HomeMy WebLinkAbout1998-034 Vacation accrual for police officers • ORDINANCE NO. 98- 34 AN ORDINANCE relating to personnel; providing compensation under limited circumstances to the chief of the fire department and the chief, captains and lieutenants of the police department for vacation leave accrued in excess of the maximum vacation leave accrual amount under Section 2.40.020 of the Yakima Municipal Code; and amending Subsection B of Section 2.40.020 of the City of Yakima Municipal Code. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Subsection B of Section 2.40.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "2.40.020 Vacation leave. B. Accumulation of Vacation. (1) An employee within the bargaining unit of the American Federation of State, County and Municipal Employees may accumulate vacation leave time in an amount equal to the vacation time the employee earns during two years of service, according to the accrual rate specified in subsection A (1) of this section. (2) Subject to subsection B (3), aAn employee in the exempt classification, as specified in Section 2.20.100 of this code, the chief and deputy chief of the fire department and the chief, captains and lieutenants of the police department may accumulate vacation leave time in an amount equal to the vacation time the employee earns during two years of service, according to the accrual rate specified in subsection A (2) of this section. (3) Effective January 1, 1998, for the chief and deputy chief of the fire department, and the chief, captains, and lieutenants of the police department, at the end of each year any vacation leave accumulated in excess of the limits specified in subsection B (2) shall be paid to the respective employee at the rate of 100% of the employee's base wage in effect as of December 31 of that year; provided, however, that the employee must use at least 75% of his /her vacation leave accrued during that year in order to qualify for the payment unless some or all of the employee's scheduled vacation leave use for that year is cancelled and cannot be rescheduled that year, and such prevents the employee from complying with the 75% vacation leave use requirement. At the end of each year all vacation leave accrued in excess of the limits specified in B (2), but for which the employee does not qualify for payment, shall be transferred to the management extended sick leave pool established under Section 2.40.110. (3) All other employees covered by this chapter except those affected by subsections B (1) and B (2) above may accumulate vacation leave time not to exceed two hundred forty hours. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. City Attorney CONTACT PERSON /TELEPHONE: Chief Blesio (575 -6211) SUMMARY EXPLANATION: For many years, police officers of the City of Yakima Police Department have been allowed to accrue vacation leave in excess of the limits provided in both the Yakima Municipal Code and the applicable Collective Bargaining Agreement (" CBA"). In turn, police officers have been compensated for their excess vacation leave upon retirement. This practice has promoted optimum police staffing levels for maximum public safety at a reasonable cost. It has also resulted in the creation of large excess vacation leave balances and corresponding unfunded economic liability. City management desires to eliminate these large vacation leave balances and, yet, still maintain a vacation leave program for police officers that encourages optimal staffing levels within the financial constraints of the City budget. These goals can be accomplished through the adoption of a vacation leave accrual program similar to that currently available for City firefighters and by compensating police officers for excess vacation leave balances in effect as of January 1, 1998. To that end, City management recommends approval of an ordinance amendment of YMC 2.40.020 regarding vacation leave accrual, and a resolution authorizing both amendment to the vacation leave accrual portion of the current CBA with the Yakima Police Patrolman's Association and compensation of police officers for excess vacation leave balances in effect as of January 1, 1998.
