HomeMy WebLinkAbout1998-071 Refuse rates , . 0 ORDINANCE NO. 98- 71 AN ORDINANCE relating to health and sanitation; adjusting fees for various services for garbage storage, collection, and disposal; and amending City of Yakima Municipal Code Section 4.16.140. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 4.16.140 of the City of Yakima Municipal Code is hereby amended to read as follows: 1 4.16.140 Classification of premises— Charges. 2 A. For the purpose of regulating the collection of garbage and refuse 3 in the City of Yakima there are hereby established two classifications: One to 4 be known as the "residential classification," and the other as the "business 5 classification." The residential classification shall include all premises 6 occupied as a single - family housekeeping unit, either in dwelling houses, 7 apartments, or other multiple residences. "Residential unit" as used herein, is 8 defined as a unit in which all persons reside together as a single family, 9 whether in single or multiple dwellings. The business classification shall 10 include all other premises. 1 Provided, property owned by the City may be served by City equipment • 2 and crews independently of the classifications and rates established by this 13 chapter; provided further, the rules and regulations established by this chapter 14 pertaining to receptacles and to the preparation, storage, and collection of 15 garbage, refuse and debris shall be applicable to all property within the City, 16 including that owned by the City. 17 B. The collection of all refuse in the business classification shall be 18 made only by licensed collectors, hereinafter provided for, at rates to be agreed 19 upon between such collector and the business houses served by him. 20 C. The collection of all refuse in the residential classification shall be 21 conducted by the City of Yakima equipment and personnel and financed by 22 garbage and refuse collection fees hereinafter set forth. The City of Yakima 23 shall not collect refuse from apartments or multiple units in excess of four 24 units except upon the request of the owner or operator thereof. The following 25 collection fees and practices shall apply for all garbage collection services 26 conducted by the City of Yakima. 27 1. There are hereby imposed for refuse collection in the residential 28 classification the following charges for each single - family dwelling and for each 29 residential unit in any multiple dwelling: _. .. A surcharge, in addition to the charges imposed by subsection 4 (C) (1) of this section, is hereby imposed on each residential unit as a charge for 75 service performed by the City for collecting yard material during the 76 nine -month period of each year commencing March 1st and ending November 77 30th. The surcharge, to be known as the "yard service charge," shall be the 78 amount of eight dollars and ninety -nine cents ($8.99) per month, . and shall be 79 billed to each residential unit at the time and as a part of the billings rendered 80 for other City services applicable for that nine -month period. 81 Any person billed for such yard service charge who does not utilize any 82 such additional refuse collection service may request such surcharge to be 83 canceled from his billing by notifying the utility accounts office of the City of 84 Yakima; and upon such notification being made the request for such 85 cancellation shall be granted, !' subject to verification by the City that such 86 additional service is not utilized. 87 Where refuse collection 1 service is performed for multiple dwellings 88 wherein all units are - carried under a single account number and street address 89 for water department metered services, the multiple dwelling shall be deemed a 90 single residential unit for the purpose of computing the surcharge imposed by 91 this section. II 92 3. All of the charges for garbage and refuse collection provided in 93 subsections (C)(1) and (C)(2) shall be billed for and paid at the same time and 43 4 for the same period as billings and payments are made for other City utility 5 services; or, in the event a customer is served by the municipal garbage 96 division but is not served with other City utility, garbage and refuse collection 97 charges shall be billed and paid for according to the schedule which would be 98 applicable to such customer were he so served with another City utility service. 99 Accounts shall become delinquent if not paid within the time specified by 100 Section 7.68.025 for payment of water service charges. 101 4. Garbage and refuse collection charges will be suspended for any 102 • customer upon advance notice to the office of the division of utility accounts 103 that a particular premises served will be unoccupied and such charges will be 104 resumed on notice to such office to resume service. No such suspension of 105 charges for garbage and refuse collection service will be made for any premises 106 served with any other City utility unless all City utility service to such premises 107 is likewise suspended. 108 Application for resumption of service to a new customer shall be made to 109 the office of the division of utility accounts on forms provided for that purpose 110 which shall contain the name of the customer and the street address and 111 number of units of the premises to be served. 112 5. Collection service may be suspended for nonpayment of accounts, 113 but such suspension shall not relieve the person owing such account from the 114 duty of complying with the provisions of this chapter or other ordinances 15 pertaining to garbage, refuse, or sanitation. Such suspension of service shall 6 render the premises where such 'collection service is suspended subject to ORDINANCE AMENDING YMC 4.16.140 REFUSE COLLECTION RATES —Page 3 117 condemnation for lack of sanitary requirements, and the owner or person in 118 charge or in possession of said premises shall be subject to prosecution for 119 maintaining a nuisance thereon. 120 6. Upon failure to pay such charges and upon delinquency, the 121 amount thereof shall become a lien against the property from which the 122 garbage collection service shall have been rendered. Such lien shall be made 123 effective by filing a notice thereof specifying the charges, the period covered by 124 the charges and giving a legal description of the premises at which the service 125 was rendered. Such lien shall be filed with the same official and within the 126 time and shall be foreclosed within the time and manner prescribed by law for 127 filing and foreclosing liens for labor and material, and shall be superior to 128 encumbrances filed subsequent to the filing of such line, but shall be subject 129 to all general taxes and local improvement assessments, whether levied prior or 130 ( subsequent thereto. 131 D. The yard service collection, for which the yard service charge is 132 imposed by subsection (C)(2) of this section, shall include the collection of yard 133 material from automated /semiautomated plastic containers furnished by the 134 City Department of Public Works or, as an alternative, yard material, not to 135 exceed the equivalent of five containers, bags or boxes (each of which shall not 136 exceed thirty- two - gallon capacity) per week during the nine -month period for 137 which the yard service charge is billed to any particular premises. Except for 138 tree and shrub trimmings, the yard material shall be collected in nonporous, 139 disposable containers, bags or boxes to be collected and disposed of along with 140 the yard material contents, and collection crews shall not be required to return 141 containers used for disposing yard. material. The yard material which will be so 142 collected shall not include trees or large limbs; and tree and shrub trimmings 143 not susceptible to being stored for collection in containers, bags or boxes shall 144 be securely tied in bundles not to exceed two feet in diameter or four feet in 145 length. Yard trimmings must not be placed against any building or fence so as 146 to constitute a fire hazard. City service does not include the collection of 147 discarded fruit from trees, nor rubbish or debris of any kind except in minor 148 quantities resulting from construction, alterations, demolition, remodeling or 149 landscaping of any property. Grass, rakings or rubbish must be in nonporous 150 containers. 151 E. In addition to the regulations adopted and charges imposed by 152 subsections C and f) of this section, further charges are imposed in the 153 following types of service: 154 1. A charge of one dollar and eighty -four cents ($1. 891.84), in 155 addition to the regular monthly charge, shall be made each time an extra can 156 or partial can of refuse or yard material is collected from any particular 157 residential premises; 158 2. A charge of one dollar and thirty- feurseven cents ($4,341.37), in 159 addition to the surcharge for collecting refuse and yard material, shall be made 160 for each extra container, bag, box or bundle of tree or shrub trimmings, 161 collected from any particular residential premises. Actual cost shall include the City's actual cost for labor, equipment 64 rental, and landfill fees. The minimum charge for this service shall be twenty 165 five dollars. 166 Section 2. At the December 8, 1999 Budget Wrap -up, City Council approved a 2% rate adjustment on residential can service including charges for extra containers and an 8% rate adjustment on bin service. The increase in refuse rates is estimated to generate an additional $51,000 in revenue for 1999. • The attached Ordinance contains revisions to subsections 4.16.140C and 4.16.140E of the Municipal Code. Amended refuse rates will become effective thirty days after publication.
