HomeMy WebLinkAbout1998-047 Rezone r 0 ORDINANCE NO. 98- 47 AN ORDINANCE concerning land use and zoning, rezoning two parcels in the vicinity of 1107 South 18th Street from Two - Family Residential (R -2) to Light Industrial (M -1) and amending the Official Yakima Urban Area Zoning Map accordingly; and granting Class 2 approval, and granting Class 3 approval for use of a third parcel as an amusement park. WHEREAS, Wendy Hollingsworth, d /b /a Circle "H" RV Ranch, Inc., has requested: (1) amendment of the Official Yakima Urban Area Zoning Map to rezone 2.85 acres consisting of two parcels of land in the vicinity of 1107 South 18th Street, Yakima, Washington (Yakima County Assessor's Parcel #'s 191329 -12023 and 191329 - 12007) (referred to below as "the Subject Property ") from Two - Family Residential (R -2) to Light Industrial (M -1); (2) Class 2 approval for expansion of the RV campground; and (3) Class 3 approval for use of a third parcel (Yakima County Assessor's Parcel #191329 12006) as an amusement park (Department of Community and Economic Development files UAZO RZ #10 -98, CL(2) #25 -98, CL(3) #7 -98, respectively);_and WHEREAS, on July'23,1998, the City of Yakima Hearing Examiner conducted a duly convened open record public hearing regarding the requested rezone, Class 2 zoning 0 review and Class 3 zoning review, and after considering the contents of the file and evidence received at the public hearing, issued his Examiner's Recommendation, Examiner No. 1U98- 12 -21, dated August 13, 1998; and WHEREAS, the Hearing Examiner recommended: (1) The Subject Property should be rezoned from Two - Family Residential (R -2 to Light Industrial (M -1); and (2) Class 2 approval of the RV campground expansion and Class 3 approval for use of the third parcel, already zoned M -1, for an amusement park should be granted, subject to certain conditions stated on pages 8 and 9 of the Examiner's Recommendation; and WHEREAS, at its regular public meeting on September 15, 1998, the City Council duly considered the requested rezone and Class 2 and Class 3 approvals, and the Hearing Examiner's Recommendation; and WHEREAS, after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council finds with respect to the requested rezone,: , 1. The Subject Property is suitable for uses permitted in the Light Industrial (M -1) zoning district; • • ORDINANCE: REZONE, CLASS 2 AND 3 APPROVAL Page 1'of 4 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing zoning was established which now make the requested rezone appropriate; and 4. The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in chapter 15.23 of the Yakima Municipal Code; b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; d. Other applicable land use controls; and WHEREAS, after considering the Hearing Examiner's Recommendation, the contents of the file, and the statements of interested persons, the City Council finds that, subject to the conditions stated on pages 8 and 9 of the Hearing Examiner Recommendation, the requested Class 2 and Class 3 approvals should be granted; and WHEREAS, it is in the best interests of the City to adopt the Hearing Examiner's findings and conclusions and recommendation to approve the requested rezone and, subject to the conditions stated on pages 8 and 9 of the Hearing Examiner Recommendation, to grant the requested Class 2 and Class 3 approvals; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: • Section 1. The Yakima City Council adopts the findings, conclusions and recommendations of the Hearing Examiner's Recommendation, Examiner No IU98- 12 -21, issued August 13, 1998, and incorporates that Hearing Examiner's Recommendation by reference as part of this ordinance. Section 2. Regarding the Subject Property, which is located in the vicinity of 1107 South 18th Street in Yakima, Washington, and legally described as: Assessor's Parcel # 191329- 12007: Beginning at a point 160 feet East and 434 feet North of the SW corner of the NW 1/4 of the NE 1A of Section 29, Township 13 North, Range 19, E.W.M.; thence East and parallel to section line 305.6 feet; thence South and parallel to section line 100 feet; thence West and parallel to section line 305.6 feet; thence North 100 feet to the point of beginning. Assessor's Parcel # 191329- 12023: A tract of land lying in the NW 1 A of the NE 1A of Section 29, Township 13'North, Range 19 East, W.M., beginning at an iron pin 1767.9 feet North and 30 feet East of the monument marking the center of said Section 29, said iron pin being the intersection of the east line of a 60 foot county road with the north line of a ORDINANCE: REZONE, CLASS 2 AND 3 APPROVAL Page 2 of 4 private lane running East as the same now exists; thence running North 89 °20' East 570 feet to an iron pin; thence North 451 feet to an iron pin; thence South 89 °20' West 600 feet to an iron pin on the West line of the NW 1 /4 of the NE 1/4 of . said Section 29, thence South along this line 166.5 feet to an iron pin on the northeasterly side of the county road; thence South 26 °30' East 68.4 feet to an iron pin; thence 223.3 feet to the point of beginning; EXCEPT that portion conveyed to the State of Washington for State Highway No. 3. Both Situated in Yakima County, Washington. The City Council finds formally that: 1. The Subject Property is suitable for uses permitted in the Light Industrial (M -1) zoning district; 2. There exists a public need for the requested rezone; 3. Circumstances have changed since the existing zoning was established which now make the requested rezone appropriate; and 4. The requested rezone is consistent with and complies with: a. The requirements and considerations set forth in Chapter 15.23 Yakima Municipal Code; 4110 b. The goals and policies of the Yakima Urban Area Comprehensive Plan; c. The intent of the Yakima Urban Area Zoning Ordinance; and d. Other applicable land use controls. Section 3. The Official Yakima Urban Area Zoning Map is amended to rezone the Subject Property from Two - Family Residential (R -2) to Light Industrial (M -1). Section 4. Subject to the conditions stated in Section 6 below, Class 2 approval is granted for expansion of the RV campground on the Subject Property. Section 5. Subject to the conditions stated in Section 6 below, Class 3 approval is granted for use of the following- described parcel as an amusement park. Assessor's Parcel #191329-12006: That portion of the East 404.19 feet of the West 900 feet of the South 434 feet of the NW 1/ of the NE 1/4 lying Southwesterly of the state highway EXCEPT that portion of the above description beginning 24 feet North of the SW corner of the NW 1/4 of the NE 1 /, thence East 700 feet, thence South 18.67 feet to the point of beginning • Section 6. Conditions: The Class 2 and Class 3 approvals provided herein are subject to the following conditions: 1. The expansion of the RV campground and associated amusement area shall be developed in general conformance with the plans on file with the Department of • ORDINANCE: REZONE, CLASS 2 AND 3 APPROVAL Page 3 of 4 Community and Economic Development (UAZO CL(3) #7-98; RZ #10-98; CL(2) #25- 98 and EC #16-98). A final site plan shall be submitted to the Planning Division prior to issuance of a Certificate of Zoning Review which shows the following: 2. Minimum 24 -foot, two -way and 18 -foot, one -way travel lanes shall be required within the campground and amusement area. All internal travel lanes shall be paved, with adequate storm water drainage systems installed. 3. Adequate vehicle turn- around areas where required for maneuvering. 4. Location and detail of any additional signage shall also be submitted with the final site plan. All signage shall be subject to the sign standards in the M -1 zoning district. 5. Certificates of Occupancy for both uses are required. Compliance with the final site plan is required, prior to issuance of the certificates. Section 7. The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 8. Subject to the foregoing provisions and conditions, this ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter, and this action shall be final and conclusive unless within 21 days from the date this ordinance is passed by the City Council an aggrieved party commences proceedings for review pursuant to the provisions of Chapter 36.70C RCW. Also included in the Council action was approval of a Class 3 Review for development of an amusement park at the RV park.
