AN ORDINANCE relating to traffic; prohibiting parking between the curb and
sidewalk or within 10 feet of the curb or edge of the roadway; and
enacting as a new section, Section 9.50.085, of the City of Yakima
Municipal Code.
WHEREAS, the City Council finds that generally, motor vehicles parked within
the planting strip in the residential portions of east Yakima endanger pedestrians and
motor vehicle traffic, and
WHEREAS, state law prohibits motor vehicle parking within planting strips as
determined by sidewalks or right of way boundaries, but where no sidewalk is present
and the right -of -way boundaries are irregular, as they are in the eastern portion of
Yakima, enforcement of the state law prohibition is unpracticable, and
WHEREAS, the City Council finds that pedestrians and motor vehicle traffic in
east Yakima will be safer if sidewalks and the area between the sidewalks and the curb
or at least 10 feet from the edge of the pavement or curb is generally kept clear of
parked motor vehicles, and
WHEREAS, the City Council finds that pedestrian and motor vehicle safety do
not conflict with motor vehicle parking on the public right of way in certain
circumstances, including where suitable improvements have been made to
accommodate motor vehicle parking on the public right of way, and
WHEREAS, chapter 8.66 of the Yakima Municipal Code currently provides for
motor vehicle parking between the curb line and the property line under certain
circumstances, and
WHEREAS, the City Council finds that because of the public safety concerns
created by motor vehicles parked between the sidewalk and the curb or within the area
10 feet from the edge of the pavement or curb in east Yakima, it is in the best interest of
the city to generally prohibit motor vehicle parking between the sidewalks and the curb
or at least 10 feet from the edge of the pavement or curb in east Yakima, now therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. NEW SECTION: Section 9.50.085 is hereby enacted as a new section of the
Yakima Municipal Code to read as follows:
"9.50.085 Stopping, standing, or parking within 10 feet of the curb
prohibited in specified places .
(1) Except when necessary to avoid conflicts with other traffic, or in
compliance with law or the directions of a police officer or official traffic
control device, or when permitted under 'chapter 8.66 of the Yakima
Municipal Code, no person shall stop, stand, or park a vehicle:
S (a) on any sidewalk or between any sidewalk and the curb or
f the paved roadway, or
(b) within the area extending 10 feet from the curb line or edge
of roadway where no sidewalk is present.

(2)This prohibition shall apply to the area east of the Burlington Northern
Railroad tracks. •
Section 2. This ordinance shall be in full force and effect 30 days after its passage,
approval, and publication as provided by law and by the City Charter.

ITEM TITLE: Ordinance prohibiting parking between the curb and sidewalk or within 10
feet of the curb or edge of the roadway; and adding a new section, Section 9.50.085 to
the City of Yakima Municipal Code.

SUMMARY EXPLANATION: This ordinance addresses concems voices by citizens in
the eastern portion of Yakima regarding dangers to pedestrians and motor vehicle traffic
created by motor vehicles parked off the street in the public right of way. Enforcement of
the state law prohibition against parking in the planting strip is unworkable because it
requires identification of the property line. The proposed new section would prohibit
parking within 10 feet of the curb or edge of the pavement where there is no sidewalk.
Where there is a sidewalk, motor vehicle parking on the sidewalk or between the sidewalk
and the curb is also prohibited.
Finally, there are circumstances in which motor vehicle parking on the public right of way
does not endanger pedestrians or motor vehicle traffic. Chapter 8.66 YMC provides for
permits to park between the curb and the property line. The ordinance provides an
exception for parking permitted under chapter 8.66.

STAFF RECOMMENDATION: PASS THE PROPOSED ORDINANCE AND DIRECT
THE POLICE DEPARTMENT AND THE DEPARTMENT OF COMMUNITY AND
ECONOMIC DEVELOPMENT TO REVIEW THE PROVISIONS OF CHAPTER 8.66 OF
THE YAKIMA MUNICIPAL CODE TO VERIFY THAT IT REMAINS APPROPRIATE.
