will become effective thirty days after publication,
