ORDINANCE NO. 98- 58
AN ORDINANCE concerning land use comprehensive planning and the Yakima Urban
Area Comprehensive Plan: (1) to adopt an amended Future Land Use
Map; and (2) to adopt Figure III -3; and (3) to amend Commercial Land
Use Definitions to allow residential uses in all commercial districts; and •
(4) to adopt an Updated Transportation Plan.
WHEREAS, pursuant to the provisions of the Urban Area Regional Planning Agreement,
the Regional Planning Commission and the Joint Board have reviewed and recommended the
following proposed amendments to the Yakima Urban Area Comprehensive Plan for
enactment by the City of Yakima; and
WHEREAS, the City Council has reviewed the following proposed amendments to the
Yakima Urban Area Comprehensive Plan and finds that it is in the best interest of the City to
enact the proposed amendments; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA,
WASHINGTC)N:
1 Section 1. The document labeled "Future Land Use Map Public Hearing 11/24/98" attached
2 to this ordinance is adopted as the Future Land Use Map of the Yakima Urban Area
3 Comprehensive Plan, and any previous Future Land Use Maps are removed from the plan.
4 Section 2. The document labeled "Proposed New Comprehensive Plan Figure III - 3" attached
5 to this ordinance is adopted as Figure III -3 of the Yakima Urban Area Comprehensive Plan.
6 Section 3. The following definitions of the Commercial Use Designations for the Future
7 Land Use Map element appearing at page III - 12 of the Yakima Urban Area Comprehensive
8 Plan are amended to read as follows:
9 • Professional Office
10 Includes financial institutions, real estate, insurance, engineer, legal, medical offices and
11 other similar business uses, and all residential uses.
12 • Neighborhood Commercial
13 Small scale shopping centers, with shared parking and access, usually located on
14 arterial streets, and all residential uses. Neighborhood commercial centers are
15 dispersed throughout the Urban Service Area to provide convenience shopping to the
16 residential population.
17 • Large Convenience Center -
18 Provides areas for commercial activities to meet retail shopping and service needs of
19 - the community, and areas for all residential uses. Accommodates clusters of retail,
20 financial, professional service business and entertainment activities that attract
21 shoppers from an area significantly larger than a neighborhood. Regional centers may
22 be considered appropriate when they demonstrate that they will complement, and not
23 have a detrimental impact on existing commercial areas or surrounding land uses.

24 • Arterial Commercial
25 Land uses which require high auto visibility such as restaurants, service stations, car
26 washes, as well as wholesale and retail activities, and provides areas for all residential
27 uses.
28 • CBD Core Commercial •
29 The Yakima Downtown area is the regional center for commerce, cultural and
30 governmental land uses. This area provides for a wide variety of intense retail, office,
31 institutional and high dcnsity all residential land uses. Encouragement should be given
32 to supportive land uses which foster the unique, regional nature of the Yakima CBD.
33 Section 4. The document labeled "Transportation Plan February 1998" attached to this
34 ordinance is adopted as the Transportation Plan of the Yakima Urban Area Comprehensive
35 Plan, and any previous versions of the Transportation Plan are removed from the plan.
Section 5. Severability: If any section, subsection, paragraph, sentence, clause or phrase of
this ordinance, or any provision of the Yakima Urban Area Comprehensive Plan established
by this ordinance, is declared invalid or unconstitutional for any reason, such decision shall
not affect the validity of the remaining portions of this ordinance, or other provisions of the
Yakima Urban Area Comprehensive Plan established by this. ordinance.
Section 6. This ordinance shall be in full force and effect 30 days after its passage, approval,
and publication as provided by law and by the City Charter.

Figure III -3 provides a guide to the compatibility of land use designations and zoning
districts. Districts that fully implement the land use designation are marked with an "X ".
In addition, districts that may implement the purposes of the land use designation based
onsite - specific considerations are marked with " *" to indicate that the district may be
considered compatible with the comprehensive plan designation as a Class 2 or 3 use, or
if coupled with a Planned Development Overlay. The Planned Development Overlay is
intended to allow specific projects to proceed when the include uses allowed in the
underlying, provided they are . consistent with the objectives of the comprehensive plan
policies and land use map designation. The overlay requires a detailed site plan, and may
include restrictions on permitted uses, height, site coverage, setback, or other features, as
necessary to assure compatibility with the comprehensive plan designation and
neighboring land uses. All other rezone proposals are not consistent with the
comprehensive plan, and require a comprehensive plan amendment. Under RCW
36.70A.130, those amendments may occur no more frequently than once every year.

SUMMARY EXPLANATION:
On October 20, 1998 the Yakima City Council and Yakima County Commissioners
opened a Joint Public Hearing to consider testimony regarding the adoption of a series
of Implementation Ordinances, as recommended by the Yakima Urban Area Regional
Planning Commission. The Hearing was continued to receive final testimony, and direct
legislation. A series of ordinances has been prepared for consideration.

STAFF RECOMMENDATION: Consider final testimony, consider previous testimony ,
direct changes as necessary and adopt ordinances
BOARD RECOMMENDATION: The Yakima Urban Area Regional Planning
Commission recommended adoption of ordinances. Several ordinances and map
changes have been submitted to the RPC recommendation and included herein.
COUNCIL ACTION:
