• AN ORDINANCE relating to City personnel; adopting a classification and compensation
plan for City employees to be effective October 1, 1997; amending
Subsections 2.20.100 A, 2.20.100 C, 2.20.100 D, 2.20.110 A,
2.20.110 G, 2.20.110 I, and 2.20.110 J, all of the City of Yakima
Municipal Code.
WHEREAS, the City Council finds and declares an emergency to exist so as to
authorize the immediate effectiveness of this ordinance in order to adjust the employee salaries to
be effective October 1, 1997 as required by collective bargaining agreements between the City
and certain employee groups and otherwise as authorized during consideration by the Council of
the 1997 budget, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Subsection 2.20.100 A of the City of Yakima Municipal Code is hereby amended
to read as follows:
"2.20.100 Classification Plan.
A. Plan Adopted. A classification plan for city employees is hereby adopted to be
effective October 1, 1997, which plan shall consist of the various following subsections of this section."

Section 4. Subsection 2.20.110 A of the City of Yakima Municipal Code is hereby amended to
read as follows:
"2.20.110 Compensation Plan. A. Pay ranges and pay steps, set out in the schedule
o nstituting Subsection B through M of this section, for the classes allocated to these pay ranges shall be
full force and effect as of October 1, 1997. The pay rates shall constitute full compensation for those
employees with a work week of forty hours as set out in other sections of this code. Employees whose
work week is less than forty hours shall be paid at the rate which is in the same proportion to the rates
set out herein that their work week bears to forty hours. The hourly rate for those employees of the Fire
Department whose work week exceeds forty hours shall be computed according to the provisions of
Section 2.22.030 of this code.
The performance of employees in the series designated Subsection B through E shall be
evaluated annually in accordance with a management performance evaluation plan. The result of the
performance evaluations shall be the determination by the City Manager of the actual salary of each
employee in the designated positions, and the determination by the City Council of the actual salary of
the City Manager, which actual salaries shall be no less than the minimum nor no greater than the
maximum set out in the pay range applicable to the position, according to the following schedule:"

ITEM TITLE An Ordinance Amending the Classification and Compensation Plan for
Certain City Employees

SUMMARY EXPLANATION:
On March 20, 1997, the City of Yakima filed a petition for clarification of an existing bargaining
unit with the Public Employment Relations Commission (PERC) to exclude the classifications of
Accountant, Accounting Technician, Buyer and Supervising Code Inspection from the AFSCME
bargaining unit. The City's position was that the Buyer and Supervising Code Inspector should
be excluded from the bargaining unit due to supervisory responsibilities and that the Accountant
and Accounting Technician should be excluded on the basis of confidentiality. Subsequently, the
PERC scheduled a unit clarification hearing for September 9, 1997. Immediately preceding the
hearing, the Examiner requested the parties to try to resolve the issue one last time without going
to formal hearing. Consequently, in lieu of the hearing, the parties negotiated a settlement in
ow hich it was agreed by the City and AFSCME that the classifications of Accountant and
Supervising Code Inspector be excluded from the bargaining unit while the Buyer and
Accounting Technician remain in the unit. The PERC Hearing Examiner drafted the
memorandum of understanding in this matter. It was further agreed that this exclusion from
the bargaining unit be effective on October 1, 1997.
Based upon the parties agreement, this Ordinance amends the Classification and Compensation
Plan by reallocating the current classification of Supervising Code Inspector, Classification Code
4431 currently in the Code Inspection Series at Pay Range 20.0 ($3,059 -3,676 per month) to the
Union Exempt Supervisory Group as Supervising Code Inspector, Classification Code 11251 at
Pay Range 376 ($3,059 -3,676 per month). Further, according to the same agreement, this
Ordinance amends the Classification and Compensation Plan by reallocating the current
classification of Accountant, Classification Code 2311 currently in the Fiscal Series at Pay Range
19.0 ($2,926 -3,515 per month) to the Union Exempt Management Support Group as Accountant,
Classification Code 10302 at Pay Range 334 ($2,926 -3,515 per month).
