ORDINANCE NO. 98- 59
AN ORDINANCE relating to land use and development regulation; adding new definitions
and providing zoning classifications for airport- related uses to
5 15.02.020 YMC; and amending S 15.09 :020(C) YMC regarding project
review in overlay districts.
WHEREAS, pursuant to the provisions of the Urban Area Regional Planning Agreement,
the Regional Planning Commission and the Joint Board have reviewed and recommended the
following proposed new definitions and proposed zoning classifications for. airport- related
uses, and the following proposed amendment to § 15.09.020(3) YMC regarding project review
in overlay districts for enactment by the City of Yakima; and
WHEREAS, the City Council has reviewed the following proposed new definitions and
proposed zoning classifications for airport- related uses and finds it is in the best interests of
the City that the proposed new definitions be added to § 15.02.020 YMC; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTON:
Section 1. New definitions shall be added to § 15.02.020 of the Yakima Municipal Code to
read as follows:
1 "Airport Operations" means activities, uses, structures and facilities that are located on
2 and necessary to the operation of the Yakima Municipal Airport. These activities and
3 facilities include runways, taxiways, parking ramps and aprons, navigation and radar /radio
4 communication facilities and equipment, safety and emergency facilities, and storage and
5 maintenance facilities. Airport operations in the Light Industrial District (M -1) and Central
6 Business District Support (CBDS) are exempt from the Class 2 review requirement of
7 § 15.09.020(2) YMC.
8 "Airport Industrial" means research, design, fabrication and assembly of aircraft, aircraft
9 parts, and aviation - related products located on the Yakima Municipal Airport. This use also
10 includes storage and wholesale trade of aviation - related products and air cargo operations and
11 associated storage and. processing. Airport Industrial uses in the Light Industrial District (M -1)
12 and Central Business District Support (CBDS) are exempt from the Class 2 review
13 requirement of § 15.09.020(2) YMC.
14 "Airport Commercial" means the retail sale of aviation- related products and services
15 including aircraft service and rental, air passenger services, and air terminal activities including
16 passenger ticketing, baggage, taxi service, car rental, restaurants, hotels and gift shops. Airport
17 Commercial uses in the Central Business District Support District (CBDS) are exempt from
18 the Class 2 review requirement of § 15.09.020(2) YMC.
Section 2. Airport Operations uses shall be classified Class 1 in the M -1 and CBDS zoning
districts. Airport Industrial uses shall be classified Class 1 in the M-1 and CBDS zoning
districts. Airport Commercial uses shall be classified Class 1 in the CBDS zoning district.
These classifications shall be displayed in Table 4 -1 provided at § 15.04.030.

Section 3. Section 15.09.020(C) of the Yakima Municipal Code is amended to read as follows:
1 c. Project Review in Overlay Districts. In order to assure the appropriate standards are
2 applied, all Class (1) uses in an overlay district unless otherwise specified, shall be subject to
3 Class (2) review (Chapter 15.14). All Class (2) uses shall be subject to Class (2) review and
4 Class (3) uses in an overlay district shall be subject to Class (3) review. A reviewing official
5 may condition or deny approval of any use, development, or modification thereto, in an
6 overlay district based on the provisions set forth and adopted by this section.
Section 4. Severability: If any section, subsection, paragraph, sentence, clause or phrase of
this ordinance, or any provision of the Yakima Municipal Code established by this ordinance,
is declared invalid or unconstitutional for any reason, such decision shall not affect the
validity of the remaining portions of this ordinance, or other provisions of the Yakima
Municipal Code established by this ordinance.
Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval,
and publication as provided by law and by the City Charter.
PASSED BY THE CITY COUNCIL at a regular meeting and signed and approved

SUMMARY EXPLANATION:
On October 20, 1998 the Yakima City Council and Yakima County Commissioners
opened a Joint Public Hearing to consider testimony regarding the adoption of a series
of Implementation Ordinances, as recommended by the Yakima Urban Area Regional
Planning Commission. The Hearing was continued to receive final testimony, and direct
legislation. A series of ordinances has been prepared for consideration.

STAFF RECOMMENDATION: Consider final testimony, consider previous testimony ,
direct changes as necessary and adopt ordinances
BOARD RECOMMENDATION: The Yakima Urban Area Regional Planning
Commission recommended adoption of ordinances. Several ordinances and map
changes have been submitted to the RPC recommendation and included herein.
