HomeMy WebLinkAbout1998-062 Mobile Home Parks ORDINANCE NO. 98- 62 AN ORDINANCE relating to land use and development regulation, and adding new standards for development of mobile /manufactured home parks to chapter 15.04 of the Yakima Municipal Code. WHEREAS, pursuant to the provisions of the Urban Area Regional Planning Agreement, the Regional Planning Commission and the Joint Board have reviewed . and recommended the following proposed new standards for development of mobile /manufactured home parks for enactment by the City of Yakima; and WHEREAS, the City Council has reviewed the following proposed new standards for development of mobile /manufactured home parks and finds that it is in the best interest of the City to enact the proposed new standards for development of mobile /manufactured home parks as a new section in chapter 15.04 of the Yakima Municipal Code; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. A new section 15.04.115 is hereby added to the Yakima Municipal Code to read as follows: 1 15.04.115 Standards for mobile /manufactured home parks. 2 A. Purpose. The purpose of this section is to establish standards and criteria for 3 development and expansion of mobile /manufactured home parks within the urban area. 4 These standards are provided to ensure uniform, coordinated development of 5 mobile /manufactured home parks and to ensure the general health, welfare and safety of the 6 occupants of mobile /manufactured homes that may be located within a park developed under 7 these standards. These standards shall be applied in a manner that stresses minimizing costs. 8 Alternatives that reduce costs and meet the intent of these standards will be encouraged. 9 B. Site Plan Requirements. All proposals for mobile /manufactured home parks shall 10 include a site plan based upon a land survey drawn by a licensed architect, engineer or 11 surveyor and shall include the following information in addition to the standard information 12 required for site plans: 13 1. All spaces shall be clearly delineated on the site plan and include dimensions and 14 square footage for each space; 15 2. A building envelope shall be shown within each space; 16 3. Unit setbacks shall be shown for each space; • 17 4. The location of required parking for each unit shall be shown on the site plan; 18 5. Streets shall be shown on the site plan; 19 6. Signage for the park and directional signage shall be shown on the site plan; 20 7. The location of all solid waste containers and screening of containers shall be shown 21 on the site plan; 22 8. All facilities, utilities, improvements and amenities shall be shown on the site plan, 23 including pathways, sidewalks, and recreational facilities. 24 C. Development Standards. All mobile /manufactured home parks shall be developed in 25 compliance with the underlying zoning district and shall be in compliance with this section. 26 The density of a park or park expansion shall not exceed the density of the underlying zoning Page 1 of 3 27 district. All required site improvements shall be installed prior to placement of units in the 28 park. Additional site improvements may be required by the reviewing official. 29 1. Minimum Space Size and Width. The minimum space size and width for a 30 mobile /manufactured home park exclusive of streets shall meet the lot size, lot width and all 31 other standards for detached single- family dwellings, as shown on Table 5 - of this title. Space 32 size may be reduced with the provision of improvements in accordance with the following: 33 a. Provision of Recreational Areas. Space size requirements of the underlying district 34 may be reduced by a maximum of ten (10) percent with the provision of a developed 35 recreational area for use by the residents. The area shall be suitable for active recreation and 36 shall consist of a minimum of ten (10) percent of the park area. 37 b. Provision of Sidewalks. Space size requirements of the underlying district may be 38 reduced by a maximum of ten (10) percent with the provision of sidewalks a minimum of 39 four (4) feet in width, serving at least one side of each street and all recreational areas. 40 c. Provision of Curbs, Gutters and Sidewalks. Space size requirements of the underlying 41 district may be reduced by a maximum of ten (10) percent with the provision of curbs, gutters 42 and sidewalks on both sides of the street. 43 d. Cumulative Space Size Reduction. Space size may be reduced up to twenty (20) 44 percent with the provision of any combination of items a through c above. 45 2. Internal Street Paving. A minimum of twenty -four (24) feet of paved internal street 46 shall be required for access to each unit, paved in accordance with section 15.06.110 of this 47 title. 48 3. Off - Street Parking. Two paved off - street parking spaces shall be provided for each 49 unit in accordance with this ordinance, section 15.06. 50 4. Street Lighting. A street light shall be provided at each street intersection within the 51 park. 52 5. Right -of -Way Dedication and Frontage Improvements. Appropriate provisions for 53 right -of -way dedication and right -of -way improvements adjacent to the park shall be made, 54 including street paving, sidewalks, curb, gutter, and street lighting. Improvements shall be 55 installed prior to placement of units in the park, unless an appropriate bond or instrument 56 acceptable to the City or County is provided to guarantee installation of improvements. 57 6. Street Signs and Internal Directional Signs. All streets within the park shall be named 58 utilizing blue street signs consistent with City of Yakima public street signs. Internal 59 directional signs indicating unit /space numbers shall be placed at all street intersections within 60 the park. 61 7. Utilities. All utilities, including irrigation and domestic water and sewer, shall be 62 installed prior to placement of units in the park. All utilities, including electrical distribution, 63 telephone, and cable TV, shall be installed underground. The internal water system shall 64 include fire hydrants located at the direction of the City of Yakima Fire Department or 65 appropriate County Department. 66 8. Minimum Unit Separation. Units shall be separated by a minimum of ten (10) feet, 67 measured from the furthest extremity of each unit, including stairways. 68 9. Perimeter Sitescreening and Landscaping. The perimeter of a park shall be 69 sitescreened with a six- foot -high, view - obscuring fence and shall include at a minimum a ten- Page 2 of 3 70 foot -wide landscape strip adjacent to the fence and within the park consisting of a 71 combination of shrubs, trees and groundcover. 72 10. Stormwater Drainage. All stormwater drainage shall be retained on site, and a 73 drainage plan shall be approved by the City /County. 74 11. Dumpsters /Solid Waste Containers. Dumpsters and solid waste containers shall be 75 provided for common use and shall be screened with a six - foot -high, view - obscuring fence or 76 wall and access gate. 77 12. Play Area Requirement. Each unit shall provide a play area for children contained 78 within the unit's space, consisting of a minimum size of 600 square feet and a minimum width 79 of 15 feet. 80 D. Expansion of Existing Mobile /Manufactured Home Parks. All standards of this 81 section shall apply to expansion of existing mobile home parks. The standards shall not apply 82 to existing areas of a park not being expanded. The Examiner may, at his or her discretion, 83 reduce one or more standards of this section for newly expanded areas of a park if expansion 84 plans also include improvements to the existing park area. 85 E. Maintenance of Common Areas, Landscaping and Open Space /Recreational Areas. 86 All common areas and facilities, including streets, walkways, utilities, landscaping, storage 87 areas, open space and recreational areas, shall be continuously maintained in good condition 88 by the park owner or designated homeowner's association. An irrigation system shall be 89 installed for maintenance of landscaping and recreational /open space areas that would 90 normally require irrigation. 91 F. Development Under Planned Development Provisions of This Ordinance. 92 Development of a mobile /manufactured home park may be accomplished under the Planned 93 Development provisions of this title. Section 2. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance, or any provision of the Yakima Municipal Code established by this ordinance, is declared invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining portions of this ordinance, or other provisions of the Yakima Municipal Code established by this ordinance. • Section 3. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. The Hearing was continued to receive final testimony, and direct legislation. A series of ordinances has been prepared for consideration.
